To give you all a recap here is a summary:-Tenant gives 30day notice of moving on June 2nd-Spent all of June's rent for other new place $995-Idiot Landlord (me) did not collect last month rent at beginning of lease-$700 for deposit was collected-Tenant did a very good job at landscaping (best on block)-Tenant painted every room different color (looks good except for 2 rooms that came out too dark)I have decided not to take my chances TRYING to collect any unpaid rent in small claims. 2008-06-03 21:59:00 Yesterday tenant gave me a 30 days notice to move but said they will be leaving in 2 weeks. The other two weeks they will be cleaning up the place. Rent is 995 and is due on the first and does not have the money to pay this month since they used it for the other new place. The deposit is 700 and tenant wants me to use the deposit to offset the the rent due for June plus the landscaping work they have done. Although I have not seen the landscaping/yard work, I have heard it is nice and wouldn't mind if they left it that way. Also, tenant painted walls with dark colors and does not want to paint the walls back at their expense. I also would not want them to repaint to original color since I have feeling they will do a lousy job and I will have to get it paint it again. My rent loss will be $500-$1,000 plus costs & depending on how long it will take me to process a new tenant..

She signed a Drug Free Housing Addendum along with her rental agreement when she moved in. She clearly violated the Drug Free Housing Addendum (having illegal activities and harboring a Felony Fugitive which was arrested on the property in question). When this information was brought to me, I served her with a 3 day notice to quit for violation of this addendum. If her trailer is gone but there are other abandoned items on property, what can I do about serving a belief of abandonment? The civil code states that I need to wait 14 days before I serve her with a 15 day notice of abandonment. She has not paid rent for the month. Should this 14 day period start from the day that rent was due and not paid or can I start a 15 day notice of abandonment beginning the day that I found her trailer to be gone?
