Not Every Short Sale Seller Pays Taxes on Canceled Debt
2009-08-31 07:00:00 An average short sale seller may not really understand the tax consequences that may occur over the issue of canceled debt in a short sale. All sellers who are contemplating a short sale should get legal advice, but equally as important is to receive tax advice from a qualified and competent tax adviser. It's possible that certain types of canceled debt may trigger tax liabilities on a short sale. The law is complex. In particular, the possible ramifications of hard-money loans such as equity loans or cash-out refis should be discussed beforehand with a tax accountant. If the seller did not use that money to improve the home, it's possible that the seller may owe taxes when all is said and done . . . read more about canceled debt. How a Short Sale Benefits the Seller
2008-06-10 10:44:00 One reason why there are so many short sales on the market today is because so many homeowners are under water. This means that a homeowner purchased a home for a price that is higher than what the home is worth now. This means that if the homeowner is behind on their mortgage, they will ...

Passive Seller vs. Motivated Seller
2008-06-04 03:12:00 We receive calls from homeowners who are considering an auction as a method of selling their home. These potential auction sellers will basically fall into two categories: a passive seller or a motivated seller. The passive seller has a predetermined dollar figure in mind they want from the sale of their home. In a lot of cases, it is very unrealistic. They are very demanding of the auctioneer. They do not want to spend a lot of money in marketing the property for an auction, but they want a lot of people to show up at the auction. They have been told by friends, neighbors, or realtors, not to take less than such and such for the home. This kind of seller does not fit the auction criteria. The motivated is very realistic and understands the current market. While not wanting to give away there home at auction, they understand the market value is determined by a group of potential buyers and the hidden costs of holding onto the property for an exten...
A Seller who Remembers Being a Buyer
2008-06-02 21:06:00 What a difference there is between sellers who have recently been buyers and those who bought years and years ago. The sellers who have recently been buyers have a much better appreciation for what attracts buyers in the marketing of their homes. They were in the market recently enough to remember the frustration of no photos, no virtual tours and skimpy descriptions. They remember dealing with sellers who were not savvy about how much the market had changed over the years. Several years ago, a buyer mentioned to me that she just figured that a listing with no photo meant it was too ugly for a photo, when the reality is that the agent often hasn't gotten around to it. By the time the photo gets attached, the property is old news. What has really surprised me is how wide-spread this notion is -- that a photo-less property is somehow less of a property. Sellers (and their agents) who don't realize what buyers want to see when they're shopping...
A Truly Prepared Seller
2008-05-31 18:18:00 I have a new listing that came on the market yesterday in Largo/Upper Marlboro. What strikes me about this property is that the seller had a plan that didn't start yesterday -- she started 2 years ago. She's owned the property for a while and has been smart about using some of the equity that she's built up -- she has used it to upgrade and maintain the property. The house was built in 1985, so one of the first things she did was put on a new roof and add gutter guards to the gutters. She did the bigger things first and the more cosmetic things as she got closer to being ready to sell. Did a little maintenance on the sump pump, replaced the kitchen floor, updated the bathrooms and so forth early on. Just before going on the market, she put in new carpeting and painted. Outside, she had the yard cleaned up long enough ago so that it doesn't look scalped now. Minor pruning and edging just makes it look better, not de-nuded. Sometimes yo...
"Is Time Always on Your Side?" - Seller loses in Court.
2008-05-26 23:54:00 This legal article provided as as public service by W. Adam Mandelbaum, Esquire, Attorney-at-Law who has his law practice at 10 Audrey Avenue, Oyster Bay, New York 11771. He can be reached at (516) 624-0240 or go to his website: http://justiceneversleeps.net.- "Time, Time, Time Is On Your Side -- Or Is It? -- A provision of the contract required the sellers to deliver to the buyer a certificate of occupancy covering the building and all improvements thereto, including its finished basement. The day before the scheduled closing, the sellers, without having obtained a certificate of occupancy for the basement, purported to adjourn the closing. The buyer, claiming, inter alia, that the sellers had breached the contract, filed suit to recover his down payment. The appellate court held that, when the sellers sought to adjourn the "time of the essence" closing date which they themselves had set, their failure to perform constituted a material breach ...

Seller Buy-Down In Lieu Of A Price Reduction
2008-05-23 21:07:00 real estate,buy,sell,house,home,real-tor,agent,san antonio, market, relocating Seller Buy-Down In Lieu Of A Price Reduction When interest rates increase, fewer buyers can afford the payments associated with home purchases and fewer buyers can qualify and budget for the higher payments. When you factor in increased home values, buyers become priced out of the market. This is what causes the local real estate market to change from a "seller's market" to a "buyer's market". Simply stated, buyers have interest rate, payment and budgeting objections that they do not have when interest rates are low. The solution to this problem is often to use buydowns to lower the buyer's effective interest rate and mortgage payment and help them qualify. A real estate agent or loan officer who has an excellent knowledge of how to use buydowns will be able to answer many of these buyer-related objections and help consummate the sale. When a home buye...

It is a rare sight these days to have Urdu script in shops, markets and households.Earlier, I have posted similar photos like picture of Urdu nameplate on a Hindu household, but this photograph is different in the sense that it is taken in a region where there is hardly any conentration of Muslims. And, unfortunately, Urdu has become a language of Muslims in this country.Urdu Muslim India Islam Poetry Religion Hindu Shairi Ghalib Literature Ada Lucknow Meer Faiz Indian Muslim Blog Cricket Ghazal Blogger Islamic Hindi Kavita Shayar Sahitya

WHEN SELLER’S AGENT CLAIMS FEE FROM HOME BUYER - Singapore
2008-05-13 07:34:00 WHEN SELLER’S AGENT CLAIMS FEE FROM HOME BUYER - Singapore To pay or not to pay By Tan Hui Yee FEE DEBATE: The PropNex case is not unique in the HDB resale market, where more and more people are dispensing with agents. — ST FILE PHOTO  ONE week after The Straits Times reported that housing agency PropNex was suing two independent home buyers for not paying its agent a fee, the firm withdrew its case. The agent, Mr Ricky Low Yong Sern, had been hired by the seller of a $400,000 terrace house in Whampoa which marketing specialist Loh Yi Min and his wife, polytechnic lecturer Ariel Wee, bought last year. The couple had acted on their own without hiring an agent. They refused to sign the commission agreement to pay Mr Loh a fee equivalent to 1 per cent of the price of the property, which was classified as an HDB flat. Mr Low claimed he was entitled to the commission or a fee commensurate with the services that he said he had provided. PropNex dropped its landmark suit ...

A Short Seller’s Dozen: What Stocks Get Pumped, Must Come Down, Usual
2008-05-08 13:26:00 VRML Short 1,300 @$3.75 LGDI SUNV Getting up bright and early, I reserved shares in all three of these stocks to possibly short today, not knowing which I???d actually short. LGDI didn???t even trade for 5 minutes and when it did, it moved slower than an under-cooked lobster. SUNV didn???t breach the key $1.20 level until the afternoon (when I had no trades left), so it was all about VRML. I wanted to short into strength cuz it was a classic short covering rally from yesterday???s $1.75 pullback off the highs???given the magnitude of the declines and that it???s still up 300+% in a few days???on an ill-researched story thinking this near bankrupt company will do anything but go under???meant short sellers would be aggressive. Afraid I???d miss the probable pullback, I jumped the gun too early, shorting 1,300 shares at $3.75???as I watched it hang around $3.90 x $4 for another 30 min, I wasn???t very worried as the big buyer blocks were only on the bids???the wall of sellers at $4 ne...

eBay Find of the Day: Dwight?s Nissan Xterra for sale, seller wants a hybri
2008-05-03 20:07:00 "I am selling this truck in the hopes of buying a new hybrid for my growing family." That is the reason eBay user jeremg gives for selling his Nissan Xterra. His timing could not be better. You see, this particular Xterra was featured on The Office earlier this week (jeremg works for the show) when the plot revolved around Dwight selling the Xterra on eBay. Since jeremg owns the SUV and was able to score a signed script and a few other show goodies, off he went to eBay Motors. All the goodies - and the SUV - can be yours if you're willing to overpay for what the vehicle is worth. Our friends at Autoblog checked, and Kelley Blue Book values an Xterra in excellent condition at $9,715. Current bid for Dwight's Xterra is $15,300. So he's up five grand and change thanks to his star car. Still, jeremg has a ways to go before he can just use money from the sale of this Xterra to buy a Prius or a hybrid SUV (the latter would be my guess, considering jeremg made a point of "my growing fami...

Utilizing Seller Concessions in a Buyers Market.
2008-04-29 17:00:00 One of the most confusing part of the home buying process for new homeowners is the concept of seller paid closing costs or seller concessions. Seller paid closing costs allow for less out of pocket expense for the home buyer, but are rarely truly seller paid. Seller paid costs are actually buyer borrowed. Regardless, there is still a great benefit to having them.Let's examine real quickly how they work. Assuming an asking price of $100,000 with the buyer using an FHA loan that has a maximum of 6% in seller paid closing costs, a buyer could offer $106,000 with $6,000 towards closing costs. The seller is going to net out at the same amount, so they usually don't care and it helps the buyer close easier. The buyer could also offer the asking $100k with $6,000 going towards closing costs netting the seller $94,000. Considering the way the real estate market is, that could easily be accepted or there may be further negotiation. What can closing costs go towards? Title fees, pro...
How should a home seller approach the Orange County real estate housing mar
2008-04-29 04:12:00 It is extremely difficult to navigate in the current Orange County real estate market. Now more than ever it is essential to have an experienced Realtor® guide you throughout the process. There are numerous variables and market changes to continuously watch for: area short sales, foreclosures, local trends, detached versus attached pricing, etc. Be prepared to constantly reevaluate your pricing position within the market. The key ingredients to a successful sale are an excellent price and excellent condition. In arriving at price, the condition and location increase or decrease the market value. This market can also test a seller’s patience and you must be as prepared for a showing on day 120 as you were the first week. Stage your home for success: turn all the lights on, have soft music playing in the background, open all of the shutters and blinds to allow in natural light, turn on the air conditioning on hot days, box up and store all clutter and your home should...
Become The Next Great eBay Power Seller
2008-04-28 15:52:00 If you look on eBay, many of the more successful sellers have one thing in common..they have all reached power seller status on eBay. By reaching this milestone, it means they have sold a certain number of products and have received great reviews on the service. In turn this allows them to sell more items to more people because they now have a degree of reliability that will make the customer feel confident in their service. Many people who start on eBay don't intend to reach power seller status but they still want to make as much money as possible. What they don't understand is that the two go hand in hand. There are ways to become a power seller quickly but most of them are frowned upon by eBay. Their are eBay programs available on the internet that are able to show you the right way to get to be a power seller and what to do after you get there. These eBay programs are usually given out for free with the user only needing to pay a small shipping and handling fee. What you learn i...

Frustrations Of A Short Seller
2008-04-16 03:14:00 Awoke to discover no shares available to short of my top 2 potential plays—FEED and PSTI. PSTI was no biggie, it wasn’t a multi-day runner, but missing FEED pissed me off cuz it was a nice morning setup for a solid PREDICTABLE fall. Yesterday it looked like it was getting tired, but it still wouldn’t crack. Today, near the market open, there was a 14,000 share buy order at $15.40 and as that got taken out rather quickly, it was clear sign to short as longs who were up big over the past few days surely were afraid of a reversal. Sure enough, the morning tank was on as it quickly took out stop losses at $15 on its way to $14.70-ish, a nice 70 cent/share drop from an easy entry. Sure, it rebounded over the rest of the day—impressive really, but then again it’s a true breakout so I expect the stock to be stronger than a pump and dump—but the play here was to cover into the stop loss panic. Thoughts on Seller Financing Your Chautauqua Home
2008-04-13 21:37:00 Sell Your House - Finance It! Sell Your House - Finance It!By: Craig & Nancy GleasonEver thought about seller financing? It does not always work out that a buyer will connect with a seller that can afford to offer seller financing, but there is always the chance that it is worth asking. There are even a couple of new web sites that will assist you in setting it all up. However, there are risks involved with this sort of sale, even though they can also be very successful, so why would anyone want to become involved? One of the deciding factors will be how badly you want to sell your home and how much mortgage is owing on it. It is fairly difficult for sellers to find prospective buyers at the moment and it is also difficult for buyers to find financing. This means that the financial climate is right for both parties to try and find a solution outside the norm. However, you will need a very low mortgage or, ideally, no mortgage at all, to be able to follow this route. Often ...
What A Bad Horse Dealer/Seller Might Do......
2008-04-12 00:07:00 1) He/She may work the hell out of a green horse before the scheduled time you have set to view so that it's tired and quiet by the time you show up.Advice: Show up earlier than scheduled. Also, leave to think about it and show up a second unexpected day and ask to see the horse that you are interested in.2) He/She may "bute" or "banamine" a sore or lame horse to mask symptoms when showing you the horse.Advice: Pre-purchase Vet exam. You choose the Vet.3) Tell you the horse is younger than it really is.Advice: Know what you're buying. Again, pre-purchase vet check.4) Tell you this is a perfectly "kid-safe" horse. Their kids ride it all the time!Advice: Find out what level a rider their child is. Use your gut. Pay attention to the horse's cues. You can tell a lot by watching things like "ears" and movements, how it leads, tacks up, etc..5) He/She may tranquilize the horse before you come to see it.Advice: Watch for this. A tranquilized horse may be slow to react. Have a droopy low...

Buy a Home, Hope the Seller Dies
2008-04-11 20:17:00 In today's real estate market, it is becoming increasingly difficult to sell homes. While many builders are no longer offering incentives such as flat screen televisions to entice buyers, individual home sellers are still trying to lure potential buyers with creative offers. One such unorthodox idea is from a seller in western Wisconsin. According to the Minneapolis Star Tribune, Bob Fanning will name whoever purchases his home as the beneficiary of a $500,000 ten year term life insurance policy.
