Co-blogger Steve Dickinson recently wrote a column for the China Economic Review on the plusses and minuses of arbitration provisions in contracts with Chinese companies. The article is entitled, "Overseas arbitration and enforcing contracts in China," and, not surprisingly, it says that decisions on whether to arbitrate should be made on a case by case basis. Steve's article starts out by noting that written contracts are "essential" for protecting the rights of foreign companies doing business in China, but such contracts are of no value if they cannot be enforced. Steve then notes how foreign company distrust of China's legal system too often leads them to insist that any dispute be subject to foreign law and resolved outside of China even though doing this sometimes renders the contract "practically or legally unenforceable." Francisco Liriano is pitching in his first major league game in 19 months today, and Twins fans have to be excited by that prospect. However, as pointed out by Joe Christensen of The Star-Tribune, had the Twins waited longer to promote Liriano from the AAA Rochester Red Wings (where his service time clock was on hold), the lefty wouldn't reach the three-year arbitration benchmark until after the 2009 season. Fluto Shinzawa of The Boston Globe reports that the Boston Bruins would prefer to take pending restricted free agent defenseman Dennis Wideman to arbitration than ink him to a multi-year deal. Not because they want to be stingy with their only NHL-ready puck-moving blueliner, but because they want to determine if the 25-year-old’s breakthrough season was a fluke or not. The Bruins would like to see Wideman sustain his level of play for at least one more season before deciding to lock him up long-term. Wideman, who is expected to get a raise either way, has a few options at his disposal: “accept a one-year qualifying offer and hope he has another solid season in 2008-09; sign a multiyear extension; or go to arbitration.” His current comparables include Brent Seabrook of the Chicago Blackhawks, Brent Burns of the Minnesota Wild, and Niklas Kronwall of the Detroit Red Wings. Chien-Ming Wang lost his arbitration case against the New York Yankees Friday, but still got the second-biggest deal in history for a first-time, arbitration-eligible starting pitcher when he was awarded $4 million by a panel of three judges the New York Daily News reported. Wang had asked for $4.6 million in a Thursday hearing that lasted 4-1/2 hours. He made $489,500 last year. Dontrelle Willis is the only starting pitcher of similar service time to make more money than Wang — Willis settled his arbitration case for $4.35 million in 2006 after going 22-10 in '05 for Florida. Hard feelings sometimes develop following hearings. The player attends and must endure listening to the club's case against him, which is filled with reasons why he is not worth the money he wants. Ryan Howard and the Philadelphia Phillies are scheduled for a salary arbitration hearing Wednesday in St. Petersburg. Howard is seeking $10 million; the Phillies have offered $7 million. But Howard talked with reporters after his workout at Bright House Networks Field. He just avoided specific questions about his contract status and the situation in general when he met the media Friday. "We're just going to wait and see what happens," Howard said. "But we can talk about spring training. . . . I'm focused here. I'm focused on trying to come out here and get better and get ready for the season. All the other stuff, the outside stuff, that's outside. But I'm here. I'm working and I'm going to try to be the best I can for the team."Phillies general manager Pat Gillick said he considered Howard's early appearance a good sign. Another reliever bites the dust; Jose Valverde will receive $4.7MM rather than the $6.2MM he was after.  That $1.5MM could go toward another starter, as could another $2.15MM saved in the event the Astros beat Mark Loretta (I think they will).  Of course, the list of remaining free agent starters ain't pretty.  It shouldn't be on February 15th. Valverde is under the Astros' control through the 2009 season.  If he has another 40 save season, he can probably vault past $10MM for '09.

The Rockies beat Brian Fuentes in their arbitration hearing, with the panel choosing the team's $5.05MM figure over Fuentes' $6.5MM.  Can't hurt his trade value. Fuentes, a 32 year-old southpaw, is set to enter 2008 as a setup man for the first time in quite a while.  Given that this is his contract year, it's not ideal for him.  He'll get paid regardless, but I'm sure he'd prefer to hit the market with another 30 saves in his pocket.  Here's a look at the pecking order for saves on each of the 30 clubs. The Braves were interested in Fuentes in December, but didn't want to take on his entire salary.  The Mets and Red Sox also reportedly inquired that month.

(NEM), one of the world's largest gold producers, will consider filing for international arbitration if it doesn't reach an agreement with the Indonesian government on the U.S. company's sale of a stake in a gold and copper mine, a company official said Friday. The Indonesian government Monday threatened to revoke Newmont's mining license at the Batu Hijau mine in the Sumbawa Island if it fails to divest its 10% stake to local authorities by Feb. 22. Newmont is obliged to divest itself of its majority stake in the mine according to the terms of a 1986 contract. Coming off a season in which Kevin Youkilis earned his first Gold Glove — and backed it up with a nice offensive performance — the Red Sox first baseman will get a hefty raise in 2008 according to Boston.com. Youkilis agreed to terms Sunday on a $3 million contract for the '08 season, continuing the Sox' streak of never having gone to an arbitration hearing in the Theo Epstein era.But Youkilis did not get quite the raise he was hoping for, signing for less than the midpoint between the amount he asked for and the amount the Sox offered when the sides exchanged numbers Jan. 18. Youkilis, who turns 29 March 15, had asked for $3.7 million, and the team offered $2.525 million. Youkilis earned $424,500 last season, after the sides could not come to a contract agreement, leading the Sox to renew him at that number. This was the first time Youkilis was eligible for arbitration, which is an option for players who have from three years of service time to less than six years.
