The federal Trade Commission (FTC) estimates that over $100,000,000 is being scammed by fraudulent Invention Marketing and Invention Patent Companies on consumers annually. That’s $100,000,000 of your money. The main reason there is such a problem is due to the fact that the general public is not aware of the problem until it is ...

Intellectual property is not a thing
2008-04-16 15:00:00 Speaking in workshops and seminars I've often posed a puzzle to wake up the audience. I've asked: What is the most powerful thing in the cave of a cave man when he skins a freshly killed beast using a stone tool? Most guess that the most powerful thing must be the stone tool. Few point to the one thing that helps the cave man know where to hunt, what to hunt, how to skin and how to fashion tools to help in all aspects of survival. That most powerful thing is the cave man's brain.
Consultant or contractor intellectual property

Intellectual Property and eBay
2008-04-12 17:02:00 Intellectual property rights and possible infringements are a major concern in many areas of the Internet today. eBay is by no means an exception. eBay has set forth a clear and straightforward policy on the rules it follows with regard to the protection of Intellectual Property Rights and its commitment to protecting the rights that belong to third parties. The introduction of this eBay policy clearly states that infringement is the unauthorized use of other people's intellectual property - like copyrighted material and trademarks.Rules that affect what a seller is allowed to sell on eBay include the restriction or prohibition of certain items simply because they have the potential to infringe on the intellectual property rights of others. These restricted items include: replicas, counterfeit items, and unauthorized copies; Celebrity material including faces, names and signatures, and autographs.Media restrictions include movie prints in both 35mm and 70 mm formats, bootleg record...

Six good questions for building wealth with intellectual property
2008-03-08 01:22:00 Venture capital looks for great intellectual property (IP). So do many providers of seed capital, including angel investors like friends and family. A single IP asset or right is rarely a silver bullet, be it a patent, a trade mark, a specific trade secret or some other IP. Your IP will be more attractive to financial backers if you work on constantly perfecting a bundle of IP legal rights instead of daydreaming about a one shot silver bullet.

Intellectual Property Donors will their copyright to expire when they do

But have you ever thought of what will happen to the work you have created once you've permanently expired? The folks over at ni9e.com have, and the result is their Intellectual Property Donor sticker: Once you pass on, your intellectual property is actually removed from the public sphere for 50 years (in Canada; in the US it's 70 years) making it impossible for anyone to legally build upon or integrate your work into their own. To make sure your ideas outlive your body, download and print your own IP Donor sticker (includes handy instructional video).

Doing Business in India - Intellectual Property Rights - Part 4
2008-02-13 05:23:00 Here is the last (4th) part of a 4 part article written by Sumeet Kachwaha of Kachwaha & Partners giving legal perspective of things if you plan on doing business in India. This aims to be an easy to read, yet comprehensive overview of legal issues involved in doing business in India. INTELLECTUAL PROPERTY RIGHTS Indian courts vigorously protect intellectual property rights (IPRs). Following the GATT Agreement India has made its IPR laws TRIPS compliant. In this Chapter, we deal with the three major IPR laws viz. Trademarks, Copyrights and Patents. TRADEMARKS: Registration of a trademark is not mandatory as the law also recognizes and enforces the Common Law right of passing off. However for passing off, the plaintiff has to establish its reputation in relation to the mark and the fact that the offending mark is likely to confuse the public. On the other hand once the mark is registered it automatically confers on the proprietor an exclusive right to use the same in relation...

Straight talk on intellectual property litigation
2007-11-07 21:05:00 American business and IP lawyers tend to be straight talkers. They use simpler language and more direct styles of expression than their cousins in Australia. What about cousins in London? Long ago, a barrister friend of mine said to me: The bar in Sydney is more conservative than the bar in London, more English than the English. He was speaking about the social politics and modes of expression used in courts in Sydney and London. My friend has practised extensively in both cities. Admiring straight talk as I do, it was a delight this week to see street protesting lawyers in Lahore (could be a good title for another song by The Clash (http://au.youtube.com/watch?v=-IXfaxEaPOjw)). They used very plain verbal and body language (see photo) against this week's Proclamation of Emergency, the suspension of the Constitution and the imposition of emergency restrictions.

Intellectual Property And Estate Taxes Posted By : Kris Koonar
2007-09-05 16:42:00 A person's intellectual property, especially copyrights, make a lot of difference while estimating the estate taxes. It is necessary to know the value of all the assets including the intellectual property to be able to find out the value of the estate. Setting financial goals helps direct financial planning. Examples of financial goals are: "To retire at age 50 with a personal net worth of $800,000 American," or "To buy a house in 3 years paying a monthly mortgage servicing cost that is no more than 25% of my gross income". It is not uncommon to have several goals, some short term, and some long term. Read more about finance.
Licensing Intellectual Property / Inventions
2007-08-20 05:42:00 Everyone gets a great idea from time to time. More often than not we just say "hey wouldn't that be great" and go on with our day. Why don't more people follow through with the great ideas they have? It could be that they think it will be more trouble than its worth, that they don't have the resources to do it, or quite simply that they don't know where to start. The reality is that every great idea has the potential to become a valuable asset. In fact protecting and developing your ideas can be a very inexpensive process that requires little to no technical knowledge. Most people think that to bring their ideas to life they need to spend thousands of dollars on a patent and build complex working prototypes. This is simply not the case. The first step to developing and profiting from your ideas is to study the existing marketplace. Go to the local store that sells products similar to the one you have in mind. If it cannot be bought in a store check online. Pay close att...
