2008-11-29 16:23:00
Thanksgiving has come and gone. But reasons to be cheerful/thankful still abound. For instance, say yay for free speech. Which is always under attack by somebody somewhere. California Approve Eminent Domain Restrictions - Prop 99
2008-06-05 16:00:00
Congratulations to the voters in California for passing Proposition 99. The new ordinance will keep developers and those politically connected from using state and local governments in California from seizing properties in their name. I have no problem with eminent domain being used for public projects. That is the role of it as long as ...
EMINENT DOMAIN - GOOD OR BAD? YOU DECIDE
2008-06-02 05:10:00
In less than forty-eight hours California voters will determine the outcome of two ballot measures focused primarily on limiting the power of state and local governments to use eminent domain. Proposition 98 and Proposition 99 offer differing approaches to the issue. But first, what is eminent domain? Eminent domain is defined as the right of the government to take private property from an owner, for the public good, paying fair market value. For example, building a highway, school, water project or some other "public" good may require a state or local government to acquire land through the process of eminent domain, or the involuntary transfer of title by the operation of law. According to their ballot statements Proposition 98 "bars state and local governments from taking or damaging private property for private uses. Prohibits rent control and similar measures. Eliminates deference to government in property rights cases. Change condemna...
Garabedian Suggests Eminent Domain Seizure
2008-03-21 14:18:00
Even though he probably won’t win this one, council President Garabedian is impressive in his tenacity. He just won’t let go of the fundamental issue regarding the Cullion Concrete plant — that the original building permit was granted wrongly. He’s like a bulldog going after the same bone again and again. You ...

Ah, the power of a police force. The Kane County, Illinois government is in a quandary. They signed a long term lease on an old Montgomery Ward to house their government offices. But then decided they wanted to buy the building. If it was a deal with anyone but a governmental agency, the process would ...

Subprime Cottage: Eco-Friendly w. Eminent Domain View
2007-12-12 05:54:00
Cast your mind back to Susette Kelo. She and her neighbors in the waterfront neighborhood of Fort Trumbull in New London, Connecticut, had their homes and investment properties taken from them by local government and the quasi-public New London Development Corporation. Poodle to Connecticut’s Department of Economic and Community Development. Residents of Fort Trumbull were mainly blue collar. Some had lived there all their lives. Though the neighborhood was often described as “modest” those who used eminent domain to take it were not. A rich stew of politicians, planners, developers, and corporate interests decided the community of Fort Trumbull didn’t deserve to exist. The land would better serve as a setting for a condo/hotel/office park that would enhance nearby Pfizer Pharmaceutical. Susette Kelo and a group of her neighbors fought the land grab all the way to the U.S. Supreme Court. Citing their property rights, as guaranteed by the Constitution. Kelo...
Drew Carey and Eminent Domain
2007-11-29 21:09:00
This is turning out to be a video day. Not intentional, there’s just a lot of good video out there right now. Eminent domain is the constitutionally sanctioned practice of taking land for legitimate public uses. Traditionally, that’s meant things like roads and schools. Over the past several decades, however, governments have gone hog wild with eminent domain, routinely condemning property and turning it over to well-connected private developers as a way of subsidizing economic development and increasing tax revenues (never mind that it doesn’t always work out that way). Officials in National City, a predominantly Hispanic community near San Diego, have pushed to bulldoze a popular athletic center for struggling kids to pave the way for private developers to build new luxury condos.

Federal Eminent Domain Lawsuit Rejected
2007-06-07 07:06:00
Yesterday, a federal judge dismissed the eminent domain lawsuit that opponents of the Atlantic Yards project had seen as their best shot at derailing the current plan. In ruling in Goldstein v. Pataki, U.S. District Judge Nicholas G. Garaufis said that even if the benefits of the project (jobs, housing, etc.) fall short of what ...

Each issue of Business Reform features practical advice on operating successfully in business while glorifying God.By Ian Hodge© 2005 Business ReformJust when you think the economy is bad enough, forcing people out of work, a new danger emerges forcing people not only from their jobs, but in some cases from their houses as well.It has become an accepted belief around the world that the government--local, state and federal--can do whatever it likes. Unfortunately, it is not just a belief, but it happens in practice as well.As a result people have been served condemnation notices on their properties in order that the properties might become available to other businesses in the community. Under the guise of better planning, people have had to give up the right ...
