I am now making all my payments on time and would save $ 400 a mont on my house payment. I am in my late 50s retired on a fixed disability income. I live in the PNW where home prices are still on the rise. If I do this refin it would add another 20k to my mortgage. My house is valued at 400k. I presently owe 240k. What should I do? Help!!!!

the seller was going to draw up a sales agreement but never did so i told the seller i would try to close on 1-25-08 some issues came up with finances and i called and told them i would have to make closing 2-15-08 the seller said no they were not waiting til then they are selling to another party for more money can they just sell to someone else keep in mind all i have done up to now is give a deposit and thats it no sales agreement or anything in writing other than the check as a doposit

My daughter lived with me during 2007 from Jan - July. She was a full-time student. She was married on July 7. She needs to file her income tax NYS --- Can she file Married Filing Separately and allow me to claim her as a dependent or does she have to claim herself or allow her husband to claim her. She made very little money. If I can claim her will this cause a problem fo her husband on his taxes? At this point I believe they do not plan to file jointly.

We sold our home in MN in July. The buyers noticed strong sewer odors in the basement following a very hard rain in August. They subsequently Oct ended up replacing the tank and line leading from the house to the tank at a cost of $4400 which we are being asked to pay.I am not in dispute with the buyers. We had a similar problem during the first 2-3 years we lived there during very heavy rains and had various professionals look at the system. Approx 3 years prior to the sale we had the plumbing vent system redone just before spending $50000 to remodel the home. The problem never returned until after we sold the home.The day before the septic system inspection the buyers agent called to see if the inspection had been done. He also asked if we had ever had a problem since the disclosure said nothing. Our closing date was Oct. 31 2007. We replaced a cracked well tile about a month before the closing. We told our realtor and the buyers. There was no problem. We explained to them about the ground not being solid because it was dug up to put new tile in. So when it rained the well got murky. After the sale they called us about the water being murky. We went up there to see if we could help them. We ended up buying them a top of the line water filter that goes directly onto holding tank. Also explained other things they could do to help it. All ws well for a couple of months. They still owe us money from the sale. I recently asked them for it and now they want us to replace the dug well. There was nothing writen in our contracts about this. I just want to know my legal rights as a seller. can they do this? Thank You in advance for any advice.

I lived with my girlfriend in a public housing NYCHA for over a period of ten 10 years.. She died last year and never put my name on the LEASE dispite my numerous request for her to do so. I have witnesess to that effect! I received a Notice to Quit and Notice of Termination of Tenancy on December 2007. I paid the rent under my girlfriends name for November 2007 December 2007 and for January 2008. But NYCHA claims that my girlfriends lease has expired due to her death. Anyway I was served with Notice of Petition on Holdover Proceedings and a hearing is escheduled for February 11 2008. Is NYCHA correct about her lease being terminated. NYCHA continues to send documents and even a request for renewal of lease on my girlfriends name. Also I went through administrative hearings and my request for sucession of rights and to be granted a lease with NYCHA as a Remaning Family Member was denied on November 2007. a brokerbuyer offered a 184-k offer we accepted 100-k dn. taking back a 2nd. for the 84-k.the contract did not state the 84-2nd. but they gave me an addendum to the contract. now the next day they came back w2nd. contract of 110-k we accepted with the 84-k addendum. they said they needed a 10-k commission to fix up the property.the bank loaned on a 114-k cert. appraisal with 88-kfinannced by bank with fed. secured funfs buyer put the balance of 110-k at closing and walked out w a 10-k commission from the proceeds.the bank did not know of the 84-k 2nd. broker said we would sign on the 2nd. outside of closing and the bank. dont need to know anything about it.what is my legal position here can I file complaiant to the board of REsue for the 10-k or what...NO LISTING CONTRACT HERE...

I have agreed to write off any remaining balance on a 2nd mortgage I am holding.I have been asked to sign a stmt indicating that I have received payment in full for this mortgage. This is not the same thing right? Please advise on how I should re-write the sentence so that it clearly states that I will write off a $ amt and have not received any type of pmt Thank you.
