British hacker can challenge US extradition
2007-12-16 06:54:00
A British computer expert, accused by Washington of "the biggest military hack of all time", was given permission to take his fight against extradition to the US to Britain's highest court. Gary McKinnon was arrested in 2002 after US prosecutors charged him with illegally accessing government computers – including Pentagon, US army, navy and NASA systems – causing $700,000 worth of damage. A district court ruled in May 2006 that he should be extradited, a decision upheld at London's High Court in April this year. But on Monday, three of Britain's top judges gave McKinnon permission to take his case to the House of Lords. McKinnon's lawyers argue that sending him to the US would breach his human rights, be an abuse of the English court process and should be barred as his extradition was sought "for the purpose of prosecuting him on account of his nationality or political opinions". Between February 2001 and March 2002, using his own computer in London, McKinnon gained una...
S`pore denies Lee Kuan Yew against extradition treaty with RI
2007-11-28 01:24:00
Singapore on Tuesday denied that Minister Mentor Lee Kuan Yew has expressed objections to the Extradition Treaty (ET) as part of one package with the Defense Cooperation Agreement (DCA) with Indonesia. "Singapore remains fully committed to the agreed package of the ET and DCA," the Singapore Embassy said in a statement issued on Tuesday. The embassy was responding to the statement by Indonesian Defense Minister Juwono Sudarsono last week that Lee Kuan Yew seemed to be against implementing the DCA in one package with the ET. "The obstacle we have noticed is that Lee Kuan Yew appears to be unwilling to implement the extradition treaty because it is related to Singapore`s services-driven economy. If the treaty is implemented the fairly large amount of Indonesian money invested in Singapore will become a problem," he said.Indonesia News Blog: http://indosnesos.blogspot.com-

The Privy Council Has Denied The Extradition Appeal Of Alleged Bahamian Dru
2007-11-11 16:33:00
Application denied BY Privy Council: By ARTESIA DAVIS, Guardian Senior Reporter - Nassau, Bahamas: The Privy Council yesterday refused an application by alleged drug dealers Dwight and Keva Major for permission to file a challenge to a court's order that they be sent to Miami, Florida to face drug charges. Former foreign affairs minister Fred Mitchell signed a warrant of surrender last year authorizing the couple's extradition after their lawyer failed to file an appeal to the Privy Council within the required time. And now the Privy Council has declined to grant lawyer Keod Smith special permission to file an appeal to its judicial committee more than a year after the Court of Appeal's decision. Now the only thing preventing the couple's extradition is a stay that was filed in the Supreme Court to prevent Bahamian authorities from executing the warrant of surrender. Bernard Turner, the director of public prosecutions, said once the stay is removed "The law will take ...

Extradition Appeal Against Seven Bahamian Men Facing Drug Charges In The Un
2007-10-18 01:10:00
Extradition Appeal Dismissed: By Quincy Parker - Nassau, Bahamas: The Judicial Committee of the Privy Council has laid out the reasons underpinning the high court?s decision to dismiss the appeal against extradition for seven Bahamian men facing drug charges in the United States. The dismissal of the appeal on July 24, 2007 cleared the way for committal proceedings of the men to proceed without further delay. Trevor Thomas Roberts, Devroy Moss, Sheldon Athelston Moore, Lionel and Linden Deal, Shanto Curry and Gordon Newbold were arrested in 2004 following an extradition request by the United States. The men were suspected of having committed drug trafficking offences. After laying out the arguments presented by Maurice Glinton, the law lords dismissed them quite bluntly. "Their lordships are of the opinion that there is no merit in any of Mr. Glinton?s arguments," the ruling said. "There has already been an inordinate delay in these cases, due to the time that disposing of the...

British Airways senior staff may face extradition to US as part of criminal
2007-08-24 16:40:00
British Airways (BA) senior staff could face extradition to the US as part of an ongoing criminal investigation involving price fixing, it was announced yesterday. The world's third largest airline pleaded guilty to two counts of criminal anti-trust violations of US law for price fixing of both passenger and cargo fuel surcharges in court yesterday, and was handed a fine of £151m for its part in the illegal cartel. The individuals under suspicion, expected to include at least two former BA employees, Martin George, ex-commercial director, and Iain Burns, former head of communications, could face up to 10 years in jail if convicted. BA was already fined £121.5m by the UK's Office of Fair Trading at the start of August, and individuals named as part of this other investigation into the fixing of passenger fuel surcharges could be spared extradition, according to Guardian Unlimited. The practice of fixing surcharges ? a charge added to tickets to pay for the rising cost of...
Is the extradition treaty in the interest of Singapore?
2007-08-08 10:52:00
Singapore needs to have the ET(extradition treaty) for at least five reasons. First, Singapore, as has been reiterated by many of its leaders, wants to project the image that it is a clean international financial hub. This amid the international business community's knowledge that many Indonesian white-collar criminals have taken refuge in Singapore, bringing their assets with them.Second, the ET will enable Singapore to erase its image in Indonesia as a safe heaven for many of Indonesia's corrupt officials and economic criminals. If Singapore ratifies the ET, there would no longer be a basis for such accusations.Third, ratifying the ET would mean that Singapore is a friend to Indonesia. Of course, this would not be the first time. The city-state assisted Indonesia in the aftermath of the tsunami and when the regional economic crisis struck in 1998. Fourth, ratifying the ET is in line with ASEAN solidarity. As members of ASEAN, bilateral ties between Singapore and Indonesia shoul...
