Burr Oak Cemetery Litigation Update
2009-08-27 22:15:00
A hearing was held yesterday regarding the reopening of Burr Oak Cemetery, where employees were charged with digging up and reselling plots.  Attorneys for the cemetery have asked for $500,000 to reopen it and the receiver in charge of the property has already received $50,000 so far.  But, yesterday, Judge Martin Agran decided to put off the decision to release the remaining $450,000 to September 22nd. Lisa Madigan promises progress on Pilgrim Baptist litigation
2009-08-26 20:30:00
Part Four of Four. Attorney General Lisa Madigan, my daugher Dawn Sherman and me, at the Gay Pride Parade in Chicago on Sunday, June 28, 2009. OK ... who's more beautiful, Lisa or Dawn? You're right: It's a tie. Photo by my wife, Celeste Sherman. Attorney General Lisa Madigan and her staff have promised me that progress should be made, soon, regarding my litigation to stop Rod Blagojevich's State grant of one million of your tax dollars to Pilgrim Baptist Church. The grant was promised by Rod to Pilgrim Baptist after incompetent, uninsured, non-union roofers screwed up and burned the church to the ground in January of 2006. The litigation has been on hold for about a year.  It should have been settled, long ago....

Governor Quinn discussed with me the million dollar Pilgrim Baptist grant at his press conference on transparency in government, last week on Monday, August 17th.  Then, two days ago, on Sunday, Auust 23rd, after his press conference on clean water, Quinn discussed with me concerns that State workers have expressed to me about why they should have to take furlough days, if the State has tens of millions of dollars for houses of worship, parochial schools and religious...

By having agreed to Second Life terms of service Minsky will most ...
Chinese Litigation: This Is The Way (Uh Huh) We Like It
2008-08-20 12:27:00
By Steve Dickinson When we draft contracts in China, our foreign company clients usually instruct us to have the contract be governed by foreign law and for any disputes to be decided by arbitration, preferably outside of China. This is often a mistake. One major reason is that when any form of arbitration is required, the plaintiff has no access to the very effective prejudgment remedies available within the Chinese litigation system. A recently completed matter shows how this can work. A very internationally savvy Japanese client came to us for help resolving a difficult foreign trade dispute. A Chinese company owed our Japanese company a substantial sum, but the amount was not documented by a clear contract and the exact sum owed was nowhere clearly specified in writing. We were able to convince the Chinese side to enter into a new agreement where the Chinese company agreed to an exact payment amount and a precise payment date. In our initial drafting of this agreement, ...

Asbestos Litigation ? Report Speculates It Is A House Of Cards
2008-05-07 15:38:00
The New York based Manhattan Institute think tank today released a report very critical of the Asbestos litigation business. Asbestos litigation is the ?longest running mass tort in US history, and arguably the most unjust? the introduction tells us. Asbestos litigation does seem to have become a sub-genre of the legal profession. And the facts and ...

Disorder in the Court; RIAA Freaked
2008-05-01 03:48:00
The RIAA is perplexed. To a certain extent so am I. But a judge has ruled that just because a file is in a Kaazaa directory does not meet the definition of ‘distribution’. The confusing part? This very same judge ruled otherwise in a similar RIAA case against a different party. In most cases, ...

Mesothelioma Litigation Facts
2008-04-04 18:38:00
Mesothelioma litigation is an option for mesothelioma patients. Litigation however is not an easy path to consider. Before you choose to sue, there are a couple of crucial facts that you should be aware of. You have the right to sue. In some cases, your condition may be caused by the negligence of others. Mesothelioma is a type of cancer that results from exposure to asbestos fibers. Like any average individual, you probably wouldn't consider exposing yourself to asbestos of your own free will. You may have been exposed to asbestos due to your work or due to a family member who works with asbestos. So why should you sue if you find out you have mesothelioma? Companies that hire individuals to work on asbestos would typically know that there are certain dangers involved in handling the mineral. Company safety rules should therefore be strictly implemented to prevent asbestos exposure. If you develop mesothelioma, it may be due to a company's inability to protect and warn people aga...

Computer Forensics, Backups and Litigation
2008-03-14 13:00:00
One of my favorite "I forgot to backup" stories.  I get a call about 1:00 pm. The customer on the phone is telling me their server computer is down. We tried to reboot it a few time with no results. The customer stated that they had to get payroll completed tomorrow because it was Thursday and if they could not get the payroll out the workers would do bad things to them.  I drove for three hours, picked up the server took it to the distributer of the system which was three more hours of driving.  BTW the customer told as I am leaving with server that they needed to backup the computer because they had not done so in a month.  So if I could handle that for them. What? My major concern with a down hard drive is to get the data off and load on another harddrive and getting the customer back up and running. If the harddrive would not come up or files might have got deleted then would have to figure out how to get the data off. Allot of network professional use compan...

They have never been interested in paying the typical artist anything. Sure there are exceptions, usually the most ...

How Asbestos Litigation Plaintiffs Can Get Mesothelioma Lawsuit Loan In 3 E
2008-02-24 06:53:00
Non-Recourse Lawsuit Funding for Mesothelioma Lawsuit PlaintiffsIf you are suffering from Mesothelioma or a loved one has died of Mesothelioma, and you are a plaintiff involved in a Mesothelioma lawsuit(asbestos lawsuit), and have hired a lawyer to represent your claim then you may qualify for a Mesothelioma lawsuit funding or lawsuit loan against the potential future proceeds you may receive from your lawsuit. This is called as Mesothelioma lawsuit funding, Asbestos lawsuit cash advance, legal funding and litigation funding. It is also called as Asbestos Lawsuit loan. But in true sense, these are not loans because loans are repayable absolutely. But the Mesothelioma or Asbestos lawsuit funding is a non recourse cash advance and it does not have to be paid back unless the case is won or settled. What is Mesothelioma?Mesothelioma is the scientific term used to describe a cancerous tumor that involves the mesothelial cells of a body organ. Mesothelial cells are cells that form a protec...
China's Incremental Revolution. Litigation As Political Force.
2008-02-23 23:45:00
Very interesting post on the Transnational Law Blog on a very interesting Christian Science Monitor article. The post is entitled, "Another Reason to Have Faith in China's Maturing Legal System," and the CSM article is entitled, "How one man in China strengthens the rule of law: Hao Jinsong, a Beijing lawyer, defies authorities with small lawsuits." They are on how a Chinese lawyer uses China's court system to accomplish democratic change that almost certainly could not be accomplished any other way. Great example of how law can create incremental change. As we argued in a previous post entitled, A Reason to Have Faith in China's Legal System, small lawsuits vindicating the rights of the average Chinese citizen will engender within the citizenry a general interest and trust in the legal system, which will perpetuate a rule of law system. Our previous article concerned a small legal aid station in Xi'an that represented migrant construction workers, and this current article ...

Subprime Litigation 2007 Filings Study - Navigant Consulting Inc.
2008-02-15 15:43:00
http://www.reuters.com/article/-marketsNews/idUKN14450240200802-14?rpc=44 Borrowers, investors and other plaintiffs filed 278 civil lawsuits in federal courts related to subprime lending in 2007, and the trend is expected to continue this year, according to the report released on Thursday. Last year's subprime tally was equal to about half of the 559 legal actions brought over a multiple-year period following the savings and loan crisis, according to the report by Navigant Consulting Inc. The subprime fallout has frequently been compared with that of the S&L crisis, which cost the government more than $100 billion. "The S&L crisis has been a high-water mark in terms of the litigation fallout of a major financial crisis," said Jeff Nielsen, managing director of Navigant, which provides business, regulatory and financial advisory services. "The subprime-related cases appear on their way to eclipsing that benchmark."

VoIP Inc borrows from the Verizon litigation as a profit center playbook
2008-02-13 14:19:00
Did Verizon open Pandora’s box with it’s endless string of VoIP suits? My guess is that enterprising law firms are doing patent searches and pitching the idea wherever a patent exists. Free enterprise has its dark side. To me, these patents look at best to be pretty duious: The patents protect innovations that enable “Pay-Per-Call” advertising and ...

Google's Response To Patent Infringement Litigation
2008-01-15 11:51:00
During November last year Boston's Northeastern University and technology company Jarg sued Google for patent infringements, see: Northeastern University Takes Google Inc To Court!. Now we have a response from Google, and it's an outright denial of the charges leveled against them. Picture Credits: The US Patent & Trademark Office The patent #5,694,593 attributes the patent to Kenneth P Baclawski who's been professor from the Northeastern University as well as one of the founders of Jarg. The patent is about the search technology wherein a search query is fragmented into smaller chunks and distributed across multiple systems in a network to enhance processing speeds. The allegations follow that Google uses the technology which has been exclusively licensed to Baclawski. Google has responded saying that the patent is invalid which has been rebutted by the other party. It seems it will be a couple of years before the lawsuit is sorted out. Via: Macworld
