2008-02-01 12:54:00
Unauthorized debit, deceptive marketing at issueA company that marketed Visa- and MasterCard-branded prepaid debit cards to subprime consumers has agreed to settle Federal Trade Commission charges that it made unauthorized debits from consumers’ bank accounts and engaged in deceptive marketing practices. The settlement requires EdebitPay, LLC, EDP Reporting, LLC, EDP Technologies Corporation, Secure Deposit Card, Inc., Dale Paul Cleveland, and William Richard Wilson, all located in Los Angeles, to pay $2,258,258 for consumer redress, plus the proceeds from the sale of an automobile. In addition, Dale Paul Cleveland must pay taxing authorities an additional $667,288.According to the FTC’s complaint, the defendants marketed bank-issued prepaid debit cards under a variety of names through Web sites and pop-up and e-mail advertisements that directed consumers to sites for the individual cards (including Acclaim Visa, Impact Visa, Sterling Visa, VIP Advantage Visa, Vue Visa, Elite Plus...

WATCH OUT FOR 'FREE OFFERS'
2008-02-01 12:35:00
Very few things are free, Iowa AG warnsIowa Attorney General Tom Miller is warning consumers to be wary of free gifts and free trial offers. Instead of getting something for free, Miller says these gifts always come with plenty of expensive strings attached. In many cases, Miller says consumers get charged for products and services without even knowing it.The charge – for things like buying club memberships and credit card protection plans - appears automatically when the free trial period ends."Consumers often are surprised when – and if – they discover the unexpected bill," Miller said. "The problem seems to stem from two things: First, consumers may not realize a seller already has the key information to bill their credit card or checking account. Second, some sellers may use questionable tactics to try to shift the burden onto the consumer to cancel."Link to complete story: http://www.consumeraffairs.com/news04/200 8/01/free_offers.html~Sandy G.

CELEBREX MAY DISRUPT HEART RHYTHM
2008-01-31 14:46:00
Popular COX-2 drug can induce arrhythmia, study findsCelebrex, a popular arthritis drug that blocks pain by inhibiting an enzyme known as COX-2, has been shown in laboratory studies to induce arrhythmia, or irregular beating of the heart.University at Buffalo researchers, conducting basic research on potassium channels, found that low concentrations of the drug, corresponding to a standard prescription, reduced the heart rate and induced pronounced arrhythmia in fruit flies and the heart cells of rats. The drug inhibited the normal passage of potassium ions into and out of heart cells through pores in the cell membrane known as delayed rectifier potassium channels, according to the study, which appears in the Jan. 18 edition of the Journal of Biological Chemistry."The adverse effects of drugs like Celebrex and Vioxx based on their selective inhibition of COX-2 currently are a topic of intense discussion in the medical community," said Satpal Singh, Ph.D., associate professor of pharm...

SENIORS SHOULD BE WARY OF REVERSE MORTGAGE SCAMS
2008-01-31 14:24:00
Scams involving reverse mortgages becoming commonFlorida Attorney General Bill McCollum is warning senior citizens about scams involving reverse mortgages, a type of home equity loan frequently abused by con artists and scammers. These loans are often popular options for senior citizens because they offer a cash source which can help meet unexpected medical expenses, supplement Social Security and more.“When our senior citizens are concerned about finances and are seeking a legitimate option for financial relief, they should not have to worry about predatory lenders or brokers trying to capitalize on their precarious position,” said Attorney General McCollum. “Consumers should take every precaution to avoid scams and situations which could leave them in even worse financial shape.”Reverse mortgages are a special type of home loan that allow homeowners who are 62 and older to borrow against their home equity without having to repay the money until the home is sold or the borro...

IS NINTENDO'S WII REALLY GOOD EXERCISE?
2008-01-31 14:09:00
Study finds health benefits may be oversoldIt may be healthier than sitting on the couch, but an informal research project suggests the health benfits of Nintendo's revolutionary Wii video games have been slightly oversold. The still hard-to-find game system, the "hot" gift during the last two holiday seasons, uses a motion-sensitive controller, requiring players to move when playing the games.Nintendo has marketed the Wii as an engaging new way to get people off the couch and into the action. So Dalhousie University student Justin White wanted to find out."I was playing Wii boxing with a friend and noticed how exerting it was," said the fourth-year kinesiology student, who saw an opportunity to combine his love of gaming with his studies. "I thought to myself, 'I'm working up a sweat doing this Nintendo thing; I might run with that.' So I put together an outline and the class thought it would be a good project to take on."The Dalhousie class in question was Applications in Exerc...

DAILY EXERCISE DRAMATICALLY LOWERS MEN'S DEATH RATES
2008-01-31 13:37:00
VA study is largest to measure fitness-mortality linkIncreased exercise reduces the risk of death in both African-American and Caucasian men, according to new research published in Circulation: Journal of the American Heart Association.A Veterans Affairs study involving 15,660 participants is the largest known to assess the link between fitness and mortality.“It is important to emphasize that it takes relatively moderate levels of physical activity -- like brisk walking -- to attain the associated health benefits. Certainly, one does not need to be a marathon runner. This is the message that we need to convey to the public,” said Peter Kokkinos, Ph.D., lead author of the study and director of the Exercise Testing and Research Lab in the cardiology department at the Veterans Affairs Medical Center in Washington, D.C.Kokkinos and colleagues investigated exercise capacity as an independent predictor of overall mortality for blacks and whites and also examined whether racial differe...

DRIVE-UP PHARMACY WINDOWS CONTRIBUTE TO RX ERRORS
2008-01-31 13:12:00
Consumers sacrifice safety for convenienceConsumers who pick up their prescription medications at a pharmacy drive-through window might be jeopardizing their safety in the name of convenience. That's the opinion of pharmacists themselves, who told researchers they believe the extra distractions associated with window service contribute to processing delays, reduced efficiency and even dispensing errors. The surveyed pharmacists reported that the design and layout of their workplace has an impact on dispensing accuracy, especially the presence of drive-through window pick-up services. Results also indicate that automated dispensing systems in pharmacies are likely to reduce the potential for errors and enhance efficiency. The study suggests pharmacy design should emphasize minimal workflow interruptions but it also offers a caution to consumers to check their prescription medications, especially those obtained from a pharmacy's drive-through window, said Sheryl Szeinbach, the study's...

BEST BUY SOLD INFECTED DIGITAL PICTURE FRAMES
2008-01-30 14:05:00
Best Buy Co. Inc. sold digital picture frames during the holidays that harbored malicious code able to spread to any connected Windows PC, the big box retailer has confirmed. It is not recalling the frames, however. What Best Buy called "a limited number" of the 10.4-in. digital frames sold under its in-house Insignia brand were "contaminated with a computer virus during the manufacturing process," according to a notice posted on the Insignia site last weekend. The frame which went by the part number NS-DPF10A has been discontinued, and all remaining inventory pulled, Best Buy added. But that didn't happen until after some of pre-infected frames were sold to customers.Link to complete story: http://www.nytimes.com/idg/IDG_002570DE00 740E18002573D9007CF01E.html?em&ex=120 1410000&en=93b9e908ae671a69&ei=50 87%0A~Sandy G.

2008-01-30 13:51:00
ST. LOUIS (AP) — Charter Communications officials believe a software error during routine maintenance caused the company to delete the contents of 14,000 customer e-mail accounts. There is no way to retrieve the messages, photos and other attachments that were erased from inboxes and archive folders across the country on Monday, said Anita Lamont, a spokeswoman for the suburban St. Louis-based company."We really are sincerely sorry for having had this happen and do apologize to all those folks who were affected by the error," Lamont said Thursday when the company announced the gaff.Charter, one of the nation's largest cable TV operators, also provides telephone and high-speed Internet service. It has applied a $50 credit to the bill of each customer whose account was affected by the mistake, Lamont said.Charter gives each new Internet user a free e-mail account, but some customers opt to use other accounts instead. So every three months the company deletes inactive accounts, Lamon...

U.S. DIET DISHES UP DIABETES

Burgers, fries, soft drinks lead to metabolic syndromeOtherwise-healthy adults who eat two or more servings of meat a day -- the equivalent of two burger patties -- increase their risk of developing metabolic syndrome by 25 percent compared with those who eat meat twice a week, according to research published in Circulation: Journal of the American Heart Association.Metabolic syndrome is a cluster of cardiovascular disease and diabetes risk factors including elevated waist circumference, high blood pressure, elevated triglycerides, low levels of high-density lipoprotein (HDL or “good”) cholesterol and high fasting glucose levels. The presence of three or more of the factors increases a person’s risk of developing diabetes and cardiovascular disease. But it’s not just meat that adds inches to the waist, increases blood pressure and lowers HDL -- “it’s fried foods as well,” said Lyn M. Steffen, Ph.D., M.P.H., R.D., co-author of the study and an associate professor of epide...

HIGH MERCURY LEVELS FOUND IN SUSHI
2008-01-29 15:39:00
Study finds high levels in tuna and swordfish sushiMillions of consumers who have developed a taste for sushi are getting something else with their meals – higher than normal levels of mercury. That's the warning contained in a new report by the conservation group Oceana. The group reports recent independent laboratory testing of 94 samples of fish and sushi bought in 26 U.S. cities revealed that the mercury content of fresh tuna and swordfish approaches or exceeds levels that may pose risks to human health, particularly for children and women thinking of having kids. The fish tested were purchased at grocery stores and sushi restaurants, and included tuna - both steaks and sushi - swordfish, tilapia and sushi mackerel. The new report also evaluates seafood counter personnel knowledge about the Food and Drug Administration's FDA mercury advisory. Some of the test results were surprising and suggest that the FDA and seafood retailers could do more to inform consumers.Link to complet...

The con artists tell consumers they need their Social Security and bank account numbers to send their rebate checks. But this is simply a ploy to steal consumers' identity, FBI officials said.Link to complete story: http://www.consumeraffairs.com/news04/200 8/01/tax_rebate_scam.html~Sandy G.

MODIFIED ATKINS DIET MAY PREVENT SEIZURES
2008-01-29 13:39:00
Study finds dietary changes as effective as drugs in some patientsPatients with epilepsy often take powerful drugs to avoid having seizures, but new research suggests altering their diet might but just as effective.Researchers at Johns Hopkins says a modified version of a popular high-protein, low-carbohydrate diet can significantly cut the number of seizures in adults with epilepsy when drugs and other treatments fail or cause complications. For almost a century, doctors have prescribed an eating plan called the ketogenic diet to treat children with epilepsy. This diet often consists of a short period of fasting, strictly limits fluids and drastically restricts carbohydrates. It appears to limit or even eliminate seizures, possibly by generating the build-up of ketones, compounds the body produces when it derives calories mostly from fat. Some of the largest studies to scientifically test this diet's efficacy took place at Johns Hopkins in the mid-1990s, led by pediatric neurologist...

PET TURTLES: CUTE BUT OFTEN CONTAMINATED
2008-01-29 13:03:00
Small turtles may carry deadly Salmonella, says FDAThe little glassy-eyed creatures may look cute and harmless, but small turtles can make people very ill, the Food and Drug Administration (FDA) warns.Turtles commonly carry bacteria called Salmonella on their outer skin and shell surfaces. People can get Salmonella by coming in contact with turtles or their habitats.Salmonella can cause a serious or even life-threatening infection in people, even though the bacteria do not make turtles sick. An example is the 2007 death of a four-week-old baby in Florida linked to Salmonella from a small turtle. The DNA of the Salmonella from the turtle matched that from the infant.People infected with Salmonella may have diarrhea, fever, stomach pain, nausea, vomiting, and headache. Symptoms usually appear six to 72 hours after contact with the bacteria and last about two to seven days. Most people recover without treatment, but some get so sick that they need to be treated in a hospital.Anyone can...

Nothing free about refund anticipation loansIt's another income tax filing season, and that means consumer organizations are renewing their warnings to taxpayers to avoid "refund anticipation loans," normally targeted at low-income, cash-strapped consumers. What exactly is a refund anticipation loan?H&R Block, the nationwide financial services firm that pioneered the RAL, settled a class action lawsuit in 2006 that challenged the fees and interest rates it charged for refund anticipation loans. Now, on its Web site, it offers this disclosure to consumers:"A refund anticipation loan is a short-term loan secured by a taxpayer's anticipated federal income tax refund. The loan is made by a third-party lending bank and facilitated by H&R Block in its tax offices. "Taxpayers choose refund anticipation loans because they can receive money in one to two days, compared to waiting up to 15 days for a tax refund to be directly deposited into their existing bank account or three to eig...

SALINE NASAL WASH IMPROVES CHILDREN'S COLD SYMPTOMS
2008-01-27 16:03:00
Snorting a little seawater can help fight the common coldA study published in the January issue of Archives of Otolaryngology, found that a salt water nasal wash solution made from processed seawater appears to improve nasal symptoms and may help prevent the recurrence of respiratory infections when used by children with the common cold. The study was released as other researchers were reporting that non-prescription cough medicines don't help children with colds and might even cause harm. Another study suggested they don't help adults much, either.“Nasal irrigation with balanced saline solutions seems effective in such health conditions and is often used in a variety of indications as an adjunctive treatment,” the authors write in the article. “Although saline nasal wash is currently mentioned in several guidelines, scientific evidence of its efficacy is rather poor.”Researchers at the Teaching Hospital Brno, Brno, Czech Republic randomly assigned 401 children age 6 to 10 ...

NEW CANCER DRUG MAY BE ON THE WAY
2008-01-25 11:36:00
New method is stronger yet less harmful than most chemoJohns Hopkins researchers say they have discovered a previously unsuspected way to kill cancer cells that could lead to stronger yet less harmful cancer drugs. Their findings appear in the Early Edition of the Proceedings of the National Academy of Sciences."A major hang-up in cancer chemotherapy is the toxicity caused by DNA disruption of cell division throughout the body. Our research suggests that drugs like cisplatin and novobiocin kill cells as much from this newly discovered mechanism as any other mechanism of cell death," said Solomon H. Snyder, M.D., a professor of neuroscience at Hopkins."Targeting this new mechanism in drug design might make for therapies with fewer side effects."Link to complete story: http://www.consumeraffairs.com/news04/200 8/01/jhu_cancer.html~Sandy G.

WEIGHT-LOSS SURGERY SEEN BENEFICIAL TO DIABETICS
2008-01-25 11:12:00
Study finds higher success rate with surgery than other methodsObese type 2 diabetes patients who underwent weight-loss surgery lost more weight and had a higher likelihood of diabetes remission compared with patients who used conventional methods for weight loss and diabetes control, according to a study in the January 23 issue of JAMA.“Obesity and type 2 diabetes are likely to be the 2 greatest public health problems of the coming decades. The conditions are strongly linked, with the increased prevalence of diabetes correlating with the increased prevalence of obesity,” the authors write.Weight control is perhaps the most important aspect of type 2 diabetes management as recent evidence indicates that improvement in blood glucose control is related to the degree of weight loss.Currently available lifestyle and pharmacological strategies provide only small to modest levels of weight loss, a problem compounded by patients with diabetes who have a harder time losing weight than t...

RESEARCHERS QUESTION NATIONAL DIETARY GUIDELINES
2008-01-25 10:55:00
Do the USDA's guidelines do more harm than good?Does the government really know what it’s talking about when it tells you what you should be eating? For nearly three decades, Americans have become accustomed to hearing about the latest "official" dietary guidelines, which are required by federal regulation to be revised and reissued at five-year intervals.Mid-way to the drafting of the 2010 guidelines, researchers at Albert Einstein College of Medicine of Yeshiva University raise questions about the benefits of federal dietary guidelines, and urge that guideline writers be guided by explicit standards of evidence to ensure the public good. The researchers, led by Paul Marantz, M.D., MPH, associate dean for clinical research education at Einstein, outline their argument in the online edition of the American Journal of Preventive Medicine.“When dietary guidelines were initially introduced in the late 1970s, their population-based approach was especially attractive since it was pres...

Coffee, tea, soda, hot chocolate present riskHigh doses of daily caffeine during pregnancy -- whether from coffee, tea, caffeinated soft drinks or hot chocolate -- cause an increased risk of miscarriage, according a new study by the Kaiser Permanente Division of Research. The study controlled, for the first time, pregnancy-related symptoms of nausea, vomiting and caffeine aversion that tended to interfere with the determination of caffeine’s true effect on miscarriage risk. The research appears in the current online issue of American Journal of Obstetrics and Gynecology. While previous research showed a link between caffeine consumption and miscarriage, this is the first study to thoroughly control for morning sickness, which typically causes many women to avoid caffeine, explained De-Kun Li, MD, Ph.D., an investigator with the Kaiser Permanente Division of Research and lead investigator of the study.“This study strengthens the association between caffeine and miscarriage risk bec...

VULNERABILITY TURNS MS EXCEL INTO OPEN DOOR FOR HACKERS
2008-01-23 12:11:00
Hackers are targeting users of some older versions of Microsoft (Nasdaq: MSFT) Excel with a zero-day exploit that could compromise their data, according to a security advisory Microsoft issued Tuesday. The vulnerability is in Microsoft Office Excel 2003 Service Pack 2, along with Microsoft Office Excel Viewer 2003, Microsoft Office Excel 2002, Microsoft Office Excel 2000 and Microsoft Excel 2004 for Mac, Microsoft said. If successfully exploited on a vulnerable computer, it could enable remote code execution, the company added.Microsoft is now investigating public reports and the extent of the vulnerability's impact on customers. Once that's done, it may provide a security update through its monthly release process or as an out-of-cycle release, it said."While the attack appears to be targeted, and not widespread, we are monitoring the issue and are working with our MSRA (Microsoft Security Response Alliance) partners to help protect customers," wrote Microsoft's Security Response...
