Improved Response to Medical Malpractice Claims
2008-06-04 16:34:00 Because of the rising number of litigation in medical malpractice claims, physicians have adopted new ways to cope with the changes. By altering their medical practices and focusing more on preventive measures, doctors were able to curb the problem.
The Changes in Medical Malpractice Claims
2008-05-30 00:23:00 One fine day, I happen to read an article entitled, Doctors Say ?I?m Sorry? Before ?See You in Court?. The article relates all about medical malpractice claims which are constantly litigated causes of actions in our courts in this genre.
The Grand Ideas
2008-03-03 15:54:00 The last five days have been very productive at 5009 Stillwood Drive. On top of the usual amount of accomplishment, the nights have seen about 20 hours worth of discussion and debate on a number of topics from issues in the state of Tennessee, to vice-president possibilities for both parties, and electoral math in the upcoming general election.Travis Gable, Jared Gable, Nathan McIntyre, and I were the participants in this series of discussions, the last of which ended at 4:30 this morning. I will offer up very brief summations of the topics and conjectures. Let us know what you think:-Health Care in Tennessee- We propose to end all socialized medicine in the Volunteer State. Instead, we improve the quality, availability, and cost of health care to all its indigent citizens by paying 100% of a private insurance premium for all eligible families. The State would contract with several private companies to provide competitive and individualized policies to all residents who qualify. Eve...
Medical Malpractice Insurance Premium Quotes Database
2008-01-23 13:00:00 Lack of information transparency has always plagued the US Health care system, possible true for most healthcare across the world. It has always been tough for me to find a good, free resource on sample malpractice insurance premium quotes for physicians by specialty, by state, location and year - but news and articles scattered over the world wide web surely have lotsa data strewn all over the
Medical Malpractice
2007-11-10 12:41:00 Years back, after being discharged from the hospital, Ricsson and me went home. For a few days I breastfed him and everything was normal. Richard and I brought him to Dr. John Lim for checkup and he was a little ‘yellow’. Dr John Lim told me not to eat too much ginger. ...

Writing to Heal
2007-10-23 09:01:00 Although my blog is a form of writing to heal, I also write letters to people that I sometimes don't send. This is one of those letters I can't send for obvious reasons, but it makes me feel better to write it.Just to give you a bit of the back story, I had another unbelievably bad experience today with my mother's doctor (a new one who replaced the two awful doctors that preceded him). I've come to the conclusion that there is something so wrong with the medical profession that unless we speak out, we'll only have ourselves to blame when our time comes around.Dear Doctor Smith, (a pseudonym)I hope that no one treats your mother the way you treated mine today. When we arrived at your office--after Dr. Jones (the orthopedic surgeon called you)--and we were waiting in the reception area, I know that you saw my mother and me and chose not to come out. How dare you!Three weeks ago when you agreed to be my mother's doctor, and you told me that the care she had recently been given ...
Medical Malpractice Victims Deserve Their Quality Lives Back
2007-10-10 19:59:00 My wife is a special education teacher so for years of weekday afternoons I?ve been regularly around children with disabilities. I too am a father, and as I speak with their parents ? those who watch their kids crawl into development - I tend to feel their anguish. This motivates me into dedicating my legal practice to the rights of these parents and children.
Mama and Me...Again
2007-10-03 09:01:00 Yesterday, I saved my mother's life. It was as dramatic as that. My mom has been ailing. She's gotten horrific medical care. Family members told me to "let her go." But I knew it wasn't her time. So, when her knee starting swelling, she stopped eating, and everyone else was sure it was due to the build up of calcium in her system, and she shouldn't return to the hospital, but should be put on hospice care, I kept my own counsel, followed my heart, and sought help.Because her beloved caregiver and I spent 10 hours at her assisted living facility and the hospital, I'm bushed. But let me share the highlights.1. As I suspected, the doctors who said she would die of high calcium due to parathyroid disease were wrong. It's treatable by medication.2. The hospital technicians who took two x-rays (Last week they sent her home from the hospital twice and said she didn't have a fracture.) of her leg after she fell, somehow missed the fact--both times--that she had broken her knee.3. The...

Medical Treatment by Boarding School Infirmiry
2007-06-10 06:10:00 Facts: Highschool boy gets injured in a basketball game at his boarding school. He is treated by the school infirmary in consultation with a physician. The physician diagnoses muscle strain, and orders pain medical and physical therapy. After some time, the boy returns home to a foreign country and is treated by a physician who diagnoses via x-rays and MRI that his back bone was misaligned and he had torn cartilage in his lower vertebrae; and that even with surgery, he could have permanent, life-long nerve damage and debilitating injury. Surgery is performed with the question pending on the life-long damage. Issue: What should the boy do? He wants to return to school. His parents are in a foreign country and they do not speak English. Should he consider a medical malpractice complaint?

Medical Malpractice
2007-06-08 00:00:00 It’s truly no secret that hospitals often overcharge for trivial items (such as tissue paper). Ponzi and I have heard that from a few people we know inside the medical industry (then again, on the radio last week). Plus, some doctors pay less attention to Medicare patients because they won’t bring in as much money ...
Hospital Physician Relationship in Medical Malpractice Defense
2007-06-04 05:30:00 The hospital physician dynamic is something that an individual will never learn unless he experiences it first hand. Most of the time, if a patient is injured while at a hospital and begins a lawsuit for medical malpractice, he will sue not only the physician but also the hospital and any other practitioner who was involved in his negligent care and treatment. It is rare that he will sue only the physician because the hospital has the deep pockets. Most physicians are not employees of the hospital, but rather merely have privileges to treat their patients at the hospital. Most physicians are employees of their own corporation including a group of physicians practicing together. A huge factor in the defense will be the amount of insurance available. If the physician has $500,000 worth of insurance coverage and the case can be settled within those limits, the hospital will work towards a stipulation to dismiss the case against them, especially if they were only the site of the...

Medical Malpractice - Who is Treating You?
2007-05-30 17:48:00 Do you know who is treating you? I learned in medical malpractice defense that patients are often unaware that the professional treating them is not a physician. For example, a patient goes into a routine outpatient procedure under which they are sedated with anesthesia. The anesthesiologist M.D. greets the patient briefly and asks some history and may perform a short examination. This takes place after another professional, likely a C.R.N.A. certified nurse anesthetist and/or a nurse has taken a history from the patient. The M.D. doesn't do a real thorough job taking the history or performing an examination because he assumes this has been done by the nurse and/or C.R.N.A. He is present to sedate the patient and once sedated, leaves the operating room giving control and supervision over to the C.R.N.A. The patient has no idea that this is taking place and that they are not being cared for by the M.D. If something goes wrong during the surgery with the anesthesia, the C.R.N...

Medical Malpractice - Which Entities to Sue
2007-05-30 05:51:00 All of them. Everyone who was involved should get a timely notice of intent to sue. The main purpose of this item is to inform the public about the way hospitals are set up, which is a topic of which I had no knowledge prior to practicing as a medical malpractice defense attorney. Prior to that time, I had no knowledge whatsoever that the emergency departments, radiology departments, anesthesia departments, and various other departments are NOT employed by the hospital. More specifically, the ER Dr. treating you when you walk in the emergency room is probably not an employee of the hospital, but rather is employed by a group of physicians formed into a corporation, which has an independent contractor contract with the hospital to manage the emergency department in such a way as to provide competent, timely, and otherwise professional medical service. The same is true of the anesthesia and radiology departments. In defending the hospitals and its employees, we routinely asked ...

Boise Idaho Medical Malpractice Lawyer - Medical Malpractice Claims - Part
2007-03-25 14:44:00 This is the first in a multi-part series on Idaho Medical Malpractice claims. Many victims of medical malpractice in Idaho do not realize that their immediate access to the court system is limited by statute. In Idaho, before you can seek monetary compensation from a negligent care provider in court, the law requires that you must first file an application for an administrative hearing with the Idaho Board of Medicine. This is called an application for a pre-litigation screening panel hearing. This "hearing" is presided over by several doctors, and usually a lawyer and a lay person. The ostensible purpose of the hearing is to weed out frivolous claims. The panel purportedly does this by issuing a panel decision advising the claimant on whether the claim has merit or not. The panel decision is completely non-binding and inadmissible in court. Critics argue that the panel process amounts to little more than the proverbial fox guarding th... |
