May and I just signed the lease on the space we're renting in Palo Alto downtown for the Monolab|Incubator. The address is 543 Bryant Street, half a block away from both City Hall and University Avenue. Essentially, Palo Alto's epicenter. We decided to work on this project no earlier than May 25th (less than a month ago), May tendered her resignation on June 4th, and here we are three weeks away from our grand opening. I have two tenants that share an apartment (Two law students). I let them move into an larger apt. New lease for a year. after less than two months one of them decides to move out. I gave her the notice to vacate form and her reason for leaving was "strong desire to live on my own and irreconcilable differences with current roommate".Would you give her any of her security deposit?I told her that I would deduct any expenses I incurred including creating a new lease and other forms and any background check that would be needed for her replacement.Your thoughts?

We agreed to rent our one bdrm unit to a single woman in mid February. Old tenant moved out, husband renovated bathroom - new tenant supposed to move in on 4/1/08. She calls and says she's been laid off, can't move in and wants her deposit ($500 out of total due 1st mo and sec of $1700). You know what I'm asking... do I have to give her the money back? She's been telling our neighbors that we're stiffs, complained to the "handyman" - actually my husband! - that he better get his money up front... and also is harassing me via email and threatening to sue. THoughts? THanks!

Our tenants signed a 6 month lease that ended May 31. We hand delivered the new lease for them to review & sign. I know they haven't forgotten about it because they mentioned they'd have it for us when we met to discuss improvements they would like us to do. We had the meeting, but still no signed lease.They are requesting a mold inspection because one tenant coughs at night. No visible signs of mold, tho there's a basement with a working dehumidifier. We've made the call & the inspector will be out week after next. We put a monetary limit on some kitchen cabinetry if they want to purchase it immediately. Otherwise, we want to wait for the mold inspection to see if any remediation is necessary before we spend more money on the kitchen. This has upset them.They've had credit problems in the past; we gave them a trial 6 month lease & they were very responsible. Now the overall tone has changed, in my opinion. We did fill out a application and a condo association paper but no lease. my girlfriend and i were homeless, when on june 27th 2007, we met a lady who offered for us to stay in her home til we got on our feet. she said we would discuss rent/lease "down the road", all she wanted us to do was landscape, she would pay for materials for me to do other home repairs for which there would be no charge for my labor. 2 days later we met at the house, an hour later she gave us the key. on the 31st of august she very aggressively demanded $500, within like a week she lowered it to $250. we still had no money, to which replied "don't worry about the $250 and i won't be putting you out on the streets". we didn't hear from her again until december, where she gave us $25 dollars for a x-mas turkey and again told us not to worry. in the interim my 2 young daughters have moved in and my girlfriend is recieving SSI. we didn't hear from her again until feb 2008, when she demands rent and serves a 3 day notice. the 4 of us are barely been getting by, she has not produced...

I have a tenant who will not respond to call, letters, etc. I had started an Unlawful Detainer last month, only to realize I had served the 3-day notice incorrectly. I was advised by a attorney that since the lease was to expire and we would not be renewing the tenant, that we should wait until the 1st. We have contacted the tenant DAILY and have had no response from them.The 1st has now come and gone, the lease has expired, and I cannot get the tenant out!HELP!!! I just need guidance as to what route to go. I want to start the summons again, but I need to know if an 3-day notice MUST be served first, and does it matter if its a PAY OR QUIT or should I use something else???

I am looking to Lease a proprty with Option to purchase. Sale price 235,000 option for 6-12mo with 5K option deposit.Rent for 1500/mo nothing towards purchase and 1500 sercuirty deposit.Now from what I have heard from the master LL's on this site is that I should do 2 separate contracts.One for the Lease and a totally seperate contract for the Option. Now for the questions.1. Where can I find just a Option contract. (do I just break that out of one of the leases or is there a seperate one).2. If the tentant violates the Lease and let's say I evict or they leave breaching the Lease.They still have the option to purchase correct. If so how whould I do my next lease if let say the option holder had 6mo left on the option. If I put a new tentant in and they excise there option what would happen...they get property with tentant..I have to remove tentant?????3. What if I put it up for sale after they left can I sell it?Bill

I had an idea tenant would be breaking lease, so I had prospective tenant ready to move in. Tenant gave me in writing that they were breaking lease on 6/1/08 lease is until 2/1/09, tenants letter is dated 5/28/08. I have new tenant ready to move in 6/1/08. Lease stipulates, if tenant breaks lease, the security deposit will be forfeited. I just did walk thru with old tenant, few damages, holes in wall, cigarette burn in new rug, scratch on hard wood floor. None of this documented on move in list.What is everyone's opinion, should I refund any security deposit or just take out damages? I don't want to be a witch about things, but I'm kinda tired of being walked on.Any advice would be greatly appreciated.thanks in advance.

I have tenant 'A' who was given a lease by tenant 'B' to sign. I did not see, approve or receive signed lease from tenant A. Tenant B also accepted rent money from A and did not give a receipt, and I have not received that money from either tenant. Can I make A sign an approved lease and provide a security deposit and/or have them move out (I am willing to pay him his rent he gave to B)? Tenant A has a dependent living with him and the rental is located in NC.

He did not respond to any communications until I caught him on the phone and he said he was not moving and needed more time. I explained that I could only give him another couple of months and it would have to be at a substantial increase because I needed to cover my expenses and he said send the papers. I sent him a notice of the month to month increase which he proceeded to ignore. During his tenancy he moved a substantial amount of his property into my attic, without my knowledge or consent and took off my lock and put his own lock on the door. He started breaking into my basement,I know it was him because he told my lawyer he's been taking pictures to try and find problems to threaten me with, and now he's not paying any rent at all. Do I have any rights to my own home?

I am insisting on a credit and background check anyway. Supposedly he has a current lardlord reference. Besides requiring a cashiers check drawn on a local bank from him, what else should I look out for with a person that wants to pay up front? TX.

 Additional Comments: 10yo, Hanoverian/TBx mare, never bred and shown successfully in several disciplines at high levels. She was an A circuit hunter prior to me, with a solid dressage background. She has since been schooled in eventing and larger jumps and is just soaking it up! She easily free jumps over 5' with room and scope. Tight knees, round back. GORGEOUS legs, and strong, sound feet. Shown year round without shoes. Easy flying lead change. She is a really nice mare, I have just been forced to reduce my herd size this year due to my recent knee surgery. :( Stands quietly for trimming, clipping, etc. UTD on all shots and wormings. Works well in odd situations ei dirt bikes, tractors, cars, traffic, etc are no problem. Fine with other mares and geldings alike. Not marish. Rides in a mullen mouth happy mouth. Hi, hopefully I can get some helpful advice on here. I currently live in Maryland with my GF and her friend. My GF signed the lease with her friend, but I moved in shortly after they did, I've never been added to the lease. So the lease with the landlord, who likes me and my GF is just between my GF and her friend. Her friend has become impossible to live with, shes inconsiderate, irresponsible, the list goes on. We have even had to cover her rent/bills from time to time. Thier lease is up September 2008. We love the house, so me and my GF want to stay here, the landlord also wants us to as well. However when we told our roomate (my gf's friend) that we didnt want to renew the lease with her in September, she told us if we're unhappy, we should move out. Of course, this is not going to happen. So, Im curious, what is the best way to get her out at the end of the lease and for us to still be able to stay? We've spoken to the landlord and he is aware of mine and my gf's intention...

Asking for last's months rent after a years lease

After tenants finish up their first years lease, is it legal to ask for last month's rent when signing the renual lease? Is it too late, should it have been asked for when they moved in? I am also raising the rent and asking them to sign for another year -- the tenant is very upset. Could they take legal action?
