This week at LWN: On the conviction of Hans Reiser
2008-05-13 11:52:00 On April 28, a California jury found Hans Reiser guilty of first-degree murder. There has been a lot of speculation in the press, both before and after the conviction, on what the loss of Mr. Reiser will mean for the Linux community. Much of that speculation, it seems, lacks an understanding of what Mr. Reiser's role in the community really was. Your editor will take no position on whether his conviction was correct or just. But there are things to be said about what this conviction will mean.

Chung Mong-koo re-elected to Hyundai board despite fraud conviction
2008-03-14 20:14:00 Chung Mong-koo re-elected to Hyundai board despite fraud conviction Chung Mong-koo — the Hyundai head who was given a suspended three-year jail sentence for fraud last year — is back on the South Korean automaker's board as of Friday. Chung was re-elected thanks to strong support from Hyundai shareholders, but the country's state pension fund strongly opposes the move. According to Automotive News, National Pension Service — Hyundai's sixth largest shareholder — voted against the move, due to Chung's fraud conviction and its belief that Hyundai needs improved management. Chung has strong connections to Hyundai as he is the eldest living son of Chung Ju-young — the founder of the Hyundai Group and Hyundai Motors. Shareholders supported Chung — despite his fraud conviction — due to his experienced leadership. Chung will stay as chairman and chief executive until March 2011. First Spam Felony Conviction Upheld: No Free Speech to Spam
2008-03-03 15:51:00 arsTechnica.com: Virginia’s Supreme Court on Friday upheld the first US felony conviction for spamming. The spammer will serve nine years in prison for sending what authorities believe to be millions of messages over a two-month period in 2003. Jeremy Jaynes is the man who will make history. A Raleigh, North Carolina, resident who made Spamhaus’ top 10 list of spammers, Jaynes was arrested in 2003 even before the CAN SPAM act was passed by Congress. Jaynes was convicted in 2005, but his lawyers appealed the conviction. This past Friday, the Virginia Supreme Court upheld that conviction, but the vote was a narrow 4-3. The prosecution presented evidence of over 53,000 illegal e-mails that Jaynes sent over just three days during July, 2003, but it is believed that he sent 10 million messages per day between July and August of that year. Though he is a North Carolina resident, Jaynes was charged in Virginia because the AOL servers he used for sending spam were located in Lo...

DNA secures indecent assault conviction
2008-02-28 20:11:00 DNA taken from a man convicted of driving an unlicensed mini-cab helped solve an indecent assault in Sidcup three years earlier. Karim Merali, aged 48, was sentenced to four years in prison for an indecent assault on a woman in September 2002 at Woolwich Crown Court on February 20. In December 2005, Merali was arrested in central London for operating as an unlicensed mini-cab driver. He was convicted of this offence and a routine dna sample was taken. On March 1 2006 police investigating an indecent assault on a woman in the back of a cab in September 2002 were told that Merali’s dna sample matched the profile found on the victim’s face. The investigation by Bexley police’s sexual offences investigation unit was immediately re-opened. Merali was arrested at his home in Stanmore, Middlesex in June 2006 and denied the charge of indecent assault. He appeared at Woolwich Crown Court on January 21 and was convicted three days later. The court heard that a woman, aged ...

Conviction? What Conviction?
2008-01-11 17:45:00 Strange how history works, isn’t it? Or fails to work, I should say. As German prosecutors proudly see to it that the conviction of a Dutch communist who was executed after the Nazis accused him of torching the Reichstag in 1933 be formally overturned, an event that led to the introduction of detention camps in Nazi Germany by the way, 100 immigrant groups in Germany are reacting in disgust to the populist campaign theatrics of CDU politician Roland Koch, who has suggested the introduction of “education camps” for Germany’s not so fine young and (watch the important word here) foreign criminals. Shooting themselves directly in the foot with this latest gag (with the stress here firmly placed on gag), the CDU, in a clear reaction to the SPD’s minimum wage offensive, got offensive itself by stooping to this American-style boot camp for young criminals idea, which, although it may or may not work in the US, forgets an important distinction or two. Americans generally put the...

You must stick to your conviction, but be ready to abandon your assumptions
2007-11-14 12:37:00 I have abandoned a few assumptions this week. I assumed I could be pregnant (i.e. deal with all the hormones and prepare for this new life coming), take care of our 17 months old boy, my other half and study for a degree at the same time.I had to admit I was wrong. The strain of having to juggle so many things at the same time when all I wanted to do was take care of myself, read, buy baby clothes, hug my boy and man, was making me iffy and moody. I became angry at myself and the world. I started to doubt myself and my choices. I started to become seriously stressed and letting it out on the ones around me. And all these emotions were not good for the baby either. Why could I not handle this?I started analysing the situation. The reason why I chose these classes was so that I could obtain this degree. A degree which would not have advanced me in my current job. It would only allow me to possibly follow some other courses in order to possibly make a career change into education. And e...
