2009-09-12 00:20:00 A Lincolnshire couple is suing the Church of Latter Day Saints for "therapeutic negligence" related to counseling their minor daughter received from the church. According to the complaint, plaintiffs Brian and Marcy (surname concealed) brought their daughter Karen to therapist Suzanne Daines, also a defendant, for counseling when Karen was 15. During the session, Karen relayed that four years prior she felt that her father would "watch" her inappropriately but the issue was resolved and there had been no similar behavior in the past four years, the complaint states. The complaint further states that the issue was discussed by Brian, Marcy and Karen with their clergy and a former therapist and that it was determined that a report of possible abuse was not required. Jewel Sued for Motorized Shopping Cart Crash
2009-09-10 22:55:00 A woman filed a lawsuit today against a supermarket for injuries she says she sustained after being struck by a motorized shopping cart. Plaintiff Raquel Goffin asserts that, while she was in the TCF bank area located within the Jewel food store on North Narragansett in Chicago, she was "struck in her back by a Jewel customer operating a motorized shopping cart." Goffin alleges, among other things, that Jewel Food Stores "failed to warn the Plaintiff of the dangerous condition of the area which allowed persons to operate motorized shopping carts in the TCF counter area thereby causing a danger to the TCF customer." According to the complaints, the defendant towing company employees would arrive at the scene of an accident unsolicited, offer to tow a driver's car, falsely state that the driver's insurance would cover the towing costs and then later refuse to release the car at the lot until full payment was made of the "excessively high towing, storage and other associated miscellaneous fees." United Methodist Church Daycare Sued for Abuse

According to the complaint, on May 7, 2009, defendant Jerome Morgan, an employee of the Marcy Center, a daycare center on S. Springfield in Chicago, "attacked, assaulted and battered" the minor plaintiff. According to the numbers, employee cases have increased by 59 percent over last year. On June 18, Canada became the first country ever to be brought to court for failing to comply with its legal commitments to combat global warming, specifically its failure to meet (and perhaps more to the point, their failure to do anything about) their mandatory legal obligations under the Kyoto Protocol.The lawsuit itself is being argued by a coalition of groups - most notably my former workplace, Ecojustice Canada - and seeks a declaration from the Court that the government has not complied with the law, and an order requiring it to do so. A decision is likely to occur in the coming months.For readers unfamiliar with Ecojustice (formerly Sierra Legal Defence Fund), I strongly recommend them as a worthy organization to support (I do so myself). 2008-06-04 04:35:00 A class-action lawsuit alleging that Microsoft deceived consumers has been given the green light by a federal court. The suit, fi led in Seattle, WA, alleges that Microsoft’s “Vista Capable” logo program—used on machines prior to the release of the OS—was intentionally misleading. Many of the PCs that sported the badge used Intel’s anemic 915 integrated graphics chipset, which was incapable of running Vista’s 3D Aero interface. Federal judge Marsha Pechman allowed the case to proceed based on a “price inflation” theory that consumers were tricked into paying more for machines with the “Vista Capable” badge. The company settled the charges three years ago. But the action is the most far-reaching yet against executives, who are accused of inflating revenue at AOL around the time of its 2000 announcement that it planned to merge with Time Warner.The allegations involve a series of online advertising transactions beginning in 2000 — a time when AOL was under increasing pressure to reach revenue targets to justify its merger with Time Warner — that eventually led to several earnings restatements.
