IP wunderkind Danny Friedmann at IP Dragon does a very nice job laying out the primary differences between Hong Kong law and Mainland China law in his post, "How do the People’s Republic of China and Hong Kong relate to each other regarding IPRs." The super-quick summary is as follows: 1. Different as night and day. 2. Registering your intellectual property (IP) in Hong Kong will not protect you in Mainland China and vice-versa. A couple years ago I had an hour long conversation with a company regarding my firm assisting it in pursuing a trademark infringement lawsuit in China. It was not until I saw their actual trademark registrations that I discovered that when they were referring to "China," they really meant Hong Kong. This company had never registered its trademark in China and I had wasted an hour thinking it had a great case, when in fact it had no case at all. I have since learned to seek clarification as to what is meant by "China."

Interesting post over at China Business Law on registering IP in Macau, got me to thinking of a company who came to me last year for assistance in pursuing trademark infringement litigation in China. As I always do in these situations, I first asked this company was whether it had actually registered its trademark in China. I ask this because many times American companies wrongly believe they have trademark protection in China simply because they have it in the United States. The company VP answered yes. We talked for another 20 minutes or so and then I asked him to send me all relevant documents. It was not until I got the documents that I discovered this company had not registered its trademark in China at all; it had registered it in Hong Kong. Our client had wrongly assumed that filing in Hong Kong constitutes filing in China. Registering your trademark in China does not constitute registering your trademark in either Hong Kong or Macau, and vice-versa. Oh, and whi...

Hutchison, parent company of wireless service provider 3, announced today that they two have signed a deal with Apple for the iPhone. The announcement adds Hong Kong and Macau to the list of 3G iPhone launch regions. Incidentally, this is the first Chinese-controlled territory to get an iPhone launch rumor since Apple ended talks with China Mobile back in November of last year.
