Singapore Developers turn landlords as property market stays quiet
2008-06-04 05:31:00 Singapore Developers turn landlords as property market stays quiet With projects held back, firms lease out units bought in collective sales By Joyce Teo, Property Correspondent STAYING ON: The consortium that bought Lincoln Lodge has allowed occupants to keep renting homes for six months from the sale completion date of July 8. — PHOTO: NEWMAN & GOH  PROPERTY developers such as Koh Brothers and GuocoLand, which bought collective sale sites during boom times, are now becoming landlords as they wait out the market slowdown. They are leasing out apartments they bought to existing occupants as a way to generate some income instead of simply leaving them vacant. If the property upswing had continued, these developers might well have moved quickly to tear down the older homes to put up new developments. But the sharp slowdown in home sales has put paid to such thoughts for now. Market observers say renting is a nimble move given present market conditions. For sellers of u...
Landlords Beware!
2008-05-30 15:18:00 There's a new scam out there. If you're a landlord like me who advertises on Craigslist and VFlyer you should watch for this story: the so-called tenant will usually approach you by email saying they are from the UK or some other foreign country. They inquire about the property and the rent. (This should be the first red flag since both the property address and rent is clearly displayed in the rental advertisement.)The rest of the story goes something like this: "Someone in the US owes me money, so they will pay you usually an amount much higher than the deposit and rent. You then have to deduct your amount and pay me the rest, so I can actually fly into the United States." Sound familiar? It should. Here's what will probably happen: The check the person who owes them money will send you might look good, but will bounce. You will be required to wire money to the so-called tenant. Why does this work? Because banks are required to make deposited funds available to you within 48 - 72...
Landlords Don't Let Your Tenants Grow Up to be Holdovers
2008-05-20 05:23:00 This relevant and important law article has been contributed as a public service by W. Adam Mandelbaum, Esquire. Mr. Mandelbaum practices law on Long Island and has his Attorney- at- Law office at 10 Audrey Avenue, Oyster Bay, New York 11771. He can be contacted at (516) 624-0240. On May 12, 2008, in W-3 Mgt. Corp. v. Beltran, the Nassau County District Court arrived at an interesting decision: Tenant hold over, landlord tries to get full month's use and occupancy when tenant only stays a few days over into the month. Tough landlord, because with respect to rent, a holdover tenant is responsible for the entire month's rent which is due while he holds over only part of the month, but with respect to use and occupancy the court has discretion to award such for only the period of the holdover. In other words, if he is supposed to be out by May 31, but stays till June 4, the judge doesn't have to award the whole month of June for use and occup...

Insider Q&A hears of tough times for landlords

He also owns residential and commercial rental properties throughout California. He is past president of the Apartment Association of Orange County and serves as a Superior Court judge pro tem. Duringer: The rental housing industry has experienced strong and sustained growth over the past 20 years. Even with the current revaluation cycle, multifamily properties have maintained their values. Throughout the state we’ve seen troubling increases in governmental oversight of housing, expansion of rent control jurisdictions and eviction controls. These cities quickly become stagnant, e...

Energy Performance Certificates for Landlords
2008-04-30 10:52:00 Energy Performance Certificates (EPCs) are a key part of the Home Information Packs I wrote about in November. As of 1st October this year (2008), EPCs will additionally be required by landlords starting new tenancies. Now, with all these things, it’s always possible that the legislation (or, rather the “guidance”) will change before October, but as things ...

Why don't landlords pursue deadbeat tenants?
2008-04-06 15:29:00 Relatively new landlord so I apologize if I sound naive..We had our first set of tenants abandon the SFH they were renting at the 7th month mark of a 1 year contract. Left a pile of trash behind, including leases from two other homes.I've contact these previous landlords to find a similar pattern; intially excellent renters with rent paid on time, only to begin with excuses on why rent was going to be a few days late (although still paid) and finally, moving out suddenly with no notice.Neither former landlord chose to attempt to find these folks to take legal action against them. When asked why, the comments ranged from "I thought they moved to another state", "I was glad to get rid of them", "I was too busy repairing the damage they did", "You can't get blood out of a turnip".Application checks showed a consistent employment history (pay stubs of both tenants confirmed what was claimed on the application), checking with 2 previous landlords showed they were "excellent tenants" ...

2008-03-31 02:38:00 I am buying my first residential fourplex and would like to start getting educated as a landlord to know more about the landlord-tenant laws and to learn from those who are experienced how to deal with practical problems. There are many different sources on the Internet and otherwise. What sources do you believe are the best? The fourplex I am buying is in California. Thank you.
Who Says Landlords Never Give Back?
2008-03-26 07:35:00 An Edmonton landlord struggles to keep the school near his complex open and is willing to pay to make that happen."Reg Appleyard, Meadowcroft Housing Society of Edmonton's executive director, told public school trustees that he will guarantee 110 students are enrolled in Woodcroft Elementary School by Sept. 15, and the society will pay nearly $5,000 for every student short of the goal, up to $98,224 or a shortfall of 19 kids." Photo courtesy of Edmonton Journal.Relying on 30 years of accumulated reserve funds, Reg sees this as the biggest crisis the complex has had to face, and is willing to pay to keep the school and his units tenanted."We bought this complex 30 years ago, and we've always set aside funds each year for crises or emergencies," he said. "We feel that this is probably the biggest crisis we've faced in 30 years, and so we are prepared to use some of our reserve funds to try to solve the Woodcroft Elementary School problem." Question again for NY City landlords
2008-03-23 03:24:00 When renting a dwelling to an individual in NY city, can tenant later move extra people in when landlord says no. Is there some kind of law that prohibits landlord from taking action against this, or a law that allows tenants to move others in without landlords permission (even if it's stated in the lease, no extra person)? Again, this is what the moderator is saying @ Tenant.Net. Sorry about all these seamingly silly questions, I am just curious if this "expert tenant/moderator" is as stupid as he sounds.
Question for NY City landlords

Record Returns For Some UK Landlords
2008-03-07 01:00:00 The North West, Scotland and Wales have registered record returns for landlords, particularly in the fourth quarter of 2007. The latest quarterly report carried out by the Association of Residential Letting Agents (ARLA) is an interesting review as it is one of the few surveys carried out well after the credit crunch began to bite. ARLA?s report focuses on returns from properties across the UK. In the last quarter of 2007, the two areas which performed regularly above average were the North West of England, Scotland and Wales. The average rate of return on cash purchase buy-to-let investments over 5 years is 10.81% per annum across the country. However, in the North West the figure rises to 11.03% and in Scotland to 11.07%, the two highest in the UK. Scotland and the North West also featured on top for gross annual rental yields. The nation?s average stands at 4.81% whilst in Scotland we see this figure rise to 5.23% and 5.29% in the North West. The survey also reflected that ...
Landlords: What to do When Your Rental Property is Used as a Meth Lab
2008-03-06 23:13:00 In the winter of 2003, I was out driving by properties that I was managing in Minnesota, checking to make sure the tenants were maintaining the exteriors. One of the properties was a four-plex building and the day I drove by was the trash pick up day. Ordinarily, there is nothing noteworthy about trash bags and trash bins at the end of the driveway on pick up days. That day, I noticed there were dozens and dozens of boxes scattered about the end of the driveway. I decided to get out and gather the boxes and pile them together so the trash collectors would take them. I was a little surprised to find that just about all of them were empty and all of them were the same size. I flipped one around to read the text on one of the boxes and that is when I began to panic. I thought I was facing what no landlord ever wants to encounter . . . A tenant manufacturing drugs in the house. All of the boxes were marked to have contained 24 pint size bottles of Isopropyl Alcohol. Someone had tol...
Birmingham School District Landlords, Didja Know…
2008-02-29 05:34:00 The real estate market has turned many a hopeful seller into a reluctant landlord (or SellLord, as I have dubbed them). Yesterday I got wind of something I have never heard of before, though I can understand the motivation. A new tenant went to enroll her children in the Birmingham public schools. The admission process is lengthy she tells me, and one of the things she was instructed to do was make sure that the landlord had rescinded the homestead exemption on the home. Well, in Birmingham and in most surrounding areas, there is a significant differences in the amount of taxes due on a non-homesteaded property. The school official told her that those funds are used for school funding, hence the district’s interest in ensuring that the exemptions are correctly rescinded. Perhaps Birmingham has been doing this a long time. I don’t know. I also heard a rumor that either the school board or the district was researching all of the currently enrolled students living in...

Great Tool For Landlords
2008-01-25 09:28:00 A rental property has to have a lot of things going for it to ensure it puts money in your pocket. Nice location, above average amenities, sturdy construction, neutral yet stylish design and the list goes on. However, none of this will mean much if your property is overpriced. The "put the For Rent sign out" and they will come mentality doesn't work in every market. If the market is tight and your vacancy rate is low you can rent for a little more but if the vacancy rate is increasing then your rent not only has to be in line with the market but also cover your expenses and reflect the quality unit that it is. So...?Someone brilliant has invented Rent-o-meter.com you simply fill in the fields for address, province or state, postal code, current rent, number of bedrooms and units in the building. Press the Analyze My Property and you get a clear spectrum of the average, high and low rents in your particular area. The site not only shows you where you unit is on the "Rent-o-meter" b...
NJ residential landlords...take notice
2008-01-14 05:51:00 New law includes single and two family rental units Landlords of single family and multiple family residential homes should take notice. On January 4, 2008, New Jersey Governor ,Corzine, signed into law legislation that expands the scope of lead paint inspection requirements for multiple dwelling units to also include single-family and two-family rental dwelling units here in Somerset and all of New Jersey. This new law is effective immediately. The law mandates the New Jersey Department of Community Affairs to inspect houses for lead based paint hazards at least once every five years. In addition, the new law requires every owner of a tenant-occupied single or two-family residential property to register with the Department of Community Affairs. Property owners who fail to comply with these registration requirements will be subject to a $200 penalty for each delinquent registration. The law does not apply to properties that have been cert...
Do the Landlords acceptance of rent monies before and after Notice to Quit
2008-01-14 01:45:00 I lived with my girlfriend in a public housing NYCHA for over a period of ten 10 years.. She died last year and never put my name on the LEASE dispite my numerous request for her to do so. I have witnesess to that effect! I received a Notice to Quit and Notice of Termination of Tenancy on December 2007. I paid the rent under my girlfriends name for November 2007 December 2007 and for January 2008. But NYCHA claims that my girlfriends lease has expired due to her death. Anyway I was served with Notice of Petition on Holdover Proceedings and a hearing is escheduled for February 11 2008. Is NYCHA correct about her lease being terminated. NYCHA continues to send documents and even a request for renewal of lease on my girlfriends name. Also I went through administrative hearings and my request for sucession of rights and to be granted a lease with NYCHA as a Remaning Family Member was denied on November 2007. Therefore according to law I have 120 days to request the courts review of s...

Any laws to protect landlords from deadbeat tenant
2007-12-07 22:54:00 This problem is only going to get worse. Tenant advocacy groups who give "free" advice to deadbeat tenants should be more discriminating. Securing Your Property With A Landlords Insurance.
2007-11-23 19:55:00 Renting out a property has proven to be one of the most profitable investments in the last decade. The risks associated with poorly behaved or unconcerned tenants make rental properties an investment that is fraught with risk and this is complicated by the lack of risk cover available on the market. Landlords insurance that does the job and protects investors from the risks posed by propery investment and is essential to maintain profitability. Even with a damages deposit, when a tenant vacates a property the landlord may still be left with a large bill to put the property back into letting condition for any future tenant. Many tenants carry no insurance of their own, safe in the knowledge that the landlord must by law cover risks associated with ma...
Landlords - time to send out rent bills!
2007-11-21 17:49:00 It's time. You should be sending a bill to your rentals today to ensure prompt payment of your rent. The statement should include the following:- when rent is due- when rent is late- what the fine is for the rent being late- what form to make the payment in- where to send it.It doesn't hurt to have a return envelope with the statement with your address on it. Log that you have sent out this statement in your rental logs.I know, I know. You're saying most of these things are in the month-to-month or lease agreement you have signed with the tenants. But most of them have not been read, so remind them. Today. And have a good December!

Voluntary rent caps could turn the situation in favour of Landlords
2007-10-19 12:00:00 Analysts are of the opinion that imposing a 'voluntary' rent cap, could turn the current situation in favour of Landlords, leading to a rampant increase in rent rates. This statement came, following a leading government official's statement that Dubai's rent cap may become voluntary, permitting landlords to adjust rents on par with current market rates. The CEO of RERA (Real Estate Regulatory Authority), Marwan bin Ghalita, said that the cap on price increases for renewed rents, when being renewed during the following year, should be done at a lower level than the current seven percent. However, he emphasized that in case the commercial or residential property Landlords are of the opinion that the cap is responsible for keeping rents below the market prices, they can argue for an adjustment, based on benchmark rate, recommended by RERA.According to Bin Ghalita, this system could be successful in reducing situations where the Landlords tend to evict tenants under silly pretexts for ...

A question for Colo. landlords
2007-10-19 02:29:00 My sister was renting an apartment in Colorado. She was offered a job on the east coast and broke a lease that expires April 2008. According to Colorado law, "A landlord shall, within one month after the termination of a lease or surrender and acceptance of the premises, whichever occurs last, return to the tenant the full security deposit deposited with the landlord by the tenant, unless the lease agreement specifies a longer period of time, but not to exceed sixty days." Does this mean that her Colorado landlord can hold the security deposit until May 2008??
