Supreme Court rejects Conrad Black's petition for release (hip hurray)
2009-08-11 00:05:00
Conrad Black, whose shadow darkened the Chicago Sun-Times with his theft and draining of every Conrad Blackneeded resource to turn a quality newspaper, will stay in the slammer. An Associated Press story reports today that Justice John Paul Stevens has turned down  Black's request to be freed from a Florida prison while he appeals his fraud conviction to the high court. This is good news to all of us who suffered under his "proprietorship," and would keep him in the federal pen for more than the six years he got for gutting a valuable community institution....

Sotomayor on Supreme Court shows Latinas can defy the odds
2009-08-06 21:30:00
Wise Latinas are celebrating the Senate confirmation of Sonia Sotomayor 68 to 31 to the United States Supreme Court. But this is a moment of pride for all Americans. It shows that no matter your class, race or ethnicity, if you work hard one can aspire to the highest court in the land. But let me explain why Judge Sotomayor means so much to Latina women like myself. It is in part her personal story, daughter of Puerto Ricans, raised in the Bronx, who goes on to succeed at Ivy League schools and defy the odds against her.How hard was it for her to defy these odds? Here are some sobering facts about Latina women in the United States:...

White firefighters win Supreme Court appeal WASHINGTON (AP) – The Supreme Court ruled Monday that white firefighters in New Haven, Conn., were unfairly denied promotions because of their race, reversing a decision that high court nominee Sonia Sotomayor endorsed as an appeals court judge. The ruling could alter employment practices nationwide and make it harder to ...
Supreme Court Renders Age Discrimination Impossible To Prove
2009-06-22 17:00:00
Many workers tend to believe that long tenure, a good work ethic and loyalty will be rewarded by their employer.  Instead of jumping ship, many have stayed at a particular company with the reliance that such allegiance will reap long term benefits. The Supreme Court just shattered such job security by making it more difficult for older workers to prove age discrimination....

President Obama nominates Sonia Sotomayor to the Supreme Court VIDEO TEXT
2009-05-28 02:30:00
REMARKS BY THE PRESIDENT IN NOMINATING JUDGE SONIA SOTOMAYOR TO THE UNITED STATES SUPREME COURTTHE PRESIDENT: Thank you. Well, I'm excited, too. (Laughter.) Of the many responsibilities granted to a President by our Constitution, few are more serious or more consequential than selecting a Supreme Court justice. The members of our highest court are granted life tenure, often serving long after the Presidents who appointed them. And they are charged with the vital task of applying principles put to paper more than 20 [sic] centuries ago to some of the most difficult questions of our time.So I don't take this decision lightly. I've made it only after deep reflection and careful deliberation. While there are many qualities that I admire in judges across the spectrum of judicial philosophy, and that I seek in my own nominee, there are few that stand out that I just want to mention.First and foremost is a rigorous intellect -- a mastery of the law, an ability to hone in on the k...

Over a Pajamas, they’re running my piece on yesterday’s California Supreme Court decision upholding Proposition 8: With the California Supreme Court upholding Proposition 8 yesterday, the initiative Golden State voters approved last fall to amend our state’s constitution to recognize only unions between one man and one woman as marriages, advocates of gay marriage have their ...
The California Supreme Court’s Illogical Prop 8 Decision

More at Zennie62.com | Follow me on Twitter! | Get my widget! On YouTube Tuesday, May 26, 2009 will go down as an eventful San Francisco day, sunny, and yet dark, and one that saw a lot of people marginalized who didn’t want to be. But then, who does. Before I turn to who said what, and who got arrested, I stick my head right into the belly of the beast, the California Supreme Court’s decision. Today, in first upholding Proposition 8, the voter-approved initiative to make same-sex marriage illegal that passed in November 2008, and yet protecting the 18,000 same-sex marriages that were done before the passage of the initiative, the California Supreme Court successfully stood logic on its head. I’ve just read the Court’s entire 167-page decision, and while I understand the reasons given by the majority of justices (six supporting the decision, one against it and even then the six judges that agreed were not perfect in their union) I’m concerned with the l...
The California Supreme Court Does Have A Brain After All
2009-05-27 00:39:00
The court has upheld “Prop 8″ which stated that marriage was between and man and a woman. Talk about a shock. So it appears that the voice of the voters does actually mean something. And it only took two tries to get it right.
CA Supreme Court Upholds Prop 8
2009-05-26 19:04:00
I believe the justices made the right decision this time. The decision was 6-1.  Now, the issue is developing a strategy to repeal the state constitutional provision defining marriage as the union of one man and one woman. And to do so in a manner which respects those who favor that definition. The court ...

?Legal Eagle? Special Ed Weighs In On The New ?Supreme? For Souter
2009-05-20 23:11:00
(And I also posted here.)I suppose as far as the WaPo is concerned, it?s merely enough to note that today?s columnist, Ed Gillespie (picture above with one of his pals), ?was in charge of the confirmation of Chief Justice John Roberts and played a leading role in the confirmation of associate Justice Samuel Alito? prior to allowing the former counselor to Dubya to display his own particular brand of hackery once more?As President Obama decides on a Supreme Court nominee to replace Justice David Souter, Senate Republicans must decide whether they will abide by the standard they used in confirming Justices Ruth Bader Ginsburg and Stephen Breyer during Bill Clinton's first term, or the standard set by Democrats in the confirmations of Chief Justice John Roberts and Justice Samuel Alito during George W. Bush's second term. This is one instance where changing their previous position can be a principled approach. In 1993 and '94, Republicans voted overwhelmingly to confirm Clinton's no...

Boxer Demands Obama Pick A Woman For Supreme Court
2009-05-13 15:14:00
More at Zennie62.com | Follow me on Twitter! Like other supporters, I received this email letter from U.S. Senator Barbara Boxer, but this one was pointed right at one of my favorite subjects: "Who should be Justice David Souter's replacement on the Supreme Court?" After not much stewing on the matter, I would guess, Senator Boxer wants it officially known: President Obama's choice must be a woman and she's taking to the Internets to make it known. I still favor Kathleen Sullivan for the job so no harm there; this is what Senator Boxer wrote: Dear Zenophon, Women make up 51% of our nation's population. Yet only 17% of the seats in Congress are held by women. Only 3% of corporate CEOs are women. And just one out of nine Supreme Court justices is a woman. President Obama can change that. Send an email to the White House now — and urge President Obama to nominate a woman to the U.S. Supreme Court! Since Sandra Day O'Connor's retirement from the Supreme Court ...

With younger Americans more favorably disposed to gay marriage, each year the number of citizens more favorably disposed to state recognition of the institution becomes eligible to vote.  The likelihood grows that should an initiative appear on the California ballot to repeal Proposition 8, it will pass. With that in mind, it’s imperative that should the ...

I had planned a post today on the hearing the California Supreme Court this morning on the constitutionality of Prop 8, but realized that I would basically be repeating a point I had made over and over again, with a slight twist to reflect the circumstances. Supreme Court Justice Charles Wells is Out. Who’s In?
2009-02-12 13:25:00
Florida Supreme Court Justice Charles Wells has decided to gracefully surrender the things of youth, take up crossword puzzles and start drinking during the day. What? Isn’t that what everyone does during retirement or just my relatives? Anyway, when Governor Charlie Crist isn’t contemplating a Senate run, he’s thinking about selecting Wells’ replacement. Dude has already appointed several right-wing nutjobs after giving in to social conservatives. Now groups like the American Family Association are itchin’ to get Judge Alan Lawson on the bench. They are trying to pressure Crist with calls, faxes, and emails urging him to appoint Judge Lawson like now. Gay rights, freedom of choice, and a continued progressive path are important to the rest of us. We don’t want Florida to go backwards. So let’s contact the Guv’na and make our voices heard.

Supreme Court Rules With Ohio Secretary of State on Voter Fraud Rules
2008-10-17 19:22:00
This has to be one of the dumber moves by the USSC I’ve ever seen… and trust me they’ve screwed up enough in my lifetime to make that count for something… The U.S. Supreme Court agreed with Democratic Ohio Secretary of State Jennifer Brunner, granting her a stay on Friday to a temporary restraining order from the 6th Circuit Court that ordered her to provide a system for implementing voter fraud prevention methods. The decision by the full court repudiates the lower court’s ruling siding with the Ohio Republican Party and ordering Brunner to verify records of about 200,000 of 666,000 new voters this year whose driver’s license and Social Security records don’t match information in other government databases. What the court has done here is empower those employing voter fraud. And yes, I include Brunner in that group.
