In the early years of this blog, when discussing China's court system, I would make it a point to emphasize that I was limiting my comments to how the courts handle business law matters. I did this for two reasons. One, my sense is that the quality of court handling of business cases is very different from the quality of judging given to criminal matters. Two, I am not the least bit qualified to talk about how Chinese courts handle criminal matters as I never studied Chinese criminal procedure and my firm has never (and will never) represented a Chinese criminal defendant. Working in tandem with Chinese lawyers, we have represented a number of foreigners in criminal proceedings in China, but those cases do not qualify me to speak on China's criminal justice system as a whole. DGR Associates, Inc. v. United States involved a decision by the Air Force to issue a set aside contract for qualified 8(a) companies. The project involved housing maintenance, inspection services and repairs at Eielson Air Force Base in Alaska. The solicitation was challenged by a HUBZone contractor who claimed that the Air Force violated the Small Business Act by failing to give priority to HUBZone contractors. Specifically, the protesting contractor claimed that when the HUBZone program was established in 1997, the legislation required agencies to consider setting aside contracts for HUBZone contractors prior to considering any other small and/or disadvantaged companies for such contracts. Tuesday, the DC Circuit Court of Appeals said the Federal Communications Commission had no power to regulate net neutrality.  While court did not say the FCC cannot regulate the internet, the court did leave the door open for these to be regulated in through future acts of Congress. The basis for suing in the United States is that "Qingdao Shengyuan Milk Co. Ltd., a dairy products manufacturer based in the eastern China city of Qingdao, had a Delaware-registered investment subsidiary with offices in Maryland, rendering it subject to U.S. law." This New York Times article does as good a job of any at setting out the issues China is facing in deciding whether to allow milk taint victims to pursue their claims in court. The article is, somewhat wrongly entitled, "Courts Compound Pain of China's Tainted Milk." It does a nice job dealing with the issues of whether China's courts are set up for these sorts of mass tort cases and also whether the rejection/acceptance of such lawsuits is being driven from Beijing or locally. I would think most Western lawyers would agree China eventually needs a system that can handle class action torts (or just mass tort cases), but the much tougher question is what it should do in the meantime.

Just came across this article discussing a ranking of various Asian countries' judicial system, conducted by Political and Economic Risk Consultancy (PERC) (h/t to Silk Road International Blog): 1,537 corporate executives working in Asia rated the judicial systems in the countries where they reside, using such variables as the protection of intellectual property rights (IPR) and corruption. Transparency, enforcement of laws, freedom from political interference and the experience and educational standards of lawyers and judges were also considered. "Year after year our perception surveys show a close correlation between how expatriates rate judicial systems and how they rate the openness of a particular economy," PERC said. The article is entitled, "The CCP Strengthens Control over the Judiciary," and to grossly summarize, it very convincingly argues that Hu Jintao is moving to ensure even greater political control over China's judicial system.
