Mylan (MYL): Patent pending profits
2009-09-16 06:00:00
"It has been estimated that $100 billion of branded drugs will go off patent over the next five years and Mylan (NYSE: MYL) is very well positioned to benefit," says growth stock expert Tom Bishop. In BI Research, he explains, "Mylan has not yet benefited much yet from the focus on healthcare reform, though generics are clearly part of the solution to lowering the cost of healthcare.""Mylan is predominantly a generic drug company that, in the wake of its acquisition of Merck Generics, has $5 billion in sales and 120 ANDA’s pending FDA approval targeting drugs with branded markets totaling $85 billion to fuel future growth."Of these 120 Mylan has thirty-five pending ANDAs that are potential first-to-file opportunities, representing $16.6 billion in annual brand sales."Meanwhile Obama’s healthcare plans call for expanding healthcare coverage to more Americans and making lower cost generic drugs more available. This incidentally includes d...
Google Wins Case To Patent Homepage Design – What Was The Big Deal Ab
2009-09-04 05:42:00
If you thought you can kick start your HTML lessons by copying Google’s simple homepage on your website, beware that your website could be sued! As ridiculous as it sounds, Google has won a five and a half year battle to patent its simple and elegant looking homepage. Why would Google do such a thing? That is because the design is indeed iconic. Look at the other search engines of today: Ask, Yahoo Search, Bing, Twitter Search, etc. and compare this with how search engines like Ask Jeeves, AltaVista and Yahoo Search looked before Google was born! The clean search page, though it looks like a selfless service at first thought is more profitable than cluttered search pages. A cluttered search page (with links to entertainment, movies, etc. ) is going to take the users away to these pages where they might convert not well enough since it could be more of curiosity clicks rather than a need. On the other hand, a simple search box is going to first assess what the visitor is looki...

China Patent Reform. When China is Good.....
2009-02-13 14:21:00
Regular readers know that CLB generally does not like to write much about upcoming laws. There are three reasons for this. One, there are plenty of existing laws about which to write and those, for obvious reasons, tend to be more central. Two, upcoming China laws often never come. Three, it is difficult to write about a law without having seen it in action first. On top of that, I generally avoid writing about patent laws because I am not a patent lawyer. But I am going to violate all of the above by pointing out an excellent Wall Street Journal opinion piece, entitled, "Patent Reform With Chinese Characteristics: Beijing's amended intellectual property law holds dangers." The piece is written by Ronald A. Cass, dean emeritus of Boston University School of Law, president of Cass & Associates, and former vice-chairman of the U.S. International Trade Commission. The reason I so much like this article is because it so clearly explains much of the current patent situation in...

China's New Patent Law Amendments. The Times They Are A Changing....
2009-01-02 02:20:00
Recieved an email from Toronto-based international lawyer, Paul Jones, on China's just amended patent laws. I liked it so much, I secured Paul's permission to run it here: "Last week in Beijing there was the last meeting of the Standing Committee of the National People’s Congress for 2008. On Saturday it was announced that they had found that the revisions and consultations (they received some 500 responses) had gone so well that that the amendments had been voted on and adopted. The Amendments will come into effect October 1, 2009. The Amendments and the Amended Law (in Chinese) are here. [We will be watching for a good English language translation and will post it when and if we find it] The amendments introduce a number of changes such as an absolute novelty requirement, make it easier for judges to increase the penalties for patent infringement, require disclosure of sources for genetic resources, and require inventions made in China to be first applied for in China unl...
