Echostar’s Charlie Ergen is up to something. It’s hard to know exactly what to expect, but the company is making some interesting moves, and we’ll be watching and reporting on them. EchoStar, the satellite broadcasting company, is finally changing its name to DISH Network, according to a filing with the SEC. Why the change? EchoStar wants its name to truly reflect its true business. It is also planning to spin off some of its businesses, and that spin-off will be called EchoStar Holding Co. (EHC), a move we had mused about earlier. Charlie Ergen is going to be chairman and CEO of both companies. EHC had sales of over a billion dollars and a profit of about $32 million for first six months of 2007, on a pro forma basis. The long-running dispute between Tivo and EchoStar inched a little closer to resolution today, with the United States Patent Office issuing a non-appealable ruling saying that Tivo's DVR-enabling "time warp" patent is valid. You might remember that Tivo sued EchoStar for violating that patent in Dish Network DVRs at the beginning of 2006, and won a $90M judgment and an injunction requiring EchoStar to turn off existing DVR functionality and stop selling DVRs in the future. That injunction was then stayed pending EchoStar's appeals before the Patent Office and the Federal Court of Appeals, so sadly, this ruling doesn't mean the case is over yet -- now it's the Court of Appeals' turn to try and sort this out.[Thanks, Dennis]

Echostar Communications Corporation (DISH) revenue for the third quarter ending September 30, 2007, increased by 12.9 percent to finish at $2.79 billion. Last year in the same period they generated $2.48 billion in revenue for the quarter.The satellite television operator had net income increase to $199.7 million, or 44 cents a share. That compares with the $139.6 million or 31 cents a share earned last year. Profit increased from the selling of high-end services and cutting costs of customer equipment.Concerning adding new subscribers, the company dropped a large amount from last years' third quarter, bringing in about 110,000, while last year they brought in 295,000.
