Virginia partial birth abortion law overturned again by federal court

The 2003 Virginia law to ban so-called "partial birth" abortions have been overturned again by a panel of the federal 4th Circuit Court of Appeals. The U.S. Supreme Court allowed for a similar federal measure to take effect and sent the Virginia law back down for reconsideration but thus far, the reconsideration has yielded the same result.The federal judicial panel's rationale for striking down the Virginia late-term abortion law was because of a slight difference between it and the federal law. Unlike the feds, the Virginia measure allowed for prosecution of doctors who intend to perform standard second-trimester abortions that become the illegal type of abortion. A decision has been issued in the United States District Court for the Eastern District of Louisiana, by Judge Stanwood R. Duval, Jr., dismissing the consolidated class action lawsuit against the United States Army Corps of Engineers for the failure of the Orleans Parish outfall canals and, in particular, the 17th Street Canal that allegedly accounted for approximately 80% of the flooding of downtown New Orleans in the wake of Hurricane Katrina (“In Re: Katrina Canal Breaches Consolidated Litigation, No. 05-4182 E.D. La.).  The only remaining defendants are the Orleans Parish Levee Board and the New Orleans Sewerage and Water Board.
