Brooker Wins Whiter Shade of Pale Appeal

Gary Brooker of Procol Harum has won his appeal of the ruling over royalties on the song A Whiter Shade of Pale. Back in December, former group organist Matthew Fischer had been awarded 40% of the royalties on the song based on his allegation that he wrote the iconic introduction, based on a Bach piece. Brooker commented at the time that he lost because he was not made aware of the proceedings and that, in fact, he had suggested the Bach piece to the organist.On Friday, judge John Mummery concurred that Fischer should receive co-authorship on the piece but, because it took him thirty-eight years to file the lawsuit, he should not received financial compensation.In part, the judgment read, "Matthew Fisher is guilty of excessive and inexcusable delay in his claim to assert joint title to a joint interest in the work. He silently stood by and acquiesced in the defendant's commercial exploitation of the work for 38 years."
