The Congressional Oversight Panel , which oversees the Troubled Asset Relief Program, will convene the first public hearing in response to the robo-signing foreclosure scandal. The Panel was formed, in large part, to keep an eye on the government’s programs to alleviate the foreclosure crisis, which includes the Home Affordable Modification Program. In 2008 Congress convened the Congressional Oversight Panel to assess and oversee the performance of the bank bailout. The COP has been extremely critical in the execution, by the government, of the bailout. The COP has recently argued that transparency has been limited by the Treasury Department’s reliance on private contractors. The Treasury Department has denied the charge. Thomas Seay, a spokesperson for the Congressional Oversight Panel, indicated that, during this hearing, the Panel will hear testimony on how affidavits that were robo-signed could hurt the banks’ bottom lines as well as the housing market. On Sunday, October 24, 2010, Bank of America almost retracted when they admitted that they actually did find errors in its filings but they plan to continue its filing processes for foreclosures in a “deliberate manner” as corrected and new paperwork is submitted to the Courts. An investigation by the 50 US states into the U.S mortgage industry has started, amidst allegations of some banks improper handling of documents that may have resulted in homes being foreclosed in error. This is after Bank of America admitted finding a small number of cases with errors, or so they say, in their review process. What is alarming here is the existence of robo-signers within these large institutions, such as the Bank of America , who sign off on foreclosure affidavits without examining the documents. And on top of this, despite incorrect information and missing documents, some foreclosure cases were still being initiated. According to the bank, these were minor mistakes, caught earlier on in the process, and did not affect the final documents submitted to the courts. McLaughlin claims that the foreclosure on her North Larchmont Drive home was instigated by the process of robo-signing, in which bank employees did not review the documents of foreclosure before they were signed. The lawsuit was filed against Rhonda Weston, a Vice President of Bank of America and Bank of America, N.A. itself. The potential for the proceeding of foreclosure cases to halt could possibly bankrupt some banks and loan servicers because some delinquent borrowers could get settlements from these servicers and they may be able to stay in their homes indefinitely. Each week the Mortgage Bankers Association (MBA) releases a report called the Weekly Mortgage Applications Survey . The survey is based on the movement of the market and the actions of the people in the area. The MBA is a research and economics group that provides current and comprehensive data for short-term and long-term planning. The MBA focuses on economic forecasting in real estate. The Market Composite Index is a measurement of the volume of mortgage loan applications. Due to rising interest rates it decreased 10.5 on a basis adjusted for the season this week compared to last week’s increase of 14.6 percent. The unadjusted basis also decreased by 10.5 percent compared to last week’s gain of 14.8 percent. The Columbus Day Holiday was not figured into the adjustments.
