The Maryland Chamber is seeking nominees for the 2008 Maryland Business Philanthropy Awards . We present the awards each year in partnership with the Baltimore Business Journal. Nominate your business or another deserving business today. Maryland Chamber member businesses contribute millions of dollars and tens of thousands of man-hours to worthy causes each year. We’re looking for outstanding examples of business philanthropy and volunteerism from companies of all sizes. Nominations must be received by 4 p.m., Wednesday, September 17, 2008. The nominations will be judged by a panel of business and community leaders. Maryland Chamber Launches Environmental Task Force

The Maryland Chamber’s Board of Directors has launched a board-level task force to research and evaluate environmental issues and promote more balanced environmental policy. There was a lot of debate on environmental and energy related issued during the 2008 General Assembly session. Issues like global warming and greenhouse gas reduction, Maryland’s looming energy, and more were debated last year and will be back in 2009. The Chamber’s new task for with meet during the interim (May thru September), to develop a proactive plan to encourage balanced environmental policy that addresses environmental concerns while maintaining the interests of the business community. Chamber Urges Governor O'Malley to Veto the Flexible Leave Act

Maryland Chamber President & CEO Kathy Snyder sent a letter to Governor Martin O’Malley yesterday urging him to veto HB 40, the Flexible Leave Act. The General Assembly passed the bill, which will require employers of 15 or more employees, who provide paid leave, to allow their employees to use their leave (sick, vacation or compensatory time) for the illness of a child, spouse or parent. Employees who earn more than one type of leave with pay may elect the type and amount of leave with pay to be used. The Maryland Chamber opposes this bill because it is an unnecessary government intrusion into the employer-employee relationship that undermines employment policies. Small Employer Wellness Regulations Published

Regulations were published last week that will implement the wellness component of health care initiatives passed as Senate Bill 6 of the 2007 special session of the General Assembly. Two parts of that law deal with wellness programs: (1) Requiring prominent health insurance carriers to offer wellness benefits in the small group market; and (2) Requiring small employers (2 - 9 employees) to offer a wellness benefit as a prerequisite to receiving a state subsidy through the Small Employer Health Benefit Plan Premium Subsidy Program. Legislation Would Moderate Onerous Corporate Reporting Requirements

During the November 2007 special session, the Maryland General Assembly passed legislation creating the Maryland Business Tax Reform Commission. The Commission will review and evaluate the state’s current business tax structure and make recommendations for changes. Policies to be studied include mandatory unitary combined reporting, gross receipts taxes, value added taxes, alternative minimum taxes, and more. While the Maryland Chamber was pleased the study arose as an alternative to mandatory unitary combined reporting, the legislation as drafted goes beyond what the government needs to do further analysis. As part of the study, the legislation imposes extensive new reporting requirements on corporations. No other state imposes reporting requirements that are this extensive. Bills Would Enforce State Fraud Statutes with Bounty Hunting Trial Lawyers

Maryland Chamber Vice President Ron Wineholt testified today in opposition to SB 215 and HB 292, two bills that would establish additional penalties for the filing of a false claim for state benefits and contracts. The bills would also authorize a person to file suit on behalf of the state for an alleged false claim for state benefits and contracts and recover up to 30 percent of the proceeds of the suit, plus attorney fees and costs. The Maryland Chamber believes that Maryland should directly prosecute any person who defrauds the state under a benefit program or contract. However, we believe it is inappropriate for the state to create a new private cause of action for the enforcement of state fraud statutes. This type of system will lead to needless litigation and harassment of government contractors by overzealous trial lawyers. Members in the News: Computer Services Sales Tax

Yesterday, two Maryland Chamber members were featured in news reports regarding their reactions to the computer services sales tax passed during the 2007 special session and set to take effect on July 1. The Washington Post ran this op-ed by Tom Loveland, CEO of Mind Over Machines and co-founder of the Maryland Computer Services Association. In the op-ed, Loveland said: “This new tax, which takes effect in July, will put many Maryland businesses at a severe disadvantage. Innovative technology fuels business growth and job creation, but it can be expensive and risky. So it’s often the last thing a business invests in, using the final dollars of its technology budget, if any remain. But now those final dollars will be diverted to the tax, significantly curbing investment in innovation and dampening job creation. Sun Editorial: Lawmakers Acted Rashly in Passing the Tech Tax

In its lead editorial today, “Much ado about little,” the Baltimore Sun slipped in a reference to the computer services sales tax that’s worth illuminating: The legislature’s actions last year on taxes were far from flawless. Like the GOP, we would hope to see a reconsideration of its decision to apply the sales tax to computer services, for instance, because we believe lawmakers acted rashly with that particular measure. But that’s a decision that should turn on the merits of the proposal, not on a technicality. Lawmakers did act rashly in passing the computer services sales tax without meaningful public input. Had they sought input from impacted companies, they would have known that this new tax will stifle economic growth and damage Maryland’s competitiveness.
