2009-09-09 17:45:00
If you're a regular reader of this blog, you're likely familiar with the unusual phenomenon of inventive Chinese farmers. For some reason, these rural inventors are grabbing more headlines than most Chinese tech companies. Well, here's another distinguished farmer to follow in that tradition. This particular pear producer isn't going to let any economic downturn get the best of his crop sales. His baby buddha pears are selling like hotcakes, and he's doing so well that he now hopes to take them overseas. Check the photos:
Chinese telecom stocks: A trio of wireless plays
2009-09-09 06:00:00
"There is still a lot of wireless growth potential in the world's most populated country," notes Geoffrey Seiler, in an intriguing and in-depth review of the leading China telecom companies.In BullMarket.co-m, he looks at China Mobile (NYSE: CHL), China Unicom (NYSE: CHU), and China Telecom (NYSE: CHA) noting, "We would expect all three to grow for the foreseeable future.""China Mobile is the undisputed king of mobile from a subscriber base standpoint. Through the end of June, the company boasted 493 million subscribers. The company boasts 70% of the Chinese market."The next two providers are China Unicom, which claimed 140 million users as of June 30th, but growth was just 800,000 from May, followed by China Telecom, with 39 million users."While still growing, the pace at which the industry is adding subscribers has slowed in the last year. In part it is because the major urban markets are getting saturated. "All three have ...

Why Suing Chinese Companies In The US Is Usually A Waste Of Time.
2009-09-02 07:31:00
Ft.com has a fascinating and extremely sad story, entitled, "An accident shows how China treats consumers." (h/t This is China!) It's a great article, but the title is all wrong, at least if you are a lawyer. The title should be "An accident illustrates why it is (almost always) a complete waste of time to sue Chinese companies in United States Courts." I am sure that most of you will read this article and get all angry and ask, how can this be? I read this article and nod my head and think, been there, done that. That is because just about every month, I get a call from some lawyer, somewhere in the United States, calling me and expecting me to be really interested in the great case he or she is offering me. The case usually goes something like this: 1. I have a $16.5 million judgment against this Chinese company for securities fraud. We got the judgment from such and such US court and "all we have to do now" (I swear they nearly always say this as though they just did ...
George Will, Pipelines, and Chinese hookers
2009-09-02 05:49:00
A lot of nonsense being written in the news about Conservative writer George Will deciding to throw in the towel in Afghanistan. Afghanistan is a mess. Big deal. It’s been a mess for a couple thousand years, and trying to “win” a war there and put in a crumpets and tea democracy is a bit delusional. But ...
No Chinese Handsets on Indian Border – Is The Govt. Proposal Acceptab
2009-09-01 07:23:00
The past few years have seen military tension frequently simmer between India and China over border violations,  suspicions of military spying, etc. And considering the fact that China has a tight control over the home grown corporations, it comes as no surprise the the Indian Government is wary of Chinese equipments used by Indian network providers in the sensitive border areas. Among the new set of diktats issued by the Department of Telecommunication (DoT) is a proposal to ban the use of equipments from Huawei and ZTE along 14-20 circles that share the border with unfriendly countries like Pakistan and China. One cannot find fault with the proposal considering that the threat is genuine, but the network providers are clearly not happy. The main reason is that the opportunity cost to switching equipment providers is huge; firstly because there are several contractual agreements already in place with the Chinese manufacturers and secondly because the European manufacturers are mu...

Chinese Woman Pulls Six Cars With Her HairIn China, hair-pulling is, counter-intuitively to Western conventional wisdom, a male-dominated sport. This makes Zhang Tingting the Danica Patrick of the strange competition of pulling cars with her hair. This past week she was the first woman on record to successfully pull six cars over 50 meters with her hair. It's the greatest athletic achievement to occur in Beijing. Ever.

Chinese Prostitutes And Government Officials, And Why You Should Listen To
2009-08-08 20:25:00
A recent survey of more than 3,000 Chinese found that less than 7.9% of them trust their government officials. The media have been reporting on how 7.9% trust prostitutes, which are more trusted than the government. As one would expect, this survey has received considerable blog play: -- Chinese Trust Prostitutes More Than Party Cadres --Chinese Trust Prostitutes More Than Government Officials --Chinese Trust Prostitutes More Than Politicians (The Huffington Post) --Chinese Trust Prostitutes Over Politicians --Prostitutes Better Than Officials In China --Chinese Trust Prostitutes more than Politicians Most of the posts focus on how this Interesting Poll">poll should come as no surprise and how the same results are likely in the United States. I agree, but this post is going to be about business, not politics. I thought of this survey today in the context of a China matter we previously handled. I am going to have to be fairly vague here to avoid revealing anything that c...
When The Chinese Government Talks You Should Listen.
2009-08-08 09:31:00
One of the misconceptions foreign businesses often have about China is that their providing China with a few hundred jobs means they wield real influence. They start to believe that because some local government official has been solicitous, that they are somehow protected from all the bad things they read about that happens to other foreign companies in China. For so many reasons, this is just not true. One of those reasons is economic prosperity is not the be all end all of the Chinese government. Yes, China sees the gloriousness in being rich, but that is absolutely not the government's highest priority. Its highest priority is to stay in power and maintain the status quo. China Digital Times just translated an article quoting China's Vice Minister of Foreign Affairs, Dai Bingguo: To ensure the US-China relationship develops forward in a stable, healthy and long-term way, it is very important to mutually understand, respect and support the other side, and defend our o...

Suing Chinese Drywall Manufacturers. Why All The Bother?
2009-07-24 16:22:00
Someone just emailed me an article on Chinese Drywall, with the question, "why do you think these lawyers are spending so much to serve the Chinese defendants." My short answer is that I have no clue. I will backtrack a bit first. The article is entitled, "Chinese-Made Drywall: A Multi-Defendant, Multi-Claim, Multi-District Litigation Has Litigators Multi-Tasking," and it is more a pitch for a bunch of money making seminars than an article designed to impart real information. With that caveat now in place, here are the "offending portions." [Ervin] Gonzalez dug in to the potential defendants, starting with a primer on how the product is made. Gypsum is mined from a quarry, heated to dry, then rehydrated to form a slurry, a paste that is then sandwiched between materials. The mining process raises questions as to whether the contaminants are natural or whether pollutants migrated from, say, a nearby farm where pesticides were used. The ingredients are supposed to be in...
Chinese Netizen Arrested, Sends SOS on Twitter

Many of you are likely familiar with the case of the American student from Berkley back in April of 2008 who when he was taken into custody by Egyptian police managed to send out a short tweet via SMS saying "Arrested." Subsequently his embassy and the press were notified and he was eventually released (see CNN story) thanks to his twitter distress call. Yesterday in China there was a very similar situation, where blogger Peter Guo, who goes by the twitter handles amoiist, sent out the following plea for help:

Owe Money To A Chinese Company? No Need To Pay.
2009-07-10 06:03:00
If you owe money to a Chinese company for product and you cannot pay all of your creditors, skip out on the Chinese company. Near as I can tell, there is nearly a 100% chance they will never sue you to recover. I am NOT advocating not paying your debt, but I am saying that if you have to choose among your creditors on who to pay, the Chinese company should be your choice. I am saying this based on the following: 1. About a year ago, a client had come to me for a consultation regarding a dispute it was having with its Chinese OEM supplier. The Chinese company was threatening to sue my client for about $350,000, per its invoices. My client was refusing to pay the Chinese company due to a spate of bad product. My client was seeking a $150,000 credit for the bad product and the Chinese company was refusing and threatening to sue. I advised my client not to pay anything, based on two legal maxims. One, possession is nine-tenths of the law, and two, never fund someone who is t...
China OEM Agreements. Why Ours Are In Chinese. Flat Out.
2009-07-05 20:18:00
Had a nice conversation with a potential client last week. Company has a great new product it wants made in China. Like many companies starting out in China, this one is in the process of shopping for its China lawyers and my firm was one of four suggested to it by its regular corporate counsel. Our conversation was interesting because we were the fourth law firm with whom she had spoken. This gave me an opportunity to ask how we differed from the other three firms and, not surprisingly, we really differed, both in how we bill for these things and, more importantly, how we typically handle these contracts. I told this company that we would almost certainly do their OEM contract in Chinese and I quoted them a flat fee for doing that, along with an English language translation. They told me that the other law firms were saying that the contract would be in English and they would "need to" charge by the hour and it would even be impossible to estimate how long it would take due ...

Chinese Government Warns Google To Clean Up! Again!
2009-06-23 06:18:00
According to Google “all necessary steps” will be taken to make its Chinese language portal, Google.cn, free of pornographic links. By now almost everyone is aware of the Great Firewall of China, the Chinese Government’s mega plan of internet censorship and surveillance. So what’s the relationship between China and Search Engines like? Well, to say the least, it’s complicated. And the fore runner from the search engines side is obviously the big daddy of search, Google. According to a recent report by Xinhua, the Chinese Government noticed that a lot of Chinese language search results contained pornographic links and wanted it blocked. The Chinese Government wants these particular Chinese search results blocked so they can’t be accessed from any country. The English search queries would remain unaffected though. The report which was released on Thursday says: [Google China] admitted that a “huge amount of porn and lewd information” had been dissemina...

The first successful conversion of pig cells into universally usable stem cells took place at the Shanghai Institute of Biochemistry and Cell Biology under the direction of Dr. Lei Xiao.  Dr. Xiao's team extracted the cells from a pig's ear and bone marrow, and found the right chemical cocktail to reprogram the cells into the three layers of cell types that make up embryonic stem cells.

The Chinese Are Coming, Part IXX, And This Time They Are Serious About Mino

Caine: May I ask, master? When I leave the temple, what will be expected of me? Master Poe: To walk the roads of the land, and use what you have learned for the needs and benefit of the people. Cain: Will I always know when to act and when to stand off? Master Poe: That which you do not know, the doing will quickly teach you. Kung Fu, Episode 26 For years there has been talk of Chinese companies coming to America. And for years, my law firm has been involved in such deals that quickly failed over something as minor as the Chinese company refusing to pay more than $5 million for something that was clearly worth at least $50 million. Not entirely sure why, but Chinese companies have recently started getting much more sophisticated and serious. And FAST. My law firm just started working on two deals where we are representing Chinese companies seeking to buy minority shares in well established American companies and things are actually progressing rather nicely. But bec...
Avoiding Chinese Jails. The Thai Bar Edition.
2009-05-18 09:18:00
A few weeks ago, I did a post emphasizing the need to follow China's laws so as to avoid jail time. My point (taken straight from Aimee Barnes) was that what actions that may be overlooked in your home country of Australia or the United States or some other Western country very well may be deemed to be criminal in China. I just read a Sydney Morning Herald article on how an Australian mother of four spent two nights in a Thai jail and is facing a potential five years in prison for allegedly having taken a bar mat. I am not saying this same thing could happen in China, but then again, I am also not saying it could not. This article on the mom in Thailand ought to convince you that what happens in the West is not necessarily what will happen in Thailand or in China. Or as Apple would say, Think Different.

Under intense interrogation, Becky refuses to admit that she knew all along that her boyfriend was raping her little daughter at home. The harsh interrogation drives Becky to kill herself. What is the truth that the raging commissioner is trying to find out? What is the seemingly defenseless mother trying to hide? Or is she actually telling the truth? Is the phrase, "A woman is born to give her body to men" the whole truth?First of all, this is a CAT III movie but i can assure you that is watchable from any angles since there are no really sex scenes involved in it.

The Chinese Are Coming, Part XVIII. It's The Stimulus Stupid.
2009-05-12 06:05:00
“Who’s going to turn down a Junior Mint? It’s chocolate, it’s peppermint, it’s delicious. It’s very refreshing.” Cosmo Kramer, Seinfeld, episode #60 When I was in law school, I was rankled by students who complained about how busy they were. I mean, we were all taking pretty much the same courses. I swore I would never engage in that whine and I never did. Bloggers who apologize for being too busy to post also rankle me. I swore we would never make that excuse on this blog and for more than three years, we haven't. But today, talking about how I have been too busy to post much is the perfect segue to this post and so I cannot resist. The reality is that my firm has been crazy busy of late and it has been due mostly to China's stimulus. Now I am not a big fan of government intervention and I see government stimuli (that is the plural of stimulus, I looked it up) as the equivalent of a sugar rush (see Junior Mints above), but man, while it is happening,...

Sinovac (SVA): Chinese biotech bet
2009-05-08 06:00:00
"One Chinese sector being relatively ignored by Wall Street is the biotech industry," notes Keith Fitz-Gerald. In The New China Trader, he looks to a biotech speculation -- Sinovac (ASE: SVA)."The government knows that the wheels could fall off the bike rather quickly if average Chinese citizens begin to see a dramatic reversal in their health and happiness. "As a result the Chinese Central Government's is participating in a large-scale effort to improve public health. "That leads us to our recommendation for Sinovac, a fully integrated, profitable China-based biopharmaceutical company that focuses on the research, development, manufacturing and commercialization of vaccines that protect against human infectious diseases."Their portfolio of regulatory-approved products consists of vaccines against the hepatitis A, hepatitis B and influenza viruses."In 2002, they launched their first product, Healive, which was the first inactivated hepatitis A ...
Chinese Chess Is Finally Accessible To Blind And Visually Impaired Persons
2009-05-06 05:30:00
Chinese chess (Xiangqi) is centuries old; some historians date the game back to 400 BC. All this time, blind and other visually disabled persons have been unable to play one of China's most popular games.  But last year, design professor Michael Siu, of Hong Kong Polytechnical University (PolyU), created a Chinese chess set  for blind persons and others with varying levels of visual impairments. The set  has opened up a new sport to millions of vision impaired persons that allows them to be included in a very popular national game.
