Very important article in today's China Daily, entitled, "Government targets land pollution to ensure food security." Far more important than the reason for this targeting is the who and what of the targeting. China's Ministry of Environmental Protection has announced that the "company which inherits the debts and rights (of the polluter) should shoulder the responsibility for providing financial assistance to restore the productivity of polluted land." The article notes that the previous policy on this "was unclear." This jibes with what we have been telling our clients for years: when buying a Chinese company, your due diligence must include reviewing its potential environmental liability. We have been saying this both because the law on this has been unclear and because this is the case in the United States and (as far as I know, in many other countries as well) and this will likely eventually become the case in China as well. This is a great video from Flight 404 which ended up winning a recent D&AD competition. It's good because it's a clever use of time and space to tell an alarming environmental story. However, it's also kind of numbing because after a while the numbers tell a story that shows the impact and responsibility we all have. Where's the meaning? As vehicles get more and more complex, auto suppliers will need everything in their arsenal to win major contracts from automakers. According to an article on Just-Auto (sub. req'd), by the year 2012, automotive suppliers will bear more than half of the total research and development of a given automobile. What this means for suppliers is that they need to stay at the forefront in environmental technologies. Increasingly complex systems will be necessary for automobiles to meet stringent emissions and fuel efficiency requirements. Biofuels and clean diesel technology are reportedly one area that suppliers are being relied rather heavily upon. Not only must the suppliers integrate the latest technology into their equipment, they need to do so at an agreeable cost to the manufacturer. Charlie McElwee of the China Environmental Law Blog did an interesting post analyzing a Xinhua article on increased enforcement of China's environmental laws and on Chinese companies' growing realization that going green means making more green. Though Charles is an environmental lawyer based in Shanghai, unfortunately, he does not provide his own assessment on these issues. My own personal data base is not large enough to venture an opinion regarding enforcement of China's environmental laws, beyond stating that it is getting increasingly tough to secure Chinese government approval to form high polluting WFOEs (Wholly Foreign Owned Entities). I can also vouch for the fact that green marketing is on the rise in China and I have to presume this would not be the case unless money is being made by doing so. Certainly, this green marketing is more apparent in Shanghai and Beijing than in the second tier cities. What are you seeing?

In the process of creating and building the Kia cee'd, Kia has won two environmental certificates from the well-known German institution TÜV. At a ceremony in Seoul, Korea on Friday, TÜV gave Kia DFE (Design for Environment) and a LCA (Life Cycle Assessment) certificates for the way Kia is building the cee'd in Zilina, Slovakia. The DFE award certifies that the car was environmentally designed and developed. The LCA takes a broader look, and is given to vehicles that have a lower lifetime environmental impact.
