Sad Fact of the Matter With Mom During Mediation

We told mom if you move back to the Kansas City Metropolitan Area, and not 2 hours away, we won't take you to court for custody modification.Let us have the kids for a while so that you can go back to school and better yourself. She would not have to pay child support to us. She could also see the kids whenever she wanted. Sleepovers during the week or weekends that wasn't her time or just to go out to eat in the evenings.We told her if she went to night school she could have the kids during the day when they didn't have school and we would pay her daycare costs. We already know we have to pay them anyway. We just figured that we would know it would be going to a good thing. Mom could better herself and be a good role model to all of her kids.

Well, today was the day. She went to pick up her youngest child but instead she was picked up. The irony... Apparently they made her wait and told her that she was with grandma running late. She waited for about 15 minutes and then went back to the door wanting to know when they were going to be back. They told her it should be anytime. Instead of them showing up the police pulled up. The officer called for backup as he pulled up and then called for more back up behind them.The officer stepped up to her van and asked her to see some ID. Mom gave the police officer her ID. The officer then told her to step out of the vehicle. The officer told her she was under arrest because she had a warrant out. The impounded her van. Someone, not sure who, stated that she looked like she was on Meth. The officer then decided he had probably better search the van to make sure there was nothing left behind with the tow truck drivers. Is Mom Hiding from What's inevitable???

On Friday at the Contempt of Court Case in Jackson County, MO mom didn't show up. This was the fourth court date in regards to the contempt of court hearing. She had more than enough chances according to the judge. As discouraged as he seemed to be and as against filing a warrant for her arrest, he knew that putting mom in jail was the only thing that might get these children's mom's attention. Everything else has failed. She still fails to have a job. As of September 01 she will be $2000 in the arrears. Suggestions have been made to her by us to get her out of trouble with the Family Fair Share program that is available in the State of Missouri for mother's and father's who have fell behind on their child support. Obviously she didn't care about that. She still hasn't done it and she has crawled into hiding.The sex offender, who guaranteed her bail, doesn't know where she is. The bail bondsman that paid her bail doesn't know where she is.What's Next???

Mother's Assault Charge in Kansas

As of today, Tuesday, we found out that the convicted sex offender guaranteed her bail with a bail bondsman. I'm not quite sure of that one considering he is the one that filed the charges against her. Her mom hasn't seen her or heard from her since a week ago Monday. The children were suppose to go for visitation this past weekend and she didn't show up and didn't call. Now as much as we have been tired of her crap and tired of the hell that we have been put through by her we have to wonder if she hasn't done something or is planning to do something stupid or if she is just in jail from the assault charges in Linn County, KS. At this point we to have to worry that mom may try to run with the children. Nothing is left unthought of as to the possibilities that could be sitting around the corner. Only time will tell...

Contempt of Court in Jackson County, MO

I went to the court hearing for the contempt of charge hearing in Independence, Jackson County , MO. She didn't show even knowing that she was looking at jail time. What is going on this mother? The fourth child that she has custody of isn't even in her care. She is with her grandparents. They need to file for assistance with the state of Kansas to at least get a little bit of assistance for taking care of their grandchild.

Assault Charges on Mom

Today was the court case in Linn County, KS for assault charges that the convicted sex offender filed against mom. Apparently she bit him on the arm because of a cell phone. I'm not going to speculate. My understanding from the police report is that he let her borrow his car and told her not to drive it out of the lake property because it was not licensed and she did as she pleased. Of course, that doesn't surprise me. Then there was an arguement over a cell phone and she broke his cell phone. So we haven't heard anything new yet for todays court ordeals. We'll see.......

Child Visitation Exchange

Tomorrow mom goes to court looking at being instantly arrested for back child support and failure to obey the courts order for her youngest daughter. Do we give up the kids to her and hope that she doesn't try to run with them?Of course, we have to see what happens in court tomorrow. As of right now it doesn't look like she will be making it to court. Court is at 2 pm and she is suppose to pick up the kids at 6pm. She can't make it because her vehicle, yet again, is broke down. She wants her mother to pick the kids up.I don't see the kids going with her this weekend. The kids just came back from seeing her for three weeks, and an extra week with their grandparents, on Sunday. We heard the 11 year old that she hails has Asburgers, Autistic tendancies, was driving a vehicle while sitting in her lap and then while she was sitting in the passenger seat. Child Custody Case Management Court Date

Yesterday was the "Case Management " Court Case. Yet again mom didn't show up. One has to wonder if she has given up. The Case Management meeting with the court is basically updating the court on mediation, any changes, basically just notifying the courts of what, if anything, has changed so then the courts may decide on whether or not the child custody case needs to proceed. We can only wonder if she thinks that the next time she would be in front of the judge that she would instantly be arrested from misreading the letter for the Contempt of Court case. Who knows... Tomorrow, Friday, is her final day to prove that she is going to do what the court wants. It doesn't seem like it has been a month already. It went pretty quick. We'll see. I will update after tomorrow.

I went to contempt of court case on July 20, 2006. It ended up being a total waist of time. Mom didn't even show up. Instead she called 5 minutes, yes, 5 minutes before court was suppose to start at 11:00 am.At this point the judge is very frustrated. He has given her two chances to redeem herself for the sake and joint custody, that she has, of her youngest daughter. You could feel the frustration throughout the court room. The outcome was grim but he did what he had to do. The judge said that he would give her one more chance and continue the contempt case until August 25, 2006.At this point now she is looking atAugust 23, 2006 -- Case ManagementAugust 24, 2006 -- Assault Charges that were placed against her by the sex offender, that she was suppose to cease contact with her fifth child, in Linn County, KS.August 25, 2006 -- Contempt of Court Case continued from July 20, 2006.What is a parent suppose to do at this point? What do you do when mom gets thrown in jail for assault?Do you let your kids go visit her?It really depends.If you are currently in a custody modification action the answer would be definitely YES.But what if you child has been hurt a couple of times and mom and gotten so unpredictable that you don't know what her next move is?It really depends on your conscions?No, If you are in the middle of custody modification and the judge tells you that the child or children MUST be exchanged at every visit then you better do so.This is all brought on from a father fighting for custody during the divorce here in Kansas City.
