Immunity? That's A Problem
2008-04-25 18:02:00
In response to Andrew Cochran's latest post "No FISA? No Problem," the reason why no one has come up with a concrete example of an intelligence investigation suffering due to Congress' unwillingness to enact FISA reform is simple: this information - who the U.S. is currently targeting its FISA methods on - is classified, and therefore not subject to public discussion. The bill is hung up for one reason: disagreements over whether it should include retroactive immunity for telecoms. If telecoms that...(read more)

Wii Immunity

Okay, I lied a little, bitty bit. I'm not entirely immune to Wii. Actually I'm not entirely immune to Guitar Hero on Wii.No,no,no. I don't play it. It does however grate on my subconscious. For instance, I was watching American Idol with the kids the other day. Suddenly, a song comes on that I recognize:"Hey," I say. "That's that Guitar Hero song."Yep, that was the first thing that came to mind. Not that it's Heart. Not that whoa Nelly, those Heart chicks look way different. Not that that's Fergie with 'em.Nope, Guitar Hero.Okay, my second thought was whoa that Fergie is very bend-y and acrobatic. I knew for once CG would be willing to watch a segment of American Idol. Usually he abhors it.Yep, I was right. He was really into her bend-y moves. No big surprise there, eh? Bush Wants Immunity for Drug Companies

The Bush Administration is at it again. This time working to protect drug companies. House Passes FISA Bill with No Immunity for Telecom Companies
2008-03-15 02:23:00
Today the House of the Representatives passed a Democratic bill that would set the rules for the surveillance of the emails and phone calls of people within the United States. The bill was passed among mostly partisan lines, 213-197. President Bush is certain to veto the bill because it does not provide the telecommunications companies with immunity against lawsuits stemming from their cooperation with the Bush administration?s secret domestic spying program which began after the September 11 terrorist attacks.

Telecom Immunity: Vote Backfired For Republicans!

Let’s have a party…. 213-197-1… Looks like the Republican’s “secret session” strategy backfired, and they lost some Bush Dogs in the process. Eleven Democrats voted “nay,” and that may include some protest votes from progressives. Leonard Boswell, one of the 21 Bush Dogs who signed the original letter to Pelosi expressing support for telecom immunity actually spoke on the floor in favor of passing this bill without it, and voted the right way. Props to his primary challenger Ed Fallon and his helpful FISSA statement, and whatever part it played in Boswell’s inspirational “come to Jesus” moment. Wanda Jackson-Let’s Have A Party

Telecom Retroactive Immunity - UnConstitutional?
2008-03-08 21:37:00
So, I'm sitting at home, reading over the Constitution (don't laugh, some people like to golf, this is my hobby), and I came across a VERY interesting section and came to a startling conclusion No Bill of Attainder or ex post facto Law shall be passed. What that means is, is that Congress cannot pass a law to be retroactive in dealing with past illegal activities. And of course, with the above sentence, you immediately begin to think of the telecommunications retroactive immunity deal that President Bush and some members of Congress are trying to push through. It is the job of Congress to know their responsibilities when it comes to the Constitution, and if they fail in that, then they are knowingly passing a law that is against the Constitution. People don't seem to understand that the telecommunications companies that spied on ordinary Americans have committed VERY serious crimes and that's why they are being sued for billions of dollars. If members of Congress pass this legis...

Bush renews demands for telecom immunity as Democrats seek compromise on sp
2008-03-03 06:05:00
US President George Bush used a Thursday White House press conference to issue a belligerent demand that Congress pass a bill effectively gutting Constitutional protections against government spying while granting immunity to telecommunications companies that helped the administration break the law.The bullying tone of the president, who repeatedly banged the podium while warning of supposed imminent dangers posed by the Congressional delay in renewing the administration?s unfettered power to conduct domestic wiretapping, stood in sharp contradiction with the overwhelming popular hostility towards Bush, whose standing in the polls has fallen to record lows. Despite his deepening political isolation, the Republican president is justifiably confident that the Democratic majority in Congress will ultimately bow to his demands.Democrats in Congress are largely agreed on measures to permanently expand government spying and give the executive branch unfettered access to telecommunication ...

The Truth About FISA & Telecom Immunity
2008-02-26 09:00:00
With the state of today’s media, I think it’s important to circulate the few bits of cold, hard truth that are available. One such example of a straightforward presentation of the facts was the explanation of the FISA controversy given by Air America radio show host Randi Rhodes on Valentine’s Day. (I have a subscription to Air America Premium, which allows me to listen to their broadcasts commercial free on my IPod, which is something I highly recommend for anyone who is looking for a source of news that doesn’t involve staring at a computer screen.) The following is a portion of Randi Rhodes’ February 14th show which will explain the entire FISA/telecom immunity situation in a way that will make perfect sense to anyone that is currently confused. To put the following in context, this show was broadcast the day before the Protect America Act revision to FISA expired. On the morning in question, Randi started her show by playing a clip of our President greeting the country ...
Bush Again Demands Telecom Immunity
2008-02-25 10:47:00
President George W. Bush again called for retroactive legal immunity from class action lawsuits initiated against telecommunication companies that participated in the government's wiretapping program without court-ordered warrants. It follows many other recent statements by the Bush Administration and its supporters in Congress who are trying to push through a legislative measure that removes a citizen's right to sue, as part of the law overseeing the government's surveillance of citizens and foreigners.Critics have called Mr. Bush's tone and choice of words "fear-mongering," if not merely wrong, when he characterizes the importance of retroactive immunity for past lawbreaking in being able to protect America from future terrorist threats. The immunity provision currently being fought over (and which will be back in the spotlight when House members return this week) is part of the update to the Foreign Intelligence Surveillance Act (or FISA), a law first enacted in 1978 which se...

FISA Fight: Senate passes telecom immunity and flips the bird to America
2008-02-12 19:59:00
Earlier today, Sam asked a very important question: When it comes to convincing the public that it’s somehow justifiable to give a pass to corporations that illegally spied on Americans without a warrant, how stupid do you think we are? Well, the answer is that the so-called “Democratic” Congress doesn’t give a damn what we think, as they’ve voted down virtually all amendments to the FISA reauthorization bill that would have granted oversight and accountability–including- blocking immunity for telecoms. As Glenn Greenwald eloquently notes, this day we’ve seen a so-called “bipartisan” Congress justify lawbreaking and illegality on a level that even the previous Republican majority couldn’t pull off. As Glenn notes: A total of 18 Democrats joined all Republicans in voting for immunity: Bayh, Inouye, Johnson, Landrieu, McCaskill, Ben Nelson, Bill Nelson, Stabenow, Feinstein, Kohl, Pryor, Rockefeller, Salazar, Carper, Mikulski,...
Telecom immunity: how stupid do you think we are?
2008-02-12 17:12:00
It’s FISA Day in your Senate - amazing how this was scheduled for Potomac Primary Day, huh? - and Matt Browner Hamlin has the agenda up at Holdfast. My big issue is item #4: retroactive immunity for telecoms. Verizon and AT&T have done all they can to pretend that they had no idea that their participation in warrantless wiretapping might be, you know, a full-monty assault on the Constitution itself. I mean, shucks, they wuz just doing what the president wanted them to, and if you can’t trust the White House who can you trust? Here’s what Sen. Russ Feingold had to say on the matter: Let’s pay close attention to this part: The telephone companies and the government have been operating under this simple framework for 30 years. The companies have experienced, highly trained, and highly compensated lawyers who know this law inside and out.In view of this history, it is inconceivable that any telephone companies that allegedly cooperated with the administration...
FISA & Telecom Immunity
2008-02-12 17:01:00
Yesterday’s Senate vote on proposed reforms to the Foreign Intelligence Surveillance Act (FISA) closed a major chapter in the NSA wiretapping scandal, striking down an amendment that would have denied telecom companies immunity for assisting with surveillance. While many decry the lack of accountability for violations of the law and attribute the outcome to the telecom industry’s lobby, others argue that protecting those who play a vital role in combating terrorism is fair.

Cheney backs immunity for phone company crimes
2008-01-25 22:15:00
Dick Cheney claims that making permanent a key intelligence-gathering law before it expires is vital to preserve national security. "We can always revisit a law that's on the books. That's part of the job of the elected branches of government," Cheney said. "But there is no sound reason to pass critical legislation ... and slap an expiration date on it." WASHINGTON - -- U.S. Vice President Dick Cheney said Wednesday making permanent a key intelligence-gathering law before it expires is vital to preserve national security. Congress last year passed the Protect America Act, which updated the 30-year-old Foreign Intelligence Surveillance Act. President George Bush signed the measure, set to expire Feb. 1, ensuring "we could quickly close the intelligence gap," Cheney said in remarks to the Heritage Foundation, a Washington conservative think tank. "(As) a result, the intelligence community has been able to do a much better job safegu...
AT&T, Verizon May Be Granted Immunity For Illegal Wiretapping
2008-01-25 00:20:00
Right now, big telecom companies including AT&T have a chance of walking away with retroactive immunity after participating in the Bush administration's wiretapping program that was later ruled unconstitutional. A bill that is currently under consideration in the Senate revises the Foreign Intelligence Surveillance Act and would grant full retroactive immunity to the telecom giants for their participation in the illegal program that was utilized to spy on American civilians.
Just Say "No" to Immunity
2008-01-23 04:32:00
by Jayne Lyn Stahl What better time than today to honor the life of Martin Luther King than by remembering something he once said: "Never forget that everything Hitler did in Germany was legal." Yes, and think about this: everything President George W. Bush is doing today will someday be legal if members of Congress don't act, and act quickly, to ensure that doesn't happen. Dr. King's words words especially resonate in light of the fact that the Senate will take up the contentious issue of how to reform the Foreign Intelligence Surveillance Act when they reconvene this week. When an insidious measure which allows for warrantless eavesdropping on citizens' phonecalls and emails, legislation ironically called the Protect America Act was scheduled to sunset, this fall, the Senate Intelligence Committee passed a measure which would require court review whenever an American citizen is targeted for surveillance anywhere in the world. The amended measure passed the Se...
