It's Time to Respect the Fame Requirement for Dilution Claims
2011-11-30 05:42:00
This is becoming a pet peeve of mine. Actually, it?s more than a pet peeve. I think it?s a Rule 11 violation: pleading dilution as a cause of action when the mark at issue isn?t even colorably famous. When the Trademark Dilution Revision Act was enacted, on October 6, 2006, Congress set a high standard for the amount of fame a mark must have before its owner can benefit from the super-trademark protection the dilution statute provides. It states: ?a mark is famous if it is widely recognized by the general consuming public of the United States as a designation of source of the goods or services of the mark?s owner.? See 15 U.S.C. § 1125(c)(2)(A). In other words, it needs to be a household name.

What! The White Sox' Minnie Minoso is not in the Baseball Hall of Fame
2011-04-07 21:12:00
( Alex Garcia, Chicago Tribune / April 6, 2011 ) White Sox legend Minnie Minoso at U.S. Cellular Field, the day before Opening Day. That's an outrage. I don't generally follow who's in the Baseball Hall of Fame at Cooperstown, N.Y. The more fascinating reading is who didn't make it. And this morning, thanks to a fine column by Phil Rogers in the Tribune, I discovered that the beloved Chicago White Sox icon Minnie Minoso is not in the Hall. I couldn't believe it. No one should have to explain to Chicagoans or true baseball fans anywhere who Orestes "Minnie" Minoso is. Here is a summary of his career: In his Major League career, Miñoso hit for a .298 batting average, with...
Bulls have 3 in Latest Hall of Fame Class: Rodman, Winter, Gilmore
2011-04-05 02:48:00
Former Chicago Bulls Artis Gilmore, assistant coach Tex Winter and Dennis Rodman are part of the Hall of Fame class of 2011. Rodman did all the dirty work, and was the leading rebounder and defender on of three Bulls NBA championship teams, (96-98).  He played in 199 regular season games with the Bulls and averaged 5.2 ppg, a franchise-best 15.3 rpg and 2.8 apg. He led the NBA in rebounding three straight years, and his single-season rebounding averages of 14.9 rpg in 1996, 16.1 rpg in 1997 and 15.0 in 1998 rate as the three top rebounding averages in franchise history.  He was also known for his "colorful" personality....
Who else belongs on the White Sox Wall of Fame?
2011-03-25 07:11:00
On Thursday, J.J. completed his retrospective analysis of the Mike Cameron for Paul Konerko trade, where he concluded that despite the fact that Cameron's defensive prowess at a premium position (CF) meant he far outstripped Konerko in career WAR, there's no way you could argue that the trade was a failure given Paulie's longevity, his contributions to a championship team, his leadership, and basically everything we love about Konerko. In trading away a talented center fielder, Ron Schueler acquired the last player to wear No. 14 for the White Sox organization. Konerko's mug and number will find itself to left-center field at U.S. Cellular Field, right between Luis Aparicio (or Ozzie Guillen, perhaps) and Ted Lyons. Maybe Cameron would've been on the road to have his number retired. But there's absolutely no reason to pine for an altering of the past in the face of the history Konerko has made with the White Sox despite what the numbers may say. Well said, as always...

It had to be difficult for Gessner to walk down the asile past so many people and up the stairs while he was getting a standing ovation. His exception speah was short and sincere. Do latino moustaches not get as much attention as white people's moustaches? I guess we figured out why Rafael Palmeiro didn't get in. They (latinos) come into this nation with nothing in their pockets...dreams of making it big! 'Son, you can make it to the Hall of Fame if you try just hard enough!' Then...poof! 'I'm sorry, kid...but you're moustache doesn't measure up to the other great moustaches.' Next thing you know they're complimenting you on how you're a 'hard worker' and come from a 'close knit family' and how they admire your 'willingness to work hard for long hours and not complain'.

Blackhawks Should Retire A Number, Re-Open Hall of Fame Discussion for Chic
2010-12-10 04:26:00
In pro sports, momentum is nearly everything. A bad game can hurt a player's confidence. A second bad game can create doubt. And a streak in the wrong direction can sometimes end a career. On the opposite end of the spectrum, a little "mo" can take a player from the doghouse to the penthouse in a heartbeat, and can make heroes out of anyone. Momentum can be an important part of a player's career after it ends, too. Whether it's the player himself or the team he played for, a little good (or bad) will can redefine a player's career. Just look at how post-career events have changed the public opinions of players like Pete Rose and OJ Simpson. With...

Ron Santo's Passing Should Not Change Hall Of Fame Status....
2010-12-03 20:08:00
Chicago lost a hometown legend today.  With the news breaking early this morning that the greatest man ever to man the hot corner at Wrigley Field Ron Santo passed away due to complications from bladder cancer.  Santo passes this morning at the age of 70 and will be remembered not only as a great icon in Chicago sports but a great human being.  No man did more for diabetes research in this city than one Ron Santo and in the few times meeting Santo as a broadcaster/producer in this town, he was indeed as true of a gentleman as he was spoken of by all you will hear from today.  However in passing I have heard throughout this morning that...

Hall of Fame Candidates Don't Measure Up To Santo
2010-11-08 23:14:00
This is another post about Ron Santo getting into the Hall of Fame, but it admittedly takes me awhile to get there. The Baseball Hall of Fame announced today that 12 individuals are up for election to the Hall by the new Expansion Era Committee and any winners will be announced at the baseball winter meetings in Orlando on December 6. The Hall has done away with the "we don't want anybody else in our club and if pressured, we'll just vote in a dead guy like Joe Gordon" panel of all living HOF members doing the Veterans voting. Instead, this year the new panel votes on a group selected from 1973-present. Next year, the panel will look at Golden...

James Toney Played Dana White for Fame and Dinero
2010-08-31 21:02:00
Well, I know that it is over and done with, but James Toney fighting Randy Couture is just so annoying.  I am glad that Couture got an easy pay day and all, but Toney is such a disgrace.  Some are even calling Toney's attempt as a 'hard try.'   Toney is so out of touch when it comes to the MMA game - he air-tapped for god-sake.   Why do we need to even entertain these spectacles.  Doesn't it undermine the sport ?  Shouldn't a PPV showcase the highest level of athlete in the sport? Keep in mind, I am a long time boxing fan.  I love it!  But Toney has never peaked my interest.  He entered the sport...
Paul Gilbert: loves Georgie Fame and his dancing girls!
2010-08-22 15:34:00
Jeb: Unlike Vai, your instrumentals feel like songs and not just alien musicians conquering the electric guitar. Unlike Satch, your instrumentals are not so smooth they feel worked on a long, long period of time. How do you differentiate yourself from the other Shred Masters? Paul: I'm actually not that familiar with most modern ?shred? music. I have enormous respect for both Steve and Joe, as well as Eric Johnson, Yngwie [Malmsteen], Tony MacAlpine, Joe Bonamassa; Is he instrumental? Either way, all those guys play so well. But as a listener, I find myself listening to very different music. For this album, I was listening to Melody Gardot, Justin Currie, old Georgie Fame records. You've got to do a YouTube search for Georgie Fame doing a song called ?Seventh Son.? It's in 7/8 and there are a bunch of dancing girls dancing to it. I've never seen anyone dance in 7/8 before; the whole song is pretty cool. I took the basic groove and played it Charlie Watts-style on my drum kit...
