Probate Litigation
2009-10-04 11:30:00
Probate litigation refers to obtaining legal assistance to resolve conflict surrounding inheritance assets. Heirs or beneficiaries must retain the services of a probate attorney in order to contest the decedent's last will. Probate litigation is oftentimes required when decedents die intestate (without a Will). Probate litigation can prolong the probate process for months or years. I know a woman whose stepfather passed away without executing a Will. Although single at the time of his death, four of his six ex-wives came forward to lay claim to his estate.

By LARRY MITCHELL - Staff WriterKay Roberts lost her home, some of her money and much of her freedom when she was put in a conservatorship under supervision of the Butte County Public Guardian's Office last year. The "unkindest cut of all," Kay feels, came when the county limited the ability of her son, Bill, to visit her or even talk to her on the phone. For a number of weeks last summer, Kay, who is 84, remained as a (prisioner)private-pay patient at Riverside Convalescent Hospital, where she was taken after treatment at Enloe Medical Center following a fall. It was a frustrating, uncomfortable time for her and her family and friends.Bill Roberts said his mother was unhappy and cried and cried. She feared she'd never leave the place and was convinced the county would end up taking all her money. "I've never seen a human being so distraught," he said. "She deteriorated so much. She just gave up."Judge Darrell Stevens had called a hearing for Sept. 18 to consider whether the public...

Probate Showdown
2008-05-16 04:30:00
by NASGAMore than a year after the retired Baytown refinery worker died, a showdown still looms in the costly court fight that pits Perry "Bit" Whatley's widow against the dead man's former guardians and the Harris County probate judge who appointed them. Two attorneys appointed by Probate Judge Mike Wood to represent Whatley during his final years ? as well as the judge himself ? could face trial in June in a civil lawsuit. The suit alleges Whatley's guardianship was improperly handled and lawyers should not have been allowed by Wood to manage Whatley's life or his savings. At stake are hundreds of thousands in court-ordered legal fees and living expenses that consumed much of Whatley's $2 million nest egg, which he built over a lifetime of investments, primarily in his former employer, oil giant Exxon Mobil Corp. As the litigation drags on beyond Whatley's death, the case remains a cause celebre among critics who allege Texas probate courts are being misused and abused at th...

Understanding what is a probate in will writing?
2008-05-09 02:41:00
Where do you see this? In court documents and newspaper articles. What does it mean? When there is a will, the deceased’s estate or assets can be accessed by the family and descendants and distributed among them only after a grant of probate has been obtained from the courts. The estate or assets are frozen under estate administration laws in the meantime. The objective is to make sure that an estate is distributed according to the wishes of the deceased. If there is no will, letters of administration will substitute the term probate. Why is it important? The process of obtaining a grant of probate in Singapore can last from a few months to two years or more. Meanwhile, there is expenditure such as funeral expenses and other bills to be taken care of, so the deceased’s family may be facing difficult cash-flow problems. Worse still, if the assets of the deceased are not properly managed or if the estate has to pay fees while it is being managed, the overall value of th...

This material is taken from Bali Web Design Blog, http://design.ebali.web.id/bali-webdesignseo-blog-1.html. In live we always have someone or maybe couple people that we love the most. Sadly that nature and God law not let human to stay forever in the earth. Someday human will go back the Father House and be with him in paradise. When that happened to someone we love the most if we could we would like to say no God and get them back here with us. But that against reality that rsquo s the thing we called as live. Sure that we are so sad when someone we love the most died. Worst if we still don rsquo t do something beneficial to pay back what we already get from them. But live must go on and the story must be continued. Although it rsquo s sad story but sometimes someone who died left us with will. Often they also left behind treasures that we never know that it is exist and waiting for us to claim. When it is happened to you don rsquo t feel too guilty because it stays like as the...

Nestled behind the Redlands Police Department, the Redlands Superior Courthouse is housing a systematic and covert assault on the lives and life-savings of San Bernardino County's elderly and disabled.A smiling, bespectacled security officer, sporting a platinum blonde ponytail, runs the visitors through a metal detector as they enter. One walks into a lobby area, with two courtrooms off to the side: Department E1 and Department E2. Only traffic and probate are now heard in the Redlands Court. At the f...

2008-04-03 13:00:00
By Christopher Ketcham ketcham99@hotmail.comON JUNE 17, an oppressively hot day, a knot of protestors converged in the plaza near Brooklyn State Supreme Court. They were mostly black, mostly women, middle-aged or elderly, well-dressed and solemn. Underneath the quiet demeanor, however, they appeared to be seething. The homemade signs in their hands expressed their anger."Judge Phillips ran for District Attorney. Now he's homeless.""Bring Judge Phillips home now!""What happened to Judge Phillips' multi-million dollar estate?"The tragic figure in their complaint, retired judge John L. Phillips, Jr., had a date in the courthouse, so when he arrived, the protest broke up and the group followed him into the building and up to the 9th floor.John Phillips had been returning to these halls since early 2001, the year he was planning to run for Brooklyn district attorney. That was also the year he was placed under a guardianship program overseen by a county judge, which wrested from Phillip...

March 29, 2008Hi Ray ;My Name is Arthur Manthorne. I E-mailed you a while back about my wife Terri?s and my fight against abuse and legal and illegal theft within the confines of the system. You might remember that I sent you an update about Terri being taken from me and my losing conservatorship of the person. After this process it was an inevitable loss of her life orchestrated by a system of hospitals, health care families, family, lawyers, and money seeking individuals to go after the estate.I am now alone and entrenched in the long drawn-out probate fight under which information and activity comes in small spurts and mostly troubling news. I have had several lawyers over the last 10 years that have taken money from me (and crucial evidence), made promises, and ultimately disappeared with my money and case evidence. Many times I have asked for and accounting of what they are doing with my money and all have not delivered on this promise. I would imagine that you have heard this ...

Should you consider avoiding probate?
2008-01-02 17:44:00
Our first article in 2008 is a guest post by Alex T. Roshuk. Want to be a guest writer on Financial Dominance ? Contact Marcel Probate is the process of having your will accepted by a Probate or Surrogate Court so that the estate will be administered and all the claims and distributions on the estate will be settled. Without a Will this process is called the administration of an estate. In the first case the Will names the Executor or Executors who administer the property, in the second case the Administrator is set by statute, agreement of the heirs and the approval of the Court. This article deals with some of the problems with probate and, to a lesser extent, administration of estates and some suggestions on how to remove your assets from your estate to avoid these problems in certain cases. The process of probate can be complex, long, and protracted. Needless to say, it can consume a sizeable percentage of the estate assets. While it’s important to consider drafting a...

The executor may also fail to reply to inquiries or provide written documentation as to the status of the estate. The beneficiaries may lose confidence in the executor and wonder what can be done. Anti-Lapse Statutes
2007-07-18 22:00:00
Most states have anti-lapse statutes. Black's Law Dictionary Sixth Edition defines 'anti-lapse statute' as legislation enacted in most jurisdictions to provide for the testamentary passing of property to heirs and next of kin of the designated legatee or devisee if he dies before the testator, thus preventing a lapse of the legacy and the passing of such property through intestacy to the heirs and next of kin of the testator. In other words, the anti-lapse statute prevents the bequest or devise from failing to vest because of the death of the devisee or legatee prior to the death of the testator. The statute expresses a presumed intention of the testator, that may be overcome by expression of a contrary intent in the will. The legacy will go to to the heirs and next of kin and if there are none, then to the residue. Michigan has an anti-lapse statute which can be found at
