China IP: Neither Hong Kong Nor Macau Need Apply.
2008-08-12 18:37:00 Interesting post over at China Business Law on registering IP in Macau, got me to thinking of a company who came to me last year for assistance in pursuing trademark infringement litigation in China. As I always do in these situations, I first asked this company was whether it had actually registered its trademark in China. I ask this because many times American companies wrongly believe they have trademark protection in China simply because they have it in the United States. The company VP answered yes. We talked for another 20 minutes or so and then I asked him to send me all relevant documents. It was not until I got the documents that I discovered this company had not registered its trademark in China at all; it had registered it in Hong Kong. Our client had wrongly assumed that filing in Hong Kong constitutes filing in China. Registering your trademark in China does not constitute registering your trademark in either Hong Kong or Macau, and vice-versa. Oh, and whi...

The View From China: As it Continues to Change, China Offers a Growing Numb
2008-05-14 18:30:00 IN THE AIR, ENROUTE FROM HONG KONG TO JAPAN - The fiery orange sunrise I see out my window is mesmerizing. I?m always filled with awe over the dawn of a new day, especially during those long trips when sunrise jolts me awake from the kind of cramped, restless sleep familiar to travelers the world over. On this day, however, I?m wide-awake. It?s the start of the newest leg of my Asian adventure. I?m tucked into seat 11A, and am quickly lost in thought. The View From China: As its Securities Regulations are Modernized, the Red
2008-05-13 16:09:00 HONG KONG - The question came to me as I was standing on the floor of the Hong Kong Stock Exchange here. I?d be willing to wager that quite a few investors - both within China and back in the United States - are wondering about this, as well. Here it is: Will China implement a long-rumored capital-gains tax, and risk (another) major sell-off as a result? Only Beijing?s inner circle knows for sure, and that only stokes investor speculation. The uncertainty can lead to rampant, knee-jerk sell-offs each time the scuttlebutt of an “imminent” tax surfaces. And those rumors have been surfacing…SHARETHIS.addEn-try({ title: "The View From China: As its Securities Regulations are Modernized, the Red Dragon?s Profit Potential Will Soar", url: "http://jutiagroup.com/2008/05/-13/the-view-from-china-as-its-s-ecurities-regulations-are-moder-nized-the-red-dragon%e2%80%99s--profit-potential-will-soar/" });

Google Maps in Hong Kong
2008-05-09 10:55:00 Today is a rather big day for Hong Kong users since Google has updated their Google Maps database in Hong Kong and Google Finance now supports Hong Kong stock listings. Google Maps will now show building names and MTR exits in Hong Kong. However, searching building names will only return user-created content (if any). Although there is still no official word from Google yet, the copyright notice at the bottom right suggests that Google has partnered with MapKing, a famous local mapping company. Hopefully, business listing will soon be available in Hong Kong.

Disk Encryption Not Used To Secure Hong Kong Hospital Data
2008-05-06 07:33:00 Theft of memory sticks?the USB kind, I guess?account for the data breach of more than 6000 patients in Hong Kong public hospitals. In the past year, nine memory sticks have been stolen from five hospitals. A task force is being set up to investigate the security issue, and will recommend solutions in three months to avoid recurrences. According to the Hospital Authority chief executive Shane Solomon, the small data storage devices were stolen not because of the data they contained, but because of the intrinsic value of the devices. This assessment comes from the fact that the patient data has not shown up anywhere to date. Of course, some would point out that this is a fallacy in reasoning, since there is no need for that information to show up. After all, patient information doesn?t have an expiration date. Whether the patient information shows up one year after the breach of five years afterwards (or much later) depends on the criminals? ...
