They wrote Steve asking him some questions regarding fixed term employment contracts under Chinese law. Steve's reply is a made to order blog post, so here goes: Pursuant to Chinese law, you are permitted to enter into two fixed term contracts with an employee. The term of these contracts can be any fixed term that is agreed between the parties. Typically, in China, the term ranges from one to five years. At the end of the second fixed term contract, you have two choices. You can chose not to continue the employment relationship or you can chose to continue the employment relationship under an open term relationship. An open term relationship requires a written contract. This contract has no term. It terminates only under the following circumstances: 1) the employee voluntarily resigns, 2) the employee reaches retirement age or 3) the employee is terminated for "cause." Term...

As a matter of fact, the Chinese courts do very well at enforcing clear written contracts.” As usual, I was greeted with disbelief. The problem with this person’s statement is that it becomes a self-fulfilling prophecy. People who think China will not enforce contracts tend to ignore the issue. They either enter into no contract at all or they enter into a poorly drafted contract or they enter into a contract that is not enforceable in China. The other contractor, a consortium consisting of China National Machinery Corp, China National Electric Equipment Corp. and local company PT Penta Adi Samudra, was awarded a contract to build the Tanjung Awar-Awar plant in East Java province, Mochtar said. NFL Rookie Contracts Are Out of Control…Still

I touched on this last year, but since the league has no intention of coming up with a solution (which is good news for Jake Long), I’ll rant about it again. In case you haven’t heard, the Dolphins just made Jake long the highest paid lineman in the league. He has played zero NFL games. For those who think it’s a good deal for Miami, take a look at the offensive lineman who have been drafted in the top 5 since 2001: Joe Thomas, Levi Brown, D’Brickashaw Fergeson, Robert Gallery, Mike Williams, and Leonard Davis. Of those six, Williams and Gallery have been complete busts, Thomas looks like a future star, Davis is a solid player but at guard not tackle, and the jury is still out on Fergeson and Brown.
