The IFPI Calls For ISPs To Enforce Copyrights
2008-02-03 23:19:00 As a follow-up to my piece about The Music Industry Vs Net Neutrality, it seems that the International Federation of the Phonographic Industry (IFPI) is following in the footsteps of U2’s manager, Paul McGuinness. In their Digital Music 2008 Report (PDF link), John Kennedy, the chairman and CEO of the organization, issues a letter of how ...SHARETHIS.addEntry({ title: "The IFPI Calls For ISPs To Enforce Copyrights", url: "http://www.seanpaune.com/2008/-02/03/the-ifpi-calls-for-isps-t-o-enforce-copyrights/" });

Sweden claims Pirate Bay Violates Copyrights
2008-01-31 23:56:00 The four men in charge of running Pirate Bay, a popular file-sharing site, have been charged with conspiracy to break copyright law in their home country of Sweden.A Swedish prosecutor filed charges Thursday against the organizers of popular file-sharing site The Pirate Bay, saying it has helped millions of users worldwide violate copyrights.The Pirate Bay, started in 2004, allows 10 million to 15 million users share films, music and other copyright-protected material. Pirate Bay acts similar to Kazaa in that it is a source for users to find, share and download content, much of which is copyrighted. The site creates Torrent files, which must be accessed through third-party software programs before it can be viewed.Swedish prosecutors say because Pirate Bay receives advertising revenue for its infringement of the copyrighted works, the people who operate the site are in violation of the law. There are four men facing the charges: Peter Sunde, Carl Lundstrom, Gottfrid Svartholm Warg...

Facebook and Copyrights
2007-12-05 03:15:00 It has been pointed out by Anna Goodson that Facebook has a somewhat (to say the least) scary clause in their Terms of Service that allows them to re-use material posted by their users– and even sell that content to third parties. She points out that anyone who cares about copyright (which we all should) need to be careful: They need to understand that anything they post on Facebook can be used by Facebook and re sold to a third party. This is very important, particularly artists who are sensitive to their copy rights. Here’s a link to the full article about. It’s certainly worth thinking twice before posting illustrations, pictures or other work. Technorati Tags: Art, Illustrations, Copyright

Book Copyrights And The European Virtual Library
2007-11-23 19:14:00 As regular readers of this blog know, I have been publicly advocating for a long time the need to develop proper business models that will make available copyrighted material for free to the public .... but under a mechanism that will also properly compensate copyright owners.The article at the bottom of this post provides a heads up on how the European Virtual Library is progressing in this matter. They are now publicly stating that their goal is to digitize copyrighted material, but will also put in place a mechanism to compensate copyright owners.There are a number of questions that still need to be answered. For example, what is the mechanism of payment? Who will administer it? Who will be able to participate? Will the content be provided for free to the public, or will there be costs involved?The Europeans are finally looking at this in a serious and objective matter .... will the American publishers do the same?UPDATE: France proposes to cut off persistent internet pirates -...

Prince YouTube Ebay and Copyrights
2007-09-20 17:16:00 Music industry icon Prince is picking a fight with YouTube LLC over unauthorized use of video content on the video-sharing Web site.To staunch the flow of copyrighted content, Prince hired John Giacobbi, an Internet policing specialist, and president of Web Sheriff, a company that polices the Internet for copyright and trademark infringements. Giacobbi, based in Marlborough, England, said he has been successful on Prince's behalf in getting YouTube to remove thousands of unauthorized files from its Web site. However, he said users then repost the files, so the next day 100 to 200 new files may have been uploaded to the site."We notify YouTube of infringements and they remove the files, but it goes on ad infinitum at Prince's expense," he said. "Now the onus is on artists and rights' creators to police YouTube at their expense. But there's a problem with that. It's copyright infringement because no one's been given permission to upload these things, let alone YouTube."Prince ma...
Copyrights, Patents & Trademarks for Selling at Craft Shows
2007-08-26 16:57:00 Copyrights, are common concerns for craftspeople. If you'veinvented a unique product, you will more than likely want toprotect it from others who can create knock-offs of your craftshow gem at cheaper prices. Although it may be flattering tohave created a craft item others want to duplicate, it can alsobe a nightmare to see your distinctive creation on the HomeShopping Network! The United States Patent and TrademarkOrganization Web site (www.uspto.gov) is a good place to learnthe differences between trademarks and patents and to learn whatis best for your situation. For more information and to applyfor a copyright go to www.copyright.gov.Although attorneys may be costly, some offer free 30-minuteconsultations, so you may be able to find one who can tell youwhat's the best protection for your craft show product. VMware may violate linux copyrights
2007-08-14 19:38:00 Linux: VMware May Violate Linux Copyrights Posted by Zonk on Tuesday August 14, @01:34PM from the what-about-its-copylefts dept. Nailer writes "Bloomberg believe VMware's IPO today may the largest technology offering since Google. But doubts have been cast over the company's supposedly proprietary ESX product, as top 10 Linux contributor Christopher Hellwig claims the software may violate Linux kernel copyrights. 'Is Hellwig right, and is VMware a derived product of Linux? Unless vmkernel can be loaded without the Linux kernel, it would appear so. VMware was developed from another, long ago OS created as a research project, but it's unclear whether vmkernel was ported from that OS or rewritten as the Linux-requiring binary blob. What's more of an issue is that VMware had these serious questions posed directly to them a year ago, repeated in a public forum many times since, but have yet to respond at all.'"source : s...

An eye on copyrights!
2007-07-16 11:26:00 The Indian Music Industry is paying heave to copyright content online, this time around it is not only limited to audio but churns around video too. According to this article, Kaushal Modi the head of SET India’s licensing and telephony division, has already sent a few legal notices to Google’s YouTube, against the hosting of some of Sony Entertainment’s popular programmes like Indian Idol and Comedy Circus. Sony is monitoring online content to look for copyright violation. “We keep legal notice templates ready in the office—whenever we detect any infringement our lawyers are sending notices,” says Modi. These infringements do cost the music and entertainment industry, but could it be looked at as another form of content distribution. There are many Indian clones of YouTube in India. The process of pinning each infringement seems to be a mammoth job, also considering, the manner in which a video/audio is duplicated over the virtual sphere i...

Copyrights, Royalties & Sharing by Evan Palmer
2007-07-07 03:06:00 A way around increasingly rigid copyright protection mechanisms or overdone policing efforts is to expand on the idea that Canada has used regarding taxing blank cassettes and tapes. We can keep tabs on how often a song or album is downloaded and pay out to the artists based on that up to a maximum. This type of royalty acknowledges the new internet medium, its mobile adjuncts and the decentralization and commons philosophy while still rewarding the artists who create the works.If successful, a regime of this type would lead to reciprocal agreements in other jurisdictions up to the stipulated maximum. Thus, as an example, a specific fee on internet connectivity would pay into a fund that would be used to pay out royalities to artists per time period per jurisdiction.This compensation scheme may actually pay out more to artists than the traditional method. The other tremendous advantage of it is that it would encourage the growth of small groups and unknown artists while it reduces t...
