Should Tenant Stay in Apt. While Suing Me?

Tenant has filed a lawsuit against me for personal injury. The rent is always paid by the housing authority (government). I'm not sure whether to renew their lease during this lawsuit or tell the housing authority that I will not be renewing their lease for another year? Kind of weird because we're nice to one another and they keep the place up. Any thoughts would be appreciated.

I have a section 8 tenant who is month to month, the lease is in her name and her underage daughter. She has over ten people (not on the lease) living in the two bedroom apartment in violation of her lease. I have served her a notice to cure according to the law of the District of Columbia, she did not respond. I filled a complaint for possession of real estate and we have a hearing coming up shortly.What do I need to prove my case in court? None of the other tenants is willing to testify in court.

We have a home in Maine we rented out to a person who signed a lease from October 2007- October 2008. Back in the end of February 2008 the tenant stated they might move out after spring. March rolled around and on March 3th we called because we had not received their rent. Tenant claimed because February was a short month they forgot about mailing the rent. Received rent for March on March 6th. The next week spoke to tenant and they stated they would be moving out end of April 2008. They never send us anything in writing about moving out. They broke their lease. March 15th we received a call from neighbors that the tenants had a moving van and left. We called the tenant and they stated that they had to move and since we had their last months rent they were paid till the end of April. An old friend rented a room from me. He rented a room from a previous landlord that I had 5 years prior that went sour quickly, and I overlooked it as a friend and allowed him to move into the house that I now own 5 years after the last living arrangement. We went to school together when he moved into the place I lived in before, and I cosigned his rental agreement. In that situation, he agreed to pay first and last months portion of the rent upon receiving his student loan dispursment. Within the first three weeks he got in a confrontation with the landlord/roommate and moved out on his own accord. The reason for his moving out was that the homeowner expected too much from him in the way of cleaning and was verbally abusive as a result. Since I vouched for him with the homeowner, the homeowner held me accountable for both rooms until I could find a roommate. my daugter and her boyfriend rent my house for way less than my morgage. i'm thinking about doing a lease and making the rent go up for the same amount as the morgage and alittle bit more because they never want to keep the grass cut or the yard maintain. the exart amount is so i can have someone come cut and maintain the yard. is this legal.

How do I go about giving my tenant 30 days notice without having them raise H... in return. Is it best to have an attorney do it ? My lease allows me to give them 30 days notice. Its a month to month lease, they only paid half the deposit, they've painted walls without permission and put my refrigerator in storage while they use their own (once again without my knowledge). If they trash my house in retaliation can I take them to court ? Yes, I"m new at this :)

Had tenant that filed bankruptcy, the bk was dismissed. during all this legal back and forth between rent and legal fees he owes me over 13k. I am a LLC therefore, I must use an attorney to garnish his wages. At this point I cannot afford the $1000.00 retainer. I am a new LL and all my savings are gone. I paid the mtg on this house for over 8 months with no rental income. I know where he works and lives. What can I do? Please help.

My rental house has no garbage disposal the house is old and to install a garbage disposal the pipes would have to be replaced and new wiring, which at this point I do not want to do. when my tenant moved in they were aware of the situation and told not to put food down the sink. now i get a call and the sink and pipes are backed up my plumber went out and found the problem to be clogged lines, I told my tenant i would pay this time to have the plumber snake the lines but next time they will have to pay, is this how other landlords handle this? and i just noticed I did not state this is the rental agreement is it to late to amend the agreement our tenant has been in the house a year

Good times turned bad

My tenant had been paying rent more than 30 days in advance in agreement for $100 less per month. Current Lease end June 30th. On March 1st he paid me for April and May. Since Since March 25th I have been trying to get him to sign and return "notice to vacate or renew." This is his 2nd 1 year lease so I thought he'd renew. I found out he moved out mid April. Electric and Gas were turned of on May 6th. Half his stuff is still there and the fridge, freezer and dishwasher were all full. After repeated attempts to have him turn electric back on I finally turned it on under my own name 18 days later (ie today). He has verbally told me he does not plan on returning, but wont sign the notice to vacate. Assuming I apply his last months rent he had pre-paid he's paid me through June 30th. My problem is the place is a pig sty and is not close to being in 'showable' condition. What should my next steps be? What penalty could he face? Is this time to get a lawyer involved?

My initial application fee when collecting the application fee states that "A $50 fee will be assessed if the electricity is not in the tenants name by the move-in date". Also in my lease I state that any additional fees are considered rent payable. Can I a) charge the $50 admin fee and b) consider it late rent and charge a late fee penalty. The electricity was changed over in 48 hours and amounted to $5.00; what am I entitled to? I do not want to be in violation of the lease laws as this is my first rental.

She has 10 months left at about 1/2 the market rental rate. Her behavior combined with the rental rate has helped me decide that I want her out.After thinking outside the box, I came up with this idea. Please critique.I want to approach her and offer to lower her rent in exchange for switching to a month-to-month. Then, one month later, advise her that she is no longer welcome. Eviction and electricity question

I am a landlord and also an attorney and I understand the landlord laws pretty well but I have more of a logistics question.I'm in the process of evicting tenants that have trashed the house and not paid for the month of may. That is pretty much a done deal.Here is my question, my court date is on June 4. I called the electric company to switch the utilities back into my name and they said that in order to have uninterrupted service, I would have to have it transferred by May 27th.My question is, do I want to have uninterrupted service because won't the tenants be more likely to stay or do I want to have them without electricity for a couple of days and that will be more incentive that their stuff is out by the eviction date.It's not an issue of retaliation, their service for whatever reason will be cut off on the 27th but not because I cut it off.
