Broadband Internet A Legal Right In Finland – When Will India Have On
2009-10-20 09:33:00
(With inputs by Abhishek Kapoor) In the era of stringent Tweeting bans compared to performance drug tests, this news will not come as a shock to many. An unshakable belief in something without need for a proof or evidence could be the importance of internet in each one’s life today. With India working up their internet penetration in the rural areas, it would achieve 20 million broadband users by 2010. Now we are at the end of 2009 and the TRAI latest numbers suggest that broadband penetration in India has just about managed to reach 6.8 million subscribers. Even countries of the European Union seem to be deeming high-speed internet as a vital human right. Recently in news, Finland legally mandated fast internet access to all it’s citizens and is the first to do so. Even the United Nations have okayed this particular move, where a universal service should be every citizen’s right. The minimum mandatory speed in Finland currently needs to be 1 megabit per second, b...

More Legal Troubles for The Ultimate Warrior
2009-09-23 01:42:00
There's been another setback for the Ultimate Warrior in his legal battle against WWE. Last week, it became clear that Warrior's lawsuit against WWE for defamation related to the "Self Destruction of the Ultimate Warrior" DVD would be thrown out because WWE lawyers were able to demonstrate that Warrior publicly defamed WWE first. On Monday, Judge Roslyn O. Silver ruled that Warrior will now will have to pay $18,967.46 for the legal costs and expenses WWE had to pay to defending themselves against Warrior's lawsuit.source: pwinsider.com

Bears' player (the one with the injured wrist) sues Chicago Bears' Brian Urlacher filed a lawsuit Friday against an autograph and sports memorabilia company for terminating their contract.  Apparently, the company, Dreams Inc., sent Urlacher a letter following his wrist injury indicating that their contract was terminated "for cause" due to his "career ending" injury.  Read more about it here. Politicking during Mass - How is this even legal?
2009-09-14 23:30:00
The Catholic Church speaking up forcefully about its teachings on same-sex marriage is clearly protected under the First Amendment, a right I strongly support even though I just as strongly disagree with their view. However, how is their collecting money during Mass for a political campaign even legal? The tax exempt status churches ...

How China's Birthday And Shanghai's Expo Are Good For The Legal B
2009-09-09 12:58:00
I have to admit one of my favorite things is forming a China WFOE for foreign companies. I love them because co-blogger Steve Dickinson and our Chinese affiliated lawyers do all the work. I also love them because it is the rare WFOE that does not also need real estate, labor law, and IP assistance to go with the new company. They often require additional work as well, such as contracts, environmental compliance, government approvals, etc. In other words, the forming of one WFOE is almost always the forming of a long term and fruitful legal relationship. Which is why I have to admit to loving China's 60th Birthday celebrations and Shanghai's upcoming Expo. Please allow me to explain. Every time China has a big event, (see the Olympic games for past proof), it starts tightening up on visas. Over the last few weeks, we are hearing more and more about foreigners getting stopped on the street or in their apartment lobby! So why is this a good thing for my law firm? Becaus...

China Food Safety. Don't Blame Legal.
2009-08-22 10:37:00
Thought provoking post over at TwoFish's Blog, entitled, "Best and the worst – The Sanlu Settlement." The thesis is that China's handling of payments to those injured by the Sanlu dairy food poisonings was handled better than would have been the case had Sanlu been in the United States and been subject to a class action suit. TwoFish makes some valid points, which points are certainly more sophisticated than some commentators who fly over to China for a week and come back proclaiming that if only China allowed tort claims (it does) just like in the United States, all (or at least nearly all) food safety problems would be solved there. TwoFish says China handled Sanlu "quite well" and he challenges those who are "critical" to "explain what the Chinese government could have done better:" As I said above, as far as the actual settlements and consequences, I do think that the Chinese government handled things quite well, and I’d like for people that are critical of the leg...

What's Happening With China Legal? Read Asia Legal Blog To Find Out.
2009-07-21 15:21:00
When I worked in BigLaw, I, along with most of the other associates at my mega-firm, could hardly wait for the next issue of American Lawyer Magazine to hit our law firm's library. That magazine did a pretty decent job keeping us informed of what was going on in the legal world, and even within our own firm. It would give ratings to working as an associate at the big firms, with a commentary. My friends and I would always try to get quoted, though always anonymously. One year we bet on who would get quoted. I won by saying that we associates were pretty well informed of firm goings-on because we would get so much coverage in the American Lawyer. Now, if you want to read law firm rumors, the best place is Above the Law, (which had my firm down for a merger with Baker & McKenzie!) but it does not carry much on Asia. Asia Legal Blog is written by a legal headhunting firm so it is not going to go off on a rumor, but it is a good and free source of goings on in the Asian legal...

Off-screen legal drama for film distributor MGM
2009-07-08 02:07:00
Ever heard of the 2001 film, "Madison," starring Jim Caviezel, Jake Lloyd, Mary McCormack and Bruce Dern? I had not. And that's the issue in question in a case filed today by a local film production company against global film distribution company MGM.   (Photo from Amazon.com) Madison Miracle Productions, based out of Illinois, is accusing MGM of doing a "horribly mismanaged and grossly substandard" job of marketing, releasing, and distributing the film. The DVD release and distribution, according to the complaint, was also "disorganized and inept."...
Political violence: useful, legal, and justified

Various organizations defend the human rights of the Palestinians. Curiously, political philosophers don?t know whether natural rights exist at all, let alone their range. The Declaration of Human Rights reflects an ultra-left understanding of them. European states employ many workarounds to circumvent the Declaration. Electoral barriers and districted elections violating proportional representation are just some ...

?Legal Eagle? Special Ed Weighs In On The New ?Supreme? For Souter
2009-05-20 23:11:00
(And I also posted here.)I suppose as far as the WaPo is concerned, it?s merely enough to note that today?s columnist, Ed Gillespie (picture above with one of his pals), ?was in charge of the confirmation of Chief Justice John Roberts and played a leading role in the confirmation of associate Justice Samuel Alito? prior to allowing the former counselor to Dubya to display his own particular brand of hackery once more?As President Obama decides on a Supreme Court nominee to replace Justice David Souter, Senate Republicans must decide whether they will abide by the standard they used in confirming Justices Ruth Bader Ginsburg and Stephen Breyer during Bill Clinton's first term, or the standard set by Democrats in the confirmations of Chief Justice John Roberts and Justice Samuel Alito during George W. Bush's second term. This is one instance where changing their previous position can be a principled approach. In 1993 and '94, Republicans voted overwhelmingly to confirm Clinton's no...
Pro Gay Marriage - Why gay marriage should be legal
2009-05-12 06:29:00
Why we dont need a Constitutional banBy Kathy BelgeCarla and Miriam fell in love and decided to get married. Last summer they held a lavish ceremony on the coast. All of their friends and family attended. Carla?s dad, a minister, officiated. Miriam?s dad wrote and sang a special song. After the reception, the two headed off to their honeymoon. When they returned, they felt like a married couple. They moved in together, opened their gifts and started talking about having a baby. Even though, the couple feels committed to each other, they have none of the legal rights that protect other married couples. If Carla becomes ill, Miriam is not guaranteed the right to be with her in the hospital. If Miriam dies, her distant nieces and nephews have more of a claim to her belongings than Carla does. They file ?single? on their tax returns and are not allowed to be on each other?s health plans. The Canadian government ruled on June 10th 2003 to overturn the laws that prevented same sex couples f...

Obama’s Choice on Prosecuting Bush’s Legal Team:Unite the Natio
2009-04-23 01:22:00
I had planned a post last night on the President’s comments yesterday where he left the door open “to prosecuting Bush administration officials who devised the legal authority” for intensive investigations of terrorism suspects.  Yet, given that other conservative bloggers had posted on the topic–and far better than I ever could–I decided to, in the limited time available to me, focus on other topics. Yet, in considering the first post I wrote this morning, I realize how the two topics are linked, the president’s refusal to close the door on prosecuting officials of his predecessor’s administration and his failure so far to show acknowledge the legitimacy of the Tea Party protests.  To shut the door on such prosecutions and to address citizens’ concerns about a rapidly growing federal government would allow him to rise above the fray and speak out in the national interest. He could unite the nation by refusing to consider the demands...

There's all these commercials on TV right now for a variety of car warranty and car insurance programs and the like, and each time I see them I think to myself That's the next wave of clients coming into my office -- people upset because they bought a car warranty from someone on TV, then had a problem with their car and couldn't get the warranty to cover it.I know that's what tends to happen, because it happened to me. When I bought "Zippy," my old Ford Festiva, I got suckered into one of those extended warranty plans that covered "everything" I was told, and I paid a lot of money for it. Not long after that, Zippy developed engine trouble and I took it to the mechanic."It's the serpentine belt," he told me. To which I said, "What's that?""It's the belt that drives all your engine parts," he said.Which made me happy, because I had an extended warranty that covered not only "everything" but things in the "drive train." So I called the dealership and asked to have the warr...

On The Importance Of "Face" In China Legal.
2009-04-01 22:29:00
China Daily did an article the other day on how China's courts are now going to post its unpaid judgments online. It is entitled, "Court launches website showing who hasn't paid." A bit of background is in order. China's court system (and I am talking about commercial disputes ONLY) is not as bad as is so widely believed in the West. Foreign companies can sue and win against Chinese companies and they can and do. All the time. But winning a lawsuit and getting paid on a lawsuit are two very different things, both in China and everywhere else in the world. Many years ago, my firm brought a cross-border lawsuit against a foreign company on behalf of about 35 mostly foreign companies. The clients would often ask me if I thought we were going to win the lawsuit and my response to that was always, "yes, we are almost certainly going to win. Defendant took money that should have gone to you without your approval or authorization. This is about as blatant a breach of contra...

The Legal Basics On Starting A China Business. Clinical Testing As Example.
2009-03-25 15:51:00
One of the many things I love about being a lawyer is learning about various industries. What so happens to lawyers is that we get one client in an industry, and then, through word of mouth, we end up getting a whole slew of others in the same industry. That has happened to us in spades with clinical testing, a global industry booming in China. I woke up this morning to an email between my firm's lead China lawyer, Steve Dickinson, and a potential client needing help in establishing its clinical testing business in China. The email does a great job laying out the basics of what clinical testing companies must do to establish themselves legally in China and to protect themselves legally from employee and IP issues. But nearly everything in this email applies with equal force to nearly all businesses, particularly service businesses, seeking to get off on the proper legal foot in China. This email sets out the essential big three for doing just about any business right in Chi...
