Does PCO apply to judges only?
2007-11-24 16:57:00 A few days back the COAS announced the imposition of emergency plus.As a result the judges were required to take oath under PCO.According to my understanding the requirement to take a fresh oath under PCO means that the constitution of 1973 is suspended or held in abeyance.This means that all public office holders whose position requires them an oath under the suspended constitution should take a fresh oath under the PCO.If I'm not wrong its always the judges who have taken oath.Why is it so that other office holders never take oath under PCO.The recent PCO promulgated by the COAS only required the judges to take oath.According to the order the PM, Speakers of Senate,National Assembly etc were to function normally.My question is how can PCO be applied only to judges and not the other office holders?Does this mean that judges work under PCO and the other office holders work under the 1973 constitution?If yes then how is it possible to have a PCO and constitution working side by side...
