A Single Europe for Data Protection?
2008-07-15 02:00:00 Last Friday I spent the morning in the company of a lawyer from a top international law firm. Once we'd marvelled that the sun had finally deemed to make an appearance over the grey skies of London, our conversation turned to the rather weightier subject of data privacy. We've been doing a lot of work around using ISO27002 as a framework best practice in developing and deploying a robust information security strategy. As part of that work, I and my "Evangelist" colleagues have taken a stab at mapping various regulations against this "gold standard" in order to help customers understand where overlaps, or indeed gaps, may occur between these various regs...

Government Conclusion: Irish Bloodbank Did Not Breach Data Protection Act B
2008-02-28 07:38:00 Irish Blood Transfusion Services did not breach the Data Protection Act when their donors? information got stolen earlier this month. Or rather, when the laptop containing their donors? information was stolen. The Data Protection Commission found ??that the encryption in place on the laptop was sufficient to ensure that there is only the remotest of possibilities of access taking place to the personal data in question.? Plus, they also investigated to make sure that the usernames and passwords to decipher the encrypted information was not stolen along with the laptop. Veryfing that the keys were not, say, written to a post-it and stuck to the bottom of the device, I assume. So, how remote are the possibilities of someone breaking the encryption? Well, it depends on two factors: the strength of the encryption key itself and the strength of the passwords. The encryption key is what is actually used to scramble the information on the laptop.&nbs...

You were in the middle of some project, and your machine suddenly dies on you, you sit there staring at a blank screen, tapping the laptop(like its an old analog TV), moving your mouse all around, and re-starting the machine as the last attempt, frustrated that all your unsaved precious data is gone for good?? 2007 worst ever year for data protection
2008-01-07 13:43:00 Data on 37 million Brits mislaid By John Oates → More by this author Published Monday 7th January 2008 12:04 GMT Last year was the worst ever for data losses in the UK, with almost 37 million people having their private data compromised. The government’s loss of 25 million child benefit records was the largest single screw-up, but other government departments and private companies played their part too. The figures were compiled by the Lib Dems, and party leader leader Nick Clegg said the problems showed the need for a rethink on data protection legislation, as well as calling for the immediate end to the ID card project. Clegg said: “The ID card project is now in freefall, because faith in the Government’s ability to handle personal data has hit crisis point. “There is simply no way that any democratic government can expect an unwilling public to accept having their precious personal data cropped and stored in the world’s largest database when they a...

Data Protection Is The Law In Oregon At The Turn Of The Year: Data Encrypti
2007-12-28 05:48:00 The associated Oregon senate bill, The Oregon Identity Theft Protection Act (SB 583), is surprisingly short but to the point?and extremely readable. It feels like someone other than lawyers wrote it up. It also seems to build on past legislation already in place for personal data protection. For example, those who are already in compliance with HIPAA would also be in compliance with SB 583. The former may carry a tag of ?96 (as in, Health Insurance Portability and Accountability Act of 1996), but eleven years later, the concept on how to protect someone?s information hasn?t changed; it?s the implementation that had to catch up. And catch up it did. There are numerous regulations in HIPAA for protecting patient information, including what people have termed ?shoulder surfing,? the act of getting information by looking over someone?s shoulder. Back in 1996, there was no method to prevent that unless you had a wall against your back. An...

Continuing TJX Legal Saga Further Highlights Need For Data Protection And E
2007-10-27 05:26:00 TJX is back in the news, and in a big way. The reason for the brouhaha is the new estimated number of credit card accounts compromised when TJX security was breached last year. The new number is 94 million, double the original TJX estimates of 46 million, as reported in a court filing. The new estimate was provided by the bank group that is suing TJX in order to recoup costs involving the notification and issuance of new credit cards for affected customers. In light of the above, obviously a lot of people are asking if the new estimate is real, or if it has been inflated in order to induce a bigger, and faster, settlement. I guess there is an incentive to inflate it, but at the same time people have multiple credit card numbers. Perhaps TJX is consolidating some of their findings based on the number of people affected, whereas the Bank group is reporting a pure number of accounts affected? Anyway, most commentators don?t seem to know what t...
Data Protection: Need, Right, And Time Should Be Extended To Mobile Devices
2007-10-24 06:43:00 In a Government Technology article, an argument is made that access to data should be granted on a need, right, and time basis. Now, this is not a new argument, and it was directed to securing databases and their contents. The argument is that not everyone needs to have access to information on a database or databases. Obviously, depending on one?s seniority and ranking within an organization as well as type of job one holds, the type of information that one should have access to will differ; the higher in the hierarchy, the more information one needs to access. Along with the need, the right to access information is to be considered as well. In fact, some would argue that the need and the right to access information are intertwined, and are not to be considered on a separate basis. The third criterion, time, is meant to curtail access to the data as necessary. If an employee always works from nine to five, there is no reason why he should...

Eventually (when our lazy blog programmer gets around to it...just kidding) we'll post it as our first "blog roll". This is new terminology to me as a still-relatively-fresh blogger, but the goal of the blog-roll is to single out the sites that are shaping the future of online security and identity. We want to have a list that reflects the global nature of the conversation. Plus, we want them to be engaging, topical, and present a mature point of view. We?re not endorsing the sites or their content, of course, but simply recommending them based on reputation. Let's us know what you think ? and what we?ve missed! Here's the current list...
