2008-06-10 06:54:00 I roomate has always been late on paying rent. Now, he has left the state with no forwarding address and has left all his property behind. He has promised to pay but will not return my phone calls so I have no way of serving a 3 day notice. Rent is due on the 1st and it is now the 9th. DO I have a legal right to hold his property, and can I rent the room out without serving the 3 day notice. What are my next steps?

2008-06-09 19:41:00 I belong to the Apartment Owners Association and they told me that even though my tenants have a year lease with me and are only on their 3rd month of renting that I can just serve them a 3-Days to Pay or Move Out Form. Is that really all I need? After that comes the eviction process? Well, what are the forms for that? Are there forms? A step-by-step list that I can follow? I've looked up the Dept. of Consumer Affairs site and they have no forms. Can someone please explain to me what Eviction process means? Thanks!

I gave my tenants 30-days notice of termination (we are M2M lease - the lease agreement stated that I need to send 30-days notice even the state law only required 20-days notice ) on April 11th, asking them to move out by May 31st. They did not pay me the rent of May after they received the notice. Worse, they did not move out on May 31st as indicated in the termination notice, and told me that they would move out by June 6th instead. On Friday (June 6th), they started moving out but still not returned the keys to me. I called them late yesterday, asking them the time want to have the walk-thru and they told me that they could not move out completely till Moday.. ?? I know that they moving out but I don't know how long will it take to completely move out. 2008-05-23 20:26:00 I am a landlord and also an attorney and I understand the landlord laws pretty well but I have more of a logistics question.I'm in the process of evicting tenants that have trashed the house and not paid for the month of may. That is pretty much a done deal.Here is my question, my court date is on June 4. I called the electric company to switch the utilities back into my name and they said that in order to have uninterrupted service, I would have to have it transferred by May 27th.My question is, do I want to have uninterrupted service because won't the tenants be more likely to stay or do I want to have them without electricity for a couple of days and that will be more incentive that their stuff is out by the eviction date.It's not an issue of retaliation, their service for whatever reason will be cut off on the 27th but not because I cut it off.

The clerk is telling me I cannot represent another person in court even with the power of attorney. My father is close to death and hospitalized and has signed over poa to me. I dont understand. The court insists that I have an attorney sign the summons. The Notice to quit has been served by the sheriff and time has expired. 2008-05-08 17:35:00 I have/had a tenant at will. He was disabled in a work related accident and has had all sorts of administrative problems getting disability. I waited for a year (he paid no rent) then advised I could not wait any longer. I gave him a 45 day notice that I was terminating his lease and he was expected to be out by April 1. He told me in April he was trying to find a place to go, but I told him if he was unable to make arrangements by MAY 1 I would begin the eviction process. I have the necessary Notice to Quit form for MA. There are language differences for a TAW and a leased tenant.It is considered a deceptive practive to use the TAW language with a tenant who is not a TAW. At this point, since his tenancy at will was terminated, there is no lease at all. Am I required to do the Notice to quit with tenancy at will language?

Pay or Quit-Eviction Confusion
2008-04-14 19:29:00 I have a lease agreement with a tenant that runs from the 12th-12th. Their first month began on Oct 12th. which means they paid for oct 12th-nov 12th. Fast forward...they only paid partial payment on March 12th. After the 3 day late period I sent a 5 day pay or quit. After no response I went to court and filed unlawful detainer. At court today the judge dismissed. She eluded to either I was doing it wrong or I simply filled out the paper wrong. On the pay or quit and the unlawful detainer I stated the period in question was 3/12-4/12. She tells me that I couldnt begin the process untill 5 days after 4/12 not 3/12. Do I really have to wait 35 days after its due???? or did i simply filled it out wrong and should have put 2/12-3/12??? help!!!!
