I have a Sec 8 tenant, approved for a 2 BR apt at $1189 and she was assisted for a share of the rent by Sec 8 and rest to be paid from her side.Subsequenty, she approached me for the 3rd bedroom in the house which meant the whole house and she signed up another document, notarized, for $1700. She paid the rent from start of the lease until Oct 2007, when she stopped abrupty..(rent on the basis of 3 BR @ $1700)Filed case for non-payment and she is defending herself that this was a side agreement and that the Landlord must return all the extra money she paid for the 3 BR as she was approved for the 2 BR. She wants the difference of $1700 less $1189 to be paid back to her.Is the tenant legally allow to claim refund of this rent despite that she signed a notarized letter for a bigger place and agreeing to the terms. I tried to compromise saying i will not demand the rent not paid and she should not claim refund..also i offered her another 2 BR apt, so that she can move out of my 3 BR ...

Now that my rental house is available again, I've decided to put my fear of learning something new aside and try to put a Section 8 tenant in it. Apparently, Section 8 is the old term - the program is now called Housing Choice Vouncher Program. With this program, from what I've heard so far, you register at Sacramento Housing and Redevelopment Agency as a landlord with an available residence for rent to a tenant on public assistance. Then the agency calls you a few weeks later for a briefing and you're free to take on a Section 8 tenant who brings you a voucher. From then on, HUD pays you the rent, the tenant pays the deposit. You are still however responsible for screening the tenants and it is a good idea to do so especially because they will be in possession of your house. I hear there is a minimum lease requirement of one year, but I guess I'll find out all the details at the briefing. Breaking Lease Agreements while on Section 8

I live in an apartment complex and my lease will be up in October. There have been break ins and other crimes in this complex and I want to move. Ispoke to management about letting me out of my lease because I fear for me and my kids safety. I'm trying to move out of state because of this fear, the lack of jobs and the failing school system in my city. I was told by management that by Michigan Law, these are not valid reasons to let me out of my lease. Any advice?

I have my section 8 tenant in evication court for non payment of rent. Their legal aid atty said we cannot collect late fees from section 8 tenants. Is this true? I used LPA lease. Thank you.

I own one 3 unit building for 4 years. I have never accepted section 8 tenants because Honestly, I think they're just milking the system. Well, last march a semi retarded guy wanted to rent an apt from me. He said he was section 8 and I reluctantly said OK. Rent for the 1 bdrm was $525 for a year. I had to make a few updates to the place after the housing inspector came through. That to me, it is annoying that my apt has to be inspected every year so it's deemed OK to live in. I keep my units nice but the inspector always finds some rediculous thing for me to fix. My tenant turns out to be a drunk and calls me telling me that his ceiling is falling down, water leaks in, his stove is leaking gas, his chimney must be cleaned immediately etc etc etc. He only calls when he's drunk and I think, makes up these "issues" to have something to complain about. Foreign investor and Section 8

I'm an foreign (Canadian) investor with a house in St. Louis, MO. I have a tenant that wants to go section 8. We submitted the forms package, through my property mgr, to sec8 but they are giving me a hard time because they are not satisfied with the W-8BEN form that we submitted. You see, one of the forms is W-9 (for US persons) to indicate their ITIN or SSN. However, since I do not have either AND am a "nonresident alien" (ie. foreign person), I cannot provide a W-9 but a W-8BEN. Even if I had an ITIN, I could not give them a W-9; it's against the law. Now, Section 8 in St. Louis has never had to deal with a foreign investor and are asking for a US id. I tried explaining to them that they do not require it but they are insisting on one or they'll reject the application.My question is whether anyone out there has had or heard of anything about section 8 and how they handle foreign persons in their area. Any suggestions would be appreciated.Thank youSotirios

Hi. Please help!Our Section 8 tenant gave me a 30 days leave notice, left our house, and "moved in with her mom". She stated that she did not get along with my wife, and the tenant caused my wife a lot of stress during the tenant's short 6 month-stay.We have since rented out the place to another tenant (not Section 8).However, our former Section 8 tenant recently asked us (now in her nicest tone of voice I've ever heard her) if we could write her a letter for the Housing Authority stating that WE kicked her out. In addition, she even asked if the place was already rented out and if she could move back in!In the meantime, we are still receiving Section 8 checks! My question is: should we cash these Section 8 checks on the premise that the tenant is simply not staying at our house or are we legally obligated to move her back into the house (and disrupt the new tenant that is now there)? Ok all I got an interesting one for you. Well to me it seems interesting but who knows maybe common place. I purchase a property in Sept 07 with Section 8 tenant in place. Checks came in Sept. then Oct., I then received a letter stating they reevaluated and change the tenants allocation. Was $700 in rent$667 paid by Section 8 and $33 paid by tenant, to $602 paid by Section 8 and $98 by tenantfine. Look I didnt really have time for this property and I got a really good deal if they I got $602 with no problems then that is fine with me. Sinde I wasnt getting the $33 so didnt care about the $98. I know I should but bigger prblems to deal with. So I got checks for Nov, Dec, Jan then for Feb no check but a letter form Section 8 saying you owe us 1806 for not passing inspection.I call them and they stated that is the wrong letter you didnt not pass inspection your tenants vacated the property in Oct so you need to pay us back for 3 Months. One of the Sec. 8 property owners has criminal charges against them. The current voucher holder is wanting to move to a property owned by this individual and states that another individual (grandmother) is the property manager. Can a denial be justified because the actual property owner has charges? Also, what documentation is needed for any property manager to sign documents?

My tenants have not paid for 4 months rent. I was wondering do I have to contact the section 8 about this? I was afraid if I did, section 8 would stop our payment and we will not have payment all together. What should we do? I've tried calling and visiting the tenants, but to no luck. My girlfriend and I recently purchased a house in New Orleans East, renovated it and are now about to rent it out via Section 8.My dilemma is HANO is only going to pay $700 toward the $1400 rent and the renter is proposing to pay the other $700 per month. Our agreement with HANO will state we are charging the tenant $700. My question is, what recourse do i have if my tenant doesn't pay their portion of the rent?Since HANO is paying their half on time (presumably), can i still evict the tenant at any time? If my tenant isn't pay the remaining portion on time can i have them evicted? Can i then sue them for the total amount due on the lease if, let's say they have 2 month's back rent and another 7 months on the lease?My girlfriend and I are newbies to renting and we are not really comfortable with Section 8 housing if we are only going to be paid $700 instead of the normal going rate of $1400.Any thoughts/suggestion/prayers are welcomed!

I have a property in Maryland that has a Section 8 tenant. I went to raise the rent from $1000 to $1050. The Section 8 office denied the increase because they said they could not find any comps in the area that support the increase. I asked for their process on obtaining this info. They said they look in the newspaper for comps and couldn't find any. Any one have any advice on fighting this and getting the increase approved.

We have a tenant that we delivered a notice to a year ago Aug. that we will not be renewing the lease.To this date she is still in our home the state is still paying during the eviction process but I cant get access to the house and am trying to go through the evviction process. She counter sued and one seeing that I did not give her a statement of condtion but she has been labled a tenant in suffereance. I am know going to court again for the eviction which she is delaying asking for a trial. I still can not get acces to my home to show to perspective buyers. What else can I do?

Help! This tenant has been a nightmare since she moved in.She is my first section 8 tenant(and possibly the last) I finally hired an attorney to help. We tried to make a deal with the tenant and her legal aide attorney to avoid eviction,but tenant apparently never signed the papers that her attorney drew up.So tenant was not out by the agreed date, I called my attorney to file eviction. The same day tenant was to be out,I get a call from another attorney stating that her company has been retained to collect damages from a window that fell on this tenant, (while residing in my property) back in May. When she moved in the place was inspected by section 8, they approved the place after I did a few things in the basement. As far as I know there wasn't a problem with the window. I did get a call from her stating that the window had fallen out of the track. They have taken abatements for repairs not made in time (but most of damage was caused by the tenants and shouldn't have been abated under the HAP contract to begin with. But, I've also heard some people on this board say they couldn't wait to get rid of their last section 8.Whats the general opinion on Section 8 rentals?
