China Patents Work And I Have The Proof.
2009-08-02 20:06:00 Axiom: Chinese businesses do not waste money. Axiom: Filing patents in China is expensive. Axiom: Chinese businesses are filing patents in China like crazy. Conclusion: Filing patents must be worth the money; in other words, they have value. According to Intellectual Asset Management Blog (h/t IP Dragon), "for the first time invention patent grants made to domestic [Chinese] entities are outstripping those made to foreign concerns. According to SIPO statistics, in the first six months of 2009 Chinese applicants received 18,634 patents, while applicants from overseas took 17,737; that's 51.2% and 48.8% respectively. In 2008, Chinese applicants were awarded 49.7% of the 93,706 invention patents granted by SIPO." Chinese and China patent filings are having and will continue to have worldwide implications: Clearly, all of this has major implications for granting authorities, in-house patent departments and private practice firms across the world. What a great time it is to be ...

Top 5 Myths About Patents
2009-05-28 17:35:00 Over seventeen years of drafting patents I have run across a lot of misconceptions about patents. Unfortunately, I sometimes hear them from would-be clients, crushed to learn their misunderstanding has cost them the chance to patent their inventions. Patent law is complex and constantly changing. Staying on top of the latest information is a full ...

Patents: "The Good and the Bad"
2009-05-08 09:32:00 Patents: fixable, or the next weapons of financial destruction? The big issue of the evening came from a discussion of the treatment of so-called "non-practicing entities" or NPEs?organizations that hold patents and assert them, but do not conduct a business that applies the patents. By Ron Wilson, Executive Editor -- EDN, 5/7/2009 A panel sponsored by the Commonwealth Club of Silicon Valley last night brought together three significant players in the US patent-law debate to discuss the future of the patent office, the current reform legislation in Congress, and the future of intellectual property. The discussion ranged from pessimism over short-term fixes to a dire warning about the arrival of the investment banks in the patent business. Steve Perlman, founder and CEO of invention-factory Rearden, David Simon, chief patent counsel at Intel, and Ronald Yin, partner at law practice DLA Piper, discussed the issues under the questioning of Wall Street Journal Deputy Bureau Chief Don C...
Easter Patents
2009-04-09 23:54:00 For some reason, people cannot get enough Easter patents. Last year’s post on Easter Patents brought ten times my normal traffic. For that, I would like to extend my gratitude. China Trademarks, Copyrights, Patents. It's All The Same To Me, I&apo
2008-12-10 13:43:00 In its post, "Why I Should Stop Reading IP Case Summaries in the News," China Hearsay does a great job attacking a Xinhua news story on what appears to have been a legal victory by Apple Computer in a trademark lawsuit. China Hearsay is justifiably ticked off about the misstatements in and extreme vagueness (can something be extremely vague?) of the article and in attacking the article, actually (inadvertently) does a really good job setting out a couple of key China trademark law basics. First, one does not just "register a trademark" in China. One must register one's trademark in a particular category or categories. This matters. Western companies frequently complain of someone having infringed on "their trademark" in China, when in fact there has been no infringement because the Western company actually never registered a trademark in the particular category in which the allegedly infringing product belongs. Second, unlike patents, China trademarks do not necessarily expir...

Microsoft Patents Proactive Virus Protection
2008-05-27 15:36:00 Slashdot It!Microsoft has just snared a U.S. patent for proactive virus protection, which is how security software helps secure your PC when it encounters shape-shifting malware not already in its antivirus definition file. What I want to know is, what does this mean for all the other vendors -- like McAfee, Symantec, Kaspersky, and Trend Micro -- that have been selling proactive protection software for years? Do they now have to pay Microsoft protection; I mean, royalties? Here's the quick low-down on the new Microsoft patent. Issued on May 20, patent number 7,376,970 is entitled "System and method for proactive computer virus protection." The inventor is Adrian Marinescu, who was at one point (maybe he still is) a lead developer on the Windows kernel team, heavily involved in the heap manager. He previously worked on Windows NT's object manager, which is a key software traffic-cop managing the interaction among all the executive kernel subsystems. All this is by way of saying tha...

Software patents underlie a novel open source business model (video)
2008-03-30 01:36:00 "Software patents are evil." Ask almost any free or open source software advocate, and they'll you that software patents kill creativity and keep computer science from advancing as rapidly as it would if everyone shared their basic work with everyone else, unencumbered by patents or other restrictions. But computer science professor Fred Popowich of Simon Fraser University says this is not necessarily true. So does attorney Larry Rosen, who spent many years as legal counsel for the Open Source Initiative starting (literally) before it had a name.
