I don't know about you, but I dread running into my tenants in the supermarket and anywhere else in a personal capacity.It isn't because I'm afraid to face them. I have good tenants, but I just don't want to mix business with personal time.I have had some tenants who turned out to be scarey wierdos, so I don't want them all knowing where I and my family live.How about you all?

I have tenant 'A' who was given a lease by tenant 'B' to sign. I did not see, approve or receive signed lease from tenant A. Tenant B also accepted rent money from A and did not give a receipt, and I have not received that money from either tenant. Can I make A sign an approved lease and provide a security deposit and/or have them move out (I am willing to pay him his rent he gave to B)? Tenant A has a dependent living with him and the rental is located in NC.

tenant demands return of stop payment check

My tenant gave me a check that they stopped payment on without telling me. I thought we were headed for eviction so the only way to have proof for court was to deposit the check in my bank. The tenant wound up paying with cash and now wants the check back. Ignore this request or how best to handle, they are purposely arguementative.In addition the end of the lease is coming and the tenant has decided to inform me in writing that I can't come on the property and to give 5 days notice to visit. I have the right to show the property as long as I provide 24 hours notice as required, they won't answer phone(unreliable)so I put a note in mailbox. Can I inform them of this along with notice not to renew lease and show the property anyway?

I was looking at the LPA termination of tenancy document. Is it required that NY landlords have a third party physically serve any termination of tenancy forms? If the rental agreement is silent or states that items must be mailed, does that constitute propert service in NY?
How To Prevent No Shows?

Out of the last five showings of our house for rent we had two no shows in a row. We use the LPA tenant qualification form to intiially qualify all prospects. We always call to confirm in advance of the appointment. Short of requiring they fill out and submit the lease application AND the $40.00 processing fee before I show the house, what else can I do to insure people show up?

I am about to find a new place to live. My husband works for a military magazine and is only home ocassionally (every other weekend). Would he have to be on the lease?Currently we are all on the lease at this apartment but I would like to be able to get everything done w/o having to wait on him to come by and sign/fill out paperwork.

Hi, I'm new to being a Landlord and we now have a rental house for the 1st time. Renters will be moving in on the 1st (this weekend). They have mentioned putting a "play pool" in the back yard. I really dont want a big above ground play pool, but not sure I would mind a small "Kiddi" type pool. Would it be wise to include in the lease agreement something to the effect of no play pools larger than 200 gallons? or something like that?ThanksFlyAZ

denying an application

In Florida does anyone know the legal reasons other than race,sex, handicap to deny an application. We have an applicant that we just don't get a good feeling from. All tattoed up, his dad is looking for his apartment for him, he is desperate to move immediately, he is very young and we just dont want to rent to him. We'd rather wait for a more qualified person. So is that enough reason to deny? Because we feel he is not a good fit for our apt? Do I even have to give a reason in FL? Can I just say it's been denied? The problem with saying we have another applicant is we don't and we'll still have signs up in the area he lives in now which is near our apt.

I need to move back into my home. I gave the tenant (who has not had a lease since the first year he was there) 90 day notice. He did not respond to any communications until I caught him on the phone and he said he was not moving and needed more time. I explained that I could only give him another couple of months and it would have to be at a substantial increase because I needed to cover my expenses and he said send the papers. I sent him a notice of the month to month increase which he proceeded to ignore. During his tenancy he moved a substantial amount of his property into my attic, without my knowledge or consent and took off my lock and put his own lock on the door. He started breaking into my basement,I know it was him because he told my lawyer he's been taking pictures to try and find problems to threaten me with, and now he's not paying any rent at all. Do I have any rights to my own home?

Not quite sure what the processing fee would be when renewing a lease. Can someone help me understand this... and if used by other LL's what is the specific fee amount?Is this used for credit review again?OPTION TO RE-NEW LEASE Tenant has the option, providing the terms and conditions of this lease have been complied with and satisfied, to re-new this agreement for a period of _one year __, at an annual increase of _5 to 10 % increase , subject to Owner's decision. Have 1 person scheduled to sign the lease and came across this on the THELPA lease>**My question is do I adjust the occupants to the total amount that I am signing up on the lease in this case is 1 and not 2???4. USE The premises shall be used as a residence by the undersigned tenants with no more than 2 occupants, and for no other purpose, without written consent of the Owner. Occupancy by guests staying over 3 days will be a violation of this provision. In the event any other people occupy and live in this rental, in any capacity, without Owner's written consent, it will constitute a breach of this agreement, and the Owner at his sole option may terminate this Lease Agreement.

In September 2007 I signed a year lease with a friend of mine. She has since become unreliable, and very difficult to live with. In September when the lease is up, I do not want to renew the lease with her. I have informed my landlord of the issues and that I would like to get a new lease with my boyfriend and I in September of 2008 that does not include her. He is sending her a notice of Non-Renewal of the lease. If she does not move out in September is the eviction process the coarse of action that needs to be taken? And if so, does the notice of non renewal that is given 90 days in advance speed up the process? What can she do to prolong her stay, and is she covered by any Tenant protection laws? separate leases for each roomate: a good/bad idea?

Hello,Here is the background on my situation. I own a 2 bedroom condo. Originally I lived there, and my roomate was an old friend of mine. Because of our friendship, we didn't have a lease, but rather a "gentlemen's agreement" that he pay me $650 per month. I moved out in January but he stayed. A new roomate was found, and I had her sign a 6 month lease for $700/month (the extra $50 for the parking space), meanwhile my friend was still paying me $650 based on our gentlemen's agreement. Two months later, he moved out. I found another tenant shortly, and had her sign a 4-month lease for $650 (this allowed BOTH tenant's leases to expire at the same time)NOW, both tenants leases are expired and they want to renew. Should I let each one renew their individual leases ($650 and $700 respectively)? Or should I make them both sign a single lease for $1350? I think it makes sense to have ONE lease with all tenants, like most traditional apartments do.Thanks for yo...
