My single family 3BR house is optimally sized and most comfortable for two adults and two children, or less. Any more tenants and the property suffers from the additional load placed upon it (wear, tear, & damages). I know that HUD rules are that a 3BR house can house a maximum of up to seven occupants. Later that same night they sent her an e-mail saying that they had put a stop payment on the check and consider the lease null and void. The language in the lease states that the deposit is refundable only if the full term of the lease is completed. Can she go after them for this $2,000? In April, they put a stop payment on a check and said they're checking account information had been stolen and someone got access to their funds. I gave them until the end of the month to pay me. May rolls around and no check for last month and no check for this month. I call several days in a row and no response. When I finally leave a message that I'm going to have to start eviction process, they call back and say they sent me a 30 day notice that they're moving out June 1st. That's fine.My question is: I know they've taken care of the place...so they're deposit will cover their May rent but they still owe me for April. What steps should I take to recover this April payment if they are not forthcoming in paying it? Should I file a small claims BEFORE they move out? We have spoken with three qualified prospects (per the L.P.A. pre-screening tenant prospect card) since yesterday, emailed them our lease application, and interior pictures. All three have seen the exterior of the house and the yard in person. In order to show them the home we require that they fill out and bring a copy of our completed application. There is no fee for this unless we get to the point of a credit and background check.The problem is that no one is following through. Is requiring the lease application be filled out before we show them the home too restrictive? We tell them there is no obligation if they don't like the house. What's wrong? TXAlso, 60% of all prospects we speak with have pets. If we had a strict no pet policy we would reduce our prospects by 60%. Do other landlords face this same problem?

I agreed to have the mold fixed. The buyer who is a contractor agreed to repair the mold himself since it was not that bad, my realtor did not get that in writing from him (stupid I know). Now several months later they have stopped paying rent and the buyer says he is too busy now to fix the problem and wants it fixed. I agreed to fix it, now they want out completely with all their option money back. Since they are behind 3K in rent now would they be entitled to the whole 8K back that they put up for down payment?

Left a pile of trash behind, including leases from two other homes.I've contact these previous landlords to find a similar pattern; intially excellent renters with rent paid on time, only to begin with excuses on why rent was going to be a few days late (although still paid) and finally, moving out suddenly with no notice.Neither former landlord chose to attempt to find these folks to take legal action against them. We feel she should sign that she has left. And she broke the lease. Month to Month.And start a new Lease.What is the law on abandonment.

2008-04-01 21:02:00 Our tenants lease was up on March 31. We notified them on March 1 that we would not be renewing their lease. They did not pay their March rent on time, we gave them a 3 day pay or vacate notice. They did not pay or vacate. I called them several times. When I talked to them on the 15th they said they could get help for $500 from the VA, but we had to prove to the VA that we own the property (we have an owner contract, the county records still show the previous owner). Their rent including late fees is $900. They said they would have the $400 on the 21st. When I called on the 21st they answered and immediately hung up the phone. I called on the 26th and left a message. I called on the 29th and left a message. I called yesterday the 31st to schedule their walk-through and they said "we're not moving we haven't found a place, we have no where to go"!
