Doing Business With China? Don't Look To The UCC
2009-08-09 13:38:00
United States domestic business lawyers live and breathe the Uniform Commercial Code (UCC). Let's turn to Wikipedia for an explanation of how the UCC came into being and why it is so important: The Uniform Commercial Code (UCC or the Code), first published in 1952, is one of a number of uniform acts that have been promulgated in conjunction with efforts to harmonize the law of sales and other commercial transactions in all 50 states within the United States of America. This objective is deemed important because of the prevalence of commercial transactions that extend beyond one state (for example, where the goods are manufactured in state A, warehoused in state B, sold from state C and delivered in state D). The UCC deals primarily with transactions involving personal property (movable property), not real property (immovable property). The UCC is the longest and most elaborate of the uniform acts. It has been a long-term, joint project of the National Conference of Commissioner...

Doing business at a political convention? Not to be cynical?.But it wouldn?t be unheard of?Better to be prepared than left out in the cold. After all, it is Minnesota?.in September?.To get a feel for the numbers, Verizon anticipates a whopping 150% surge in broadband usage from the Minneapolis-St. Paul downtown core when delegates, political junkies, hangers-on and the merely curious follow John McCain?s Straight-Talk Express to Minnesota for the Republican convention, September 1-4. Cellphone capacity alone is expected to jump 35%. In anticipation of this demand surge during the quadrennial gathering of the conservative faithful, Qwest Communications is installing an additional 100 miles of fiber-optics and copper around St. Paul?s Xcel Energy Centre. Other telecoms ? AT&T, Sprint, Nextel ? are following suit.Assuring your IT needs in advance ? securing business computer rentals, server rentals, peripherals etc., as well as the IT support to service them ? will definitely ...

2008-04-14 16:00:00
Even though India is regarded as the Information Technology hub, Indian has been ranked lowly at 50th place in the recent report - The Global Information Technology Report 2007-2008 - produced by the World Economic Forum in cooperation with INSEAD, the leading international business school. In this year rankings, Denmark got the coveted position of being the most networked economy in the world, followed by Sweden and Switzerland. Among the top ten, the Republic of Korea (9) and, to a lesser extent, the United States (4) post the most notable improvements. China fared even worst in the ranking and came in at 57th place, 7 ranks below India. It is quite surprising given the infrastructure development taking place in China in last 2 decades. The comprehensive report ranked total of 127 economies on more than 80 different parameters covering the environment, readiness and usage of Information Technology. Doing business
2008-03-30 21:22:00
I was getting myself ready to write about Entrepreneurship in Brazil and dedicate it to Cris Zimermann from Virtual entrepreneur when I found this article: Brazilians are among most entrepreneurial . It says that “The total entrepreneurial activity index (TEA) in the country grew from the 11.6% registered in 2006 to 12.72% in 2007, the equivalent to 15 million enterprises” Anyway, the thing is that if you are looking at this screenshot (I’ve copied it from there, thanks) you will see that none of the so called “developed countries is there”. I don’t know yet why, but the good news is that the article is based on the findings of the 2007 GEM research (look for the PDF file to download) written by Niels Bosma, Kent Jones, Erkko Autio and Jonathan Levie. Now I need to read this, and I’m sure it will be interesting to find out what’s special in the countries in the top (I know that Romania usually ranks amongst the bottom of the list, sho...

Cost of Doing Business on eBay: An Article eBay Does not Want You to Read
2008-03-13 14:47:00
We?ve all heard the stories of people making a surprisingly good living from opening up a business on eBay. Some people have even become millionaires thanks to the ease of use and global reach of eBay. You may say to yourselves, ?It seems easy enough. If others can make a nice profit on eBay, why can?t I?? The truth is, eBay is not as profitable as you may think. The escalating costs of fees and marketing are forcing more and more people to shut down their eBay business. In August of this year, eBay announced to its members yet another increase in fees. For businesses who make their profit selling more expensive items, the fees don?t hurt as much. It?s the ?little guys?, who make up the majority of eBay businesses, which are suffering the most. That is to say sellers that offer goods sold for less than $10.The current fee structure for cheaply priced items is quite astounding. For this example, we will assume that the item being sold will be $5 or less. For items with a starting pric...
Why Are You Doing Business?
2008-03-12 03:05:00
As business owner you may at times ask yourself what am I doing? If you are asking this then there are chances you maybe getting bored with your current business. This is not unordinary, especially if your a serial entrepreneur. Many times the reason why you would resort to this is that there is no longer a challenge for you in this business.First, go back to your business plan and review the mission statement. Sometimes a refreshment session with your business plan may re-inspire another idea or get motivated about the business again. If this doesn’t work take a few days off and step back. Don’t be afraid to give yourself a vacation as a small business owner. Vacations are necessary in order to avoid the burnout. When I mean burnout I don’t just mean you being burned out, but take a look at your family and give them a break to spend more time with you. Your family is there to support you yes, but be sure to take some time to give a little something back to them.Next, if the f...

Art of running a startup from Smartest Unknown Indian Entrepreneur

Asian economic boost - doing business in China
2008-02-24 07:45:00
After writing the other day about entrepreneurship advices from the Philippines, today I found a very interesting review on the Chinese economic growth, which can at least show you a glimpse of what’s really going on. Usually when talking about stock markets, recession, unemployment and stuff, heads turn towards USA or maybe even Europe. But hold your pants, it seems that the history is written somewhere else this time: China! Philip Fernando from Asian Tribune, makes an interesting review of the Chinese developments in an article called “Entrepreneurship in Asia, Alive and Kicking“. I’m going to quote a couple of phrases so you can see what we are talking about: “Asian giants China and India have shown colossal economic gains generally considered epochal and almost parallel to what USA went through during period following World War II. “ “Several studies by research groups predict that China’s middle class of 100 million would increase t...

Interesting article on doing business in China
2008-02-14 14:19:00
Post found in the http://www.chinavortex.com/Work-ing the Gray Areas in ChinaIf I were to wait until the Chinese government said I could do something, I?d never be able to make money.?This is a line I have heard on many occasions from different Chinese entrepreneurs. In China, there are many areas which are not strictly illegal, but they?re not legal either. Most of the time, these involve fields which are too new for the government to regulate. Any government is a slow-moving giant; they are not renowned for their quickness and being smart. In this business ecosystem, the advantage lies with the fast-moving entrepreneur who can identify a need and move in quickly.By the time the government has figured out the industry and begins to regulate it, the major players are already established. This is how the online gaming industry started in China with Shanda, and how Giant Interactive became successful with its pay-for-play online gaming model. When Americans and Europeans go to China, the...

This aims to be an easy to read, yet comprehensive overview of legal issues involved in doing business in India. INTELLECTUAL PROPERTY RIGHTS Indian courts vigorously protect intellectual property rights (IPRs). Following the GATT Agreement India has made its IPR laws TRIPS compliant. In this Chapter, we deal with the three major IPR laws viz. Trademarks, Copyrights and Patents. TRADEMARKS: Registration of a trademark is not mandatory as the law also recognizes and enforces the Common Law right of passing off. However for passing off, the plaintiff has to establish its reputation in relation to the mark and the fact that the offending mark is likely to confuse the public. On the other hand once the mark is registered it automatically confers on the proprietor an exclusive right to use the same in relation...

Brand Building is definitely an exercise
2008-01-22 12:35:00
Brand Building over the new media is just an emphasis or a new route to the traditional media which means ?Give customers what they want?. The business means the same today, as it was yesterday. However with the rising trends like Competition, Globalization and Virtualization, the options to reach consumers are broadened. The simple steps to build a brand are to fulfil the requirement of the end users, relentless attention to make such brands and the third step that follows the two which is consumers become part of the marketing and sales force (Word of Mouth). Engaging customers in a way that value deliverance is the embedded keyword behind your core strategy is a concern, however leveraging customers' value acceptance is given more priority
