Of course I don't believe that this was the intent of the founding fathers, but rather when using the term 'advice and consent' of the Senate they were implying that it was OK for the Senate to not grant consent. Recently we saw a hard-fought battle between the White House and the Senate over the nomination of Judge Michael Mukasey for the position of Attorney General. The specifics of why the confirmation hearing was so difficult boiled down to one question: Would Judge Mukasey commit to denouncing waterboarding and calling it 'torture?'
