Get a lawyer for the day.
2008-10-01 20:02:00 One of the difficulties of working for a law firm is the up-and-down nature of the practice. Some days just cruise on by, easily and on schedule with no surprises. Other days, the mail brings what seems like 157,000 different things that need to be handled, combined with notices of court hearings that can't be moved and client calls that are urgent. It's difficult to manage a schedule like that; lawyers learn to be flexible and work ahead whenever possible. That flexibility can now apply to staffing a law firm, too. The Law Offices of Ilene H. Cohen, home of the temporary attorney New York, can give law firms lawyers on a temp basis -- lawyers that are able to handle motions, depositions, EBTs, hearing, and other matters in some (not all) state and federal courts. The Cohen temp lawyers are admitted in New York's Eastern and Southern District federal courts, New Jersey's federal court, New York state courts, and a variety of federal appellate courts ranging from the Court of Fe...

So You Want To Be An International (China) Lawyer? Part III
2008-09-30 15:36:00 I am frequently emailed by college students, law students and even practitioners, seeking advice on what it takes to become an international lawyer. It seems the lawyer behind the Counterfeit Chic blog (an excellent blog, BTW) gets even more of these regarding "fashion law" and she gives answers in her post, entitled, "Fashion Law." How can I get into fashion law?" Several times each week -- more during interview season -- a Counterfeit Chic reader asks me this question. I've heard from aspiring law students, current law students, recent graduates, law firm associates disillusioned with their current jobs, law partners interested in a new group of clients, and former lawyers who've spent quite enough time at home changing diapers, thank you very much. I've received messages from parents seeking advice for their children, colleagues seeking advice for their students, and innamorati seeking advice for the objects of their affection. Your emails have come from every continen...

2008-09-24 04:51:00 This is new and extraordinary news, considering that both sides expected a ruling this year. Well, someone's going to have to finance Steve Donziger for another three years! By Mercedes Alvaro - Dow Jones Newswires, September 16, 2008: 5:47 PM QUITO - (Dow Jones)- A five-year-old environmental-damage trial in Ecuador against U.S. oil company Chevron Corp. (CVX) could take at least two or three more years, lawyers said Tuesday. The delay is expected after objections to an April report from a court- appointed expert were received by a court in Lago Agrio. The report prepared by Richard Cabrera, a geologist and environmental consultant, recommended that Chevron pay at least $8.3 billion, and maybe as much as $16 billion, in compensation for environmental damage in Ecuador. Chevron is facing the lawsuit in Ecuador for alleged contamination by its Texaco unit in the Amazon region of Lago Agrio. Tabu will be seen playing a lawyer and fights the court case opposite Govin
2008-09-11 09:21:00 In Ravi Chopra ?s Banda Ye Bindaas Hai , Tabu will be playing a naughty lawyer. The acclaimed actress has never played a completely over the top sensuous character before and is excited to play the part in this Hollywood comedy, My Cousin Vinny?s Bollywood remake.Reports are that Chopra managed to convince Tabu in playing a sexy character for the film. When she was first offered the part by him she had declined it.But after a lot of deliberation, Chopra managed to get The Namesake starlet going in for the role. The role requires Tabu to expose her body. But since the film is a comedy she won?t be presented in a vulgar manner. The same part was earlier offered to Bollywood hotties, Bipasha Basu , Mallika Sherawat and even Sushmita Sen . But they had refused the role calling it too insubstantial. But Tabu has taken up the role as a challenge of attempting something, which she has never done before in Bollywood.Tabu will be seen playing a lawyer and fights the court case opposite Govinda...
Danone-Wahaha And Why You Need A Real Lawyer For China.
2008-08-07 18:24:00 Brad Luo over at the China Business Law Blog just posted on a recent Chinese court decision in the never-ending conflict between Wahaha and Danone. The post is entitled “Wahaha” Ain’t French, and It Belongs to China," and it once again shows why I earlier remarked on how "we love that dispute because within it lies just about every China business or business law issue one might confront." This new ruling touches on two important legal issues, one very particularized and one very general. Let's start with the particulars. The recent court decision is the Hangzhou Intermediate People’s Court's ruling upholding the Hangzhou Arbitration Commission's December, 2007, ruling that the “Wahaha” trademark belongs to the China based Wahaha Company, not to the joint venture between Danone and Wahaha, of which Danone is the majority shareholder. Both this ruling and that of the Arbitration panel are believed to have been based on Danone's failure to secure Chinese government...

Thinking The... The Archies' Lawyer Should Have A Word With Those Def Leppa
2008-07-30 17:32:00 Want to know a fun way to irritate people who like music? Refer to every single music group or singer as "The... [insert name][s]." Like when you're talking to your kids, make sure you say things like "I like that group, 'The Fall Out Boys'." It works with parents, too: "You know who was good? The Elvis Presleys."I'm thinking about that because I noticed this weekend, while listening to my iPod during grocery shopping that The Def Leppards may have borrowed a bit from The The Archies:"Pour your sugar on me, baby!" Sing it, The The Archies. Now, here's your slightly-harder rocking version:If you're wondering what kind of music collection includes both The The Archies and The Def Leppards, it's the kind of music collection I have, one that also includes the complete CD of Baby Einstein music.Thinking The... is a short entry to kill time between larger entries. UK: A Top Lawyer Calls For Elements Of Islamic Law Be Introduced
2008-07-07 19:21:00 Europe is headed for destruction...Another top British barrister has called for elements of Islamic Sharia law to be introduced into the UK.Former chairman of Britain's Bar Council Stephen Hockman QC said last week that "It is vital and inevitable that sharia will become part of British law in some shape or form."Given the world situation and our own substantial Muslim population it is vital that we now look at ways to integrate Muslim culture into our own traditions... Otherwise we will find that there is a significant section of our society which is increasingly alienated, with very dangerous results."His comments follow similar remarks from Lord Phillips of Worth Matravers (England and Wales most senior judge) who said that Sharia could play a role in family and financial matters for Muslims. Lord Philips had discussed how elements of Sharia had been misrepresented and misunderstood by the press and public: "Severe physical punishments" he said, were unacceptable, but the Islami...

House Investigation Into Plaintiff Lawyer Kickbacks on Class Action Cases?
2008-05-11 06:58:00 Tulsa settlement planner Robert Risk's February 13th "man of class and grace", disgraced class action lawyer William Lerach, reports to Federal Prison on May 19, 2008 after pleading guilty to charges of criminal conspiracy in conjunction with a class action scheme. Two Republican members of the House of Representatives, John Boehner (R-OH) and Lamar Smith (R-TX) recently suggested that Congress has ignored the steadily unfolding scandal and call for a hearing. "If in fact the crimes committed by Mr. Lerach and his colleagues are an 'industry practice' as Mr. Lerach himself confessed, then the United States Congress is sitting idle while criminal behavior in the trial lawyer industry threatens American jobs and feeds like a parasite on the prosperity of working families" Boehner stated in a letter to House Judiciary Chairman John Conyers (D-MI) dated May 2, 2008. Are we shortly going to see people start defending the payment of kickbacks as "helping cons...

Is Rusty Hardin the Worst Lawyer Ever?
2008-05-09 06:40:00 I’m not sure too many people are going to be hiring him in the future (although he did do some noble work in getting Enron off the hook). Here a few of Hardin’s shrewd moves so far. –Demanding a congressional hearing in which his client was repeatedly railed by the democratic members of Congress for being an arrogant liar—Somehow Hardin failed to foresee that the U.S. Government wouldn’t jump at the opportunity to clear the name of one of baseball’s most upstanding gentlemen. Additionally, Hardin let Clemens testify without any material beyond the “I worked hard” line he’d been peddling for the previous six weeks. –Filing a defamation lawsuit against Brian McNamee without knowing whether there was any information that could prove Clemens’ name was already defamed—Either McNamee was so naive he didn’t believe Roger Clemens’ copious extramarital affairs would effect the suit, or he didn’t both...

Lawyer Ethics With Chinese Characteristics. It Matters.
2008-05-06 20:34:00 Second year SMU law student, Jing "Brad" Luo, recently had an article of his on China lawyer ethics published in China Law & Practice Magazine. A law student getting an article published in such a prestigious magazine (in his second language, no less) is really quite a feat. The article is entitled, "Chinese Law on Lawyers Amended: Progress Made and to Be Made," and though a subscription is required to see the whole article on the China Law & Practice site, Brad nicely summarizes it on his own blog, with a post, entitled, "Legal Ethics, In Chinese Style." My gross summary of Brad's summary is that China's new ethical rules for lawyers expand a bit on both the scope of confidentiality of client information and on what constitutes a conflict of interest, but on neither front have the rules gone far enough to make Western clients feel terribly comfortable. I previously wrote on why this discomfort is necessary in a post, entitled, "China Lawyer Ethics -- Perils And Pitfalls For F...

Want Your Ideal Client? Be Their Ideal Lawyer
2008-05-05 06:02:00 Identifying who your ideal client is, well, just the beginning. You need to learn how to attract your ideal client so they will actually contact you to determine if they need your services and if you are 'ideal' to deliver those services to them. How do you do that? This post is not about branding directly. I've discussed branding here and here. This post is about understanding who you are targeting by generational differences and reflecting back their values in order to attract their business. Each generation is classically 'labeled'. Understand there are always exceptions and subsects within each group, but in general you should not be targeting the exceptions. In James Chartrand's (of Men with Pens) post on Copyblogger, "Are You Talking to My Generation?" he writes the following:There are four generations out there right now, all with money to spend: the Silent Generation, the Baby Boomers, Generation X (or the Thirteenth Gen...
RSP Designation Mischaracterized AGAIN by Fort Myers Elder Lawyer
2008-05-05 00:19:00 At a time when a number of settlement consultants and elder lawyers are getting to know each other better for the mutual benefit of each other and those they serve it's critical that references to credentialing be accurate. I'm not sure why Fort Myer's Elder law attorney, William T. Edy continues to get his facts wrong on the Registered Settlement Planner Designation (RSP). In a post today on Medicare Trusts on News-Press.Com, Attorney Edy mischaracterizes which entity designates someone a Registered Settlement Planner and wrongly states the Society of Settlement Planners (SSP). The fact is that, as stated in the overview for the program posted on the Texas Tech University web site, the Registered Settlement Planner Program is a product of collaboration between the Registry of Settlement Planners Board (RSP Board) and Texas Tech University’s Personal Financial Planning Division. There is nothing worse than professionals not getting the facts straight on credentialing...
