The Inter national Criminal Court (ICC) was established in 2002 as a permanent tribunal to prosecute individuals for genocide, crimes against humanity, war crimes, and the crime of aggression, although it cannot currently exercise its jurisdiction over the crime of aggression. The court can only prosecute crimes committed on or after July 1, 2002, the date its founding treaty, the Rome Statute of the International Criminal Court, entered into force. 104 states are currently members of the Court, and a further 41 countries have signed but not ratified the Rome Statute. However, a number of states, including the United States, China and India, continue to oppose it. The Court can generally only exercise jurisdiction in cases where the accused is a national of a state party, the alleged crime took place on the territory of a state party, or a situation is referred to the Court by the United Nation s Security Council. As stated in Article 93 of the UN Charter, all 192 UN members are automatically parties to the Court's statute. Non-UN members may also become parties to the Court's statute under the Article 93(2) procedure. For example, before becoming member nations, Switzerland used this procedure in 1948 to become a party; Nauru also became a party in 1988. Once a state is a party to the Court's statute, it is entitled to participate in cases before the Court. However, being a party to the statute does not automatically give the Court jurisdiction over disputes involving those parties. The issue of jurisdiction is considered in the two types of ICJ cases: contentious issues and advisory opinions.

The ICJ is composed of 15 judges elected to nine year terms by the UN General Assembly and the UN Security Council from a list of persons nominated by the national groups in the Permanent Court of Arbitration. The election process is set out in Articles 4-12 of the ICJ statute. Judges serve for nine year terms and may be re-elected. Elections take place every three years, with one-third of judges retiring each time, in order to ensure continuity within the court. Should a judge die in office, the practice has generally been to elect a judge of the same nationality to complete the term. No two may be nationals of the same country. According to Article 9, the membership of the Court is supposed to represent the "main forms of civilization and of the principal legal systems of the world". Did you know that there is a system in our constitution, as per the 1969 act, in section " 49-O " that a person can go to the polling booth, confirm his identity, get his finger marked, and convey the presiding election officer that he / she doesn't want to vote anyone!Yes, such a feature is available, but obviously these seemingly notorious leaders have never disclosed it. This is called "49-O".Why should you go and say "I VOTE NOBODY"? ... Because, in a ward, if a candidate wins, say by 123 votes, and that particular ward has received " 49-O " votes more than 123 , then that polling will be cancelled and will have to be re-polled. Not only that, but the candidature of the contestants will be removed and they cannot contest the re-polling, since people had already expressed their decision on them.This would bring fear into parties and hence look for genuine candidates for their parties for election. Role of the Security Council

Under Chapter Six of the Charter, "Pacific Settlement of Disputes", the Security Council "may investigate any dispute, or any situation which might lead to international friction or give rise to a dispute". The Council may "recommend appropriate procedures or methods of adjustment" if it determines that the situation might endanger international peace and security. These recommendations are not binding on UN members. Under Chapter Seven, the Council has broader power to decide what measures are to be taken in situations involving "threats to the peace, breaches of the peace, or acts of aggression". In such situations, the Council is not limited to recommendations but may take action, including the use of armed force "to maintain or restore international peace and security". Under article 27 of the UN Charter decisions in the 15-member Security Council on all substantive matters-for example, a decision calling for direct measures related to the settlement of a dispute-require the affirmative votes of nine members. A negative vote-a veto-by a permanent member prevents adoption of a proposal, even if it has received the required number of affirmative votes. Abstention is not regarded as a veto despite the wording of the Charter. Since the Security Council's inception, China (ROC/PRC) has used 5 vetoes; France, 18; Russia/USSR, 122; the United Kingdom, 32; and the United States, 81. The United Nation s Security Council (UNSC) is the organ of the United Nations charged with maintaining peace and security among nations. While other organs of the United Nations only make recommendations to member governments, the Security Council has the power to make decisions which member governments must carry out under the United Nations Charter. The decisions of the Council are known as United Nations Security Council Resolutions. The Security Council is made up of 15 member states, consisting of five permanent seats and ten temporary seats. The permanent five are China, France, Russia, the United Kingdom and the United States. These members hold veto power over substantive but not procedural resolutions. The ten temporary seats are held for two-year terms with member states voted in by the UN General Assembly on a regional basis. The Presidency of the Security Council is rotated alphabetically each month.

On 21 March 2005, Secretary-Gene ra l Kofi Annan presented a report, In Larger Freedom, that criticized the General Assembly for focusing so much on consensus that it was passing watered-down resolutions reflecting "the lowest common denominator of widely different opinions." He also criticized the Assembly for trying to address too broad an agenda, instead of focusing on "the major substantive issues of the day, such as international migration and the long-debated comprehensive convention on terrorism." Annan recommended streamlining the General Assembly's agenda, committee structure, and procedures; strengthening the role and authority of its President; enhancing the role of civil society; and establishing a mechanism to review the decisions of its committees, in order to minimize unfunded mandates and micromanagement of the UN Secretariat.
