Eviction and electricity question
2008-05-23 20:26:00 I am a landlord and also an attorney and I understand the landlord laws pretty well but I have more of a logistics question.I'm in the process of evicting tenants that have trashed the house and not paid for the month of may. That is pretty much a done deal.Here is my question, my court date is on June 4. I called the electric company to switch the utilities back into my name and they said that in order to have uninterrupted service, I would have to have it transferred by May 27th.My question is, do I want to have uninterrupted service because won't the tenants be more likely to stay or do I want to have them without electricity for a couple of days and that will be more incentive that their stuff is out by the eviction date.It's not an issue of retaliation, their service for whatever reason will be cut off on the 27th but not because I cut it off. Rent Increases?

2008-05-23 16:57:00 New tenant signed lease on 5/1. Wants to move in room mate on 6/1. I knew the possibility of this happening since both had contacted me together about the apartment. One just couldn't commit at the time. I'm fine with letting the second person move in.SHould I rewrite an entirely new lease to include both? Tenant Got Hurt
2008-05-23 02:24:00 My tenant call me today saying he was trying to trim a branch on a tree next to the rental property when it snapped and he fell, he hurt his knee pretty bad and said he is not sure how long he will be off work. I told him that all i can do is let him slide in june but he would have to make a double payment in july. Is this a bad idea, what should i do. He has a doctors appointment on wed, i told him to immediately call me and let me know how long he will be off. If its a long time I will have to get him to move out. Tenant broke lease, can I evict her?
2008-05-22 21:11:00 Tenant moved in on March 1, 2008. She signed 1 yr lease, with lease stating NO pets, and one person occupancy. within 3 weeks, she had a man living with her, and brought a cat in without asking. The man left her, and she is causing numerous problems. She questions the utility bills, even though it states clearly on them the address. renewed under false pretenses
2008-05-22 07:17:00 Tenant comes to me after 6 years and says old manager erroneously charged for 3rd person, a minor his granddaughter. After months of letter writings between us and my investigation, I find out they had 3 adults living in apt. for undisclosed amount of time (which tenant denies) but also a pet that they never disclosed and were never charged for. I suggested we call it even, 3rd person charge for pet. Tenant agreed and 2 weeks later signed a whole new lease, total years passed now 7. Because daughters felon-parolled boyfriend was later refused residency tenant has decided to sue for 6 years of 3rd person charge. Has statute of limitations run out? Does signing a new lease make issues with old lease null and void?

2008-05-22 04:15:00 I have a tenant who has rented a 2 bedroom unit for 9 months gave me 10 days notice to move out 5/12/08..the couple had relationship problems..now she leaves me with a vacancy and loss of rent until I can change the locks (she did not give me the key after 4-5 times asking for it so we can get in there to clean up-paint,etc) I have had the locks change today because the unit is vacant..now she wants her full security deposit back..she left me with a rent loss situation plus the cost of any rehab to the unit..They have no lease, month to month for 1 year ,but with the understanding of a 30 notice to me of vacating the unit I do not want to give her back anything after this. My rent loss will be $500-$1,000 plus costs & depending on how long it will take me to process a new tenant.. More About: Days , Notice

Tenant's Violation of Pet Policy
2008-05-22 03:26:00 We rented our home on a lease purchase to a family in November. The lease portion called for no pets without prior consent of the landlord and a seperate addendum and fees would apply if landlord agreed to add a pet to the property. The tenant called to say there was a water leak in the family room. While meeting the plumber at the home, it was clear that the family had a dog. When questioned, the tenant said her husband had brought home the puppy for their daughter a month ago. While at the property today working on repairs and replacement of carpet my husband and I explained there are to be no animals on premise and we would give them two weeks to find a home for the dog. The tenant went into a rant about how us as owners had a cat and "cat's" are much worse than dogs and they feel they are taking much better care of our home than we did. 2008-05-22 03:01:00 We are trying to sell our duplex because we are unable to rent out one side of it after old tenants moved out. Our tenants that are in the other side are flat out refusing our realtor entry and they are very hostile, telling me that they are going to be there when we show the other side and tell the potential buyer everything that is wrong with the property. We are also concerned that they are now going to stop paying rent. move- out inspection
2008-05-22 01:43:00 Had my tenants of 3 years decide to move out. On the day of move-out inspection it was noticed that the electric in the house was not working. The tenants had the power turned off prior to moving out. Now I cannot conduct a proper inspection due to no electrical. I could not check to see if the stove, fridg., or washer and dryer was properly working. Power cannot be turned back on until next week. Therefore no security deposit can be returned until appliances are checked out to be operational. Tenants seem to think this is unfair and that I should take their word that all is operational. They are in need of the money quickly to pay for car repairs. Not to mention that during their tenancy they were always late paying the rent and they had me waiting to collect monies on rent due date. Paying $1k/mo for an indefinite amt of time (probably 6 - 18 months) OR pay $450 for 24 mos?I'm trying to make a decision on if I want to sell my rental property (negative cashflow $1000 per mo) OR sell it ASAP which requires me bringing approx 20k to the table to close (I don't have 20k so I'd have to take out a 20k loan and pay $450 on it every month)... so The question is, which is better?
