District Court Throws Out Wrestlers Lawsuit Against WWE... Again
2009-09-19 22:24:00
Back in February, a federal court in Connecticut dismissed a lawsuit brought by three former wrestlers who contended, among other things, that they were improperly classified as independent contractors. The case garnered national attention for a variety of reasons, including the disclosure of the wrestlers contracts. (If you'd like to see the details on the contract, you can view them here.)But after that, two of the three wrestlers (Scott Levy and Christopher Klucsarits) filed a motion to amend the judgment or otherwise set it aside to allow them an replead (or refile) their claims. Notably, one of the wrestlers --- Michael Sanders -- did not join in this motion. On July 31, 2009, the District Court denied the wrestlers' motions, finding that even if it allowed the amendments at this late date, such amendments would be "futile". In other words, even if the court allowed the amendment, the wrestlers would STILL lose on the merits. You can download the decision here. The wrestlers ...

Malaysian Court Says MCCURRY Does Not Infringe MCDONALD'S
2009-09-09 07:11:00
McCurry’s owners get a happy result in victory against McDonald’s.Photo credit: AP/Mark Baker On Sept. 8, a 3-judge panel of Malaysia’s federal court found a restaurant’s use of MCCURRY does not infringe McDonald’s Corp.’s rights in its well-known trademark. It’s apparently the end of the line for McDonald’s in its 8-year fight. The AP cites McCurry’s attorney as saying the ruling means McDonald’s does not have a monopoly over “MC” trademarks in connection with restaurants. “This is a precedent to follow,” he said. McCurry’s sells its curry fare in connection with white-and-grey lettering, a red background, and logo featuring a smiling chicken giving two thumbs up. McDonald’s, of course, sells its western-style fare in connection with its familiar golden arches. The court found these differences supported McCurry’s claim it isn’t passing itself off as ...
Oprah's court battles, a timeline

Oprah's run-ins with the court system have been tons more interesting than her shows (but I'm a guy, so what would I really know.) She's tussled with Texas cattle ranchers, photographers and spurned fans and even a Canadian tabloid that attempted to spread some vicious rumors about her b-friend Stedman Graham. And somehow, the Queen of Talk has emerged unscathed. From $1 trillion to a couple hundred thousand, there is a colorful cast of characters in Oprah's dances with the justice system....

Photo by her daddy. Isn't she beautiful?! That's the case in which my sixteen-year-old atheist daughter, Dawn Sherman, who was only fourteen years old at the time, took on the entire Illinois General Assembly in federal court and won, getting the notorious mandatory Student Prayer Act declared unconstitutional on January 21st of this year by federal Judge Robert Gettleman, a former ACLU of Illinois Board Member (how convenient!). Madigan requested last week, for the third time since April, that the Appellate Court suspend briefing on the case until...

Sotomayor on Supreme Court shows Latinas can defy the odds

Wise Latinas are celebrating the Senate confirmation of Sonia Sotomayor 68 to 31 to the United States Supreme Court. But this is a moment of pride for all Americans. It shows that no matter your class, race or ethnicity, if you work hard one can aspire to the highest court in the land. But let me explain why Judge Sotomayor means so much to Latina women like myself. It is in part her personal story, daughter of Puerto Ricans, raised in the Bronx, who goes on to succeed at Ivy League schools and defy the odds against her.How hard was it for her to defy these odds? Here are some sobering facts about Latina women in the United States:...

Illinois Attorney General Lisa Madigan. Assistant Attorney General Rachel Murphy "suggests," as she put it in her brief, that the Appellate Court "suspend briefing in this matter" until November 3, 2009.  In the alternative, Murphy "proposes that the Court set a briefing schedule." The reasons cited for suspending briefing for yet another three months were disingenuous and misleading....

In this era of computers nobody can deny the presence of computer and internet in their life. With the increasing penetration of computers and internet there is huge splurge in cyber crime. None can forget the arrest of Avneesh Bajaj, CEO, Baazee.com (now ebay.co.in) regarding the sale of MMS of DPS scam or the parliament attack case but these proceedings either happened in regular courts or specialized panels were setup for them. None of which is suitable and possible for all cyber crime cases. Now after a lame attempt to solve the cyber crime cases in regular courts for more than 8 years, Indian Government has recognized the need of a separate court for cyber crimes and is looking to set up at least one cyber court in each region to handle cases related to cyber crimes like email forger, email and website hacking, identity theft, data theft etc. The first cyber court has been setup in Delhi with Justice Rajesh Tandon as the presiding officer of Cyber Regulation Appellate Tribunal...

President Obama nominates Sonia Sotomayor to the Supreme Court VIDEO TEXT
2009-05-28 02:30:00
REMARKS BY THE PRESIDENT IN NOMINATING JUDGE SONIA SOTOMAYOR TO THE UNITED STATES SUPREME COURTTHE PRESIDENT: Thank you. Well, I'm excited, too. (Laughter.) Of the many responsibilities granted to a President by our Constitution, few are more serious or more consequential than selecting a Supreme Court justice. The members of our highest court are granted life tenure, often serving long after the Presidents who appointed them. And they are charged with the vital task of applying principles put to paper more than 20 [sic] centuries ago to some of the most difficult questions of our time.So I don't take this decision lightly. I've made it only after deep reflection and careful deliberation. While there are many qualities that I admire in judges across the spectrum of judicial philosophy, and that I seek in my own nominee, there are few that stand out that I just want to mention.First and foremost is a rigorous intellect -- a mastery of the law, an ability to hone in on the k...

Boxer Demands Obama Pick A Woman For Supreme Court

More at Zennie62.com | Follow me on Twitter! Like other supporters, I received this email letter from U.S. Senator Barbara Boxer, but this one was pointed right at one of my favorite subjects: "Who should be Justice David Souter's replacement on the Supreme Court?" After not much stewing on the matter, I would guess, Senator Boxer wants it officially known: President Obama's choice must be a woman and she's taking to the Internets to make it known. I still favor Kathleen Sullivan for the job so no harm there; this is what Senator Boxer wrote: Dear Zenophon, Women make up 51% of our nation's population. Yet only 17% of the seats in Congress are held by women. Only 3% of corporate CEOs are women. And just one out of nine Supreme Court justices is a woman. President Obama can change that. Send an email to the White House now — and urge President Obama to nominate a woman to the U.S. Supreme Court! Since Sandra Day O'Connor's retirement from the Supreme Court ...

Another Flowers Fraud On Obama?s High Court Choice
2009-05-08 21:29:00
I have to believe that the Philadelphia Daily News give column space to Christine Flowers on Friday because it will make our weekends more enjoyable to know that her dreck won?t appear again for seven days afterwards. She wastes more of our time here today on the question of who President Obama will choose as his Supreme Court nominee to replace Justice David Souter; after telling us that Obama ?still? hasn?t made his choice (is he supposed to be governed by sands running from an hourglass on this?), she implies that he?s busy making sure the demographics of his choice are satisfactory to the voters who elected him.And then she tells us this? This is the first time in more than a decade and a half that a Democratic president will be asking a majority Democratic Congress to approve his high court pick. The last was Bill Clinton, whose choice of Ruth Bader Ginsburg was graciously handled by both sides of the aisle: She was confirmed by a 96-3 vote.Don't expect to see those numbers this...
