Fantastic Sams allege-s that Regis convinced the corporation that owned the right to develop and grant third parties FANTASTIC SAMS franchises in the Seattle-Tacoma market to sell its salons to Regis. Fantastic Sams alleges that immediately after closing on its purchase, Regis began operating the salons under its HAIR MASTER brand but failed to remove all of the FANTASTIC SAMS marks from the premises. A year ago they announced the series would be coming to the Wii and the DS. The Wii version has already arrived, but a DS version hasn’t been talked about yet. On January 19th Activision registered a product called “Guitar Hero On Tour” with the United States Patent and Trademark office. Two distinct possibilities exist for this game given the title: either we’re looking at a game for portable devices (likely either a DS or cellphones) or an all-live-recording version of the game. I wrote about how Ferrari had just lost a ten year battle to prove its horse constituted a famous mark such that it did not need to register it in China to achieve trademark protection there. I made clear that the best way to avoid such fights is simply to register: Our advice to all our clients is to register their trademarks in China before they go there. China is a first to register country and this means that whoever registers the trademark first gets it. Yes, there is an exception for famous trademarks, but unless you are Coca-Cola, it is lunacy to bank on a Chinese court holding your trademark is famous when just going ahead and registering it costs so little. Most firms charge less than $5,000 for this. So even if the Chinese Court rules your trademark is famous, you will almost certainly have spent well over $5,000 in making your case.
