Obviously, thousands of seniors will be left hung out to dry by the city. 2008-06-05 07:00:00 Debt seems to spread like some sort of virus among the consumer populace of the United States. Of course, acknowledging the problem is just the beginning. The most important question is this: How can you tell when you are headed for serious financial and debt problems?
Hunt Them Down Like Animals.- Take Everything They Own : Have No Mercy for
2008-06-04 16:10:00 by Janet Phelan from Americans' BulletinThe lengths to which the guardians will go to secure their dominion over the assets of their charges are revealed in the Lopez case.In 1980, Nellie Lopez gave birth to her only child, Jacqueline Salazar at a hospital in New York. There were problems with the delivery, and as a result, Jacqueline Salazar was horribly injured, and sustained severe brain damage, quadriplegia and scoliosis. She was not expected to live long, but her mother took action to ensure that was not the case. She sued the hospital, won a judgment of several million dollars, and quit her job as a city clerk to devote herself to caring for Jacqueline.New York law, however, stipulates that the courts appoint a legal guardian for an incapacitated adult such as Jacqueline when the individual reaches the age of 18.In 1998, the court saw fit to appoint a stranger as guardian for Jacqueline, even though the guardian is usually a parent or close relative. While the court evaluator,...

How Many More Stolen and Destroyed Lives?
2008-06-04 06:05:00 By LARRY MITCHELL - Staff WriterKay Roberts and her friends and relatives shake their heads in bewilderment when they talk about their experience with the Butte County public guardian and courts. They wonder why things happened as they did and whether their experience is typical or a fluke.County officials say if all the facts could be known, it would be clear why the public guardian intervened in Kay's situation. (Officials say confidentiality rules prevent them from talking about Kay's case specifically.)In fact, because questions were raised, Butte County administrator Paul McIntosh said, the County Counsel's Office investigated whether the case had been handled properly. In addition, the county had the case examined by an outside attorney with expertise in conservatorships. "Both reviews (showed that) our handling of the case was appropriate and in compliance with the instructions provided by the court," McIntosh said.Nevertheless, to a degree, the experiences Kay and her fami...

The Probate Cartel in an Amazing Act of Cruelty Prohibits Family From seein
2008-06-03 06:03:00 By LARRY MITCHELL - Staff WriterKay Roberts lost her home, some of her money and much of her freedom when she was put in a conservatorship under supervision of the Butte County Public Guardian's Office last year. The "unkindest cut of all," Kay feels, came when the county limited the ability of her son, Bill, to visit her or even talk to her on the phone. For a number of weeks last summer, Kay, who is 84, remained as a (prisioner)private-pay patient at Riverside Convalescent Hospital, where she was taken after treatment at Enloe Medical Center following a fall. It was a frustrating, uncomfortable time for her and her family and friends.Bill Roberts said his mother was unhappy and cried and cried. She feared she'd never leave the place and was convinced the county would end up taking all her money. "I've never seen a human being so distraught," he said. "She deteriorated so much. She just gave up."Judge Darrell Stevens had called a hearing for Sept. 18 to consider whether the public...

Kay Roberts , An Example of a Guardianship/Conservatorship at Work!
2008-06-02 07:01:00 By LARRY MITCHELL - Staff WriterDid William Roberts deserve to have Judge Darrell Stevens and the Butte County Public Guardian's Office restrict his ability to visit his mother?Just like the question of exactly why the county put Kay in a conservatorship and took charge of her life last year.Last fall, the public guardian and court put Kay in a conservatorship, froze her bank accounts and removed all her possessions from her apartment and locked them up in storage. An estimated $40,000 of her money was spent by the county. Also, Bill was told he couldn't visit his mother without the public guardian's approval, and even then, there would have to be a chaperone present.Kay hasn't seen her son as much as she's wanted over the last year. "It's hard. It's really hard," she said, in tears, as she spoke with a reporter earlier this month. "My son is my only joy. Without him, I wouldn't have a life."What's happened to Kay and Bill is an outrage, said Mel Jones, an old friend of the ...

?Disability? No deterrent to IRA- The Fleecing of Our Parents
2008-06-02 06:00:00 May 30th, 2008 by Estate Of Denial.ComThe Involuntary Redistribution of Assets (IRA) cases highlighted here at Estate of Denial portray some seriously ugly actions. Anyone thinking otherwise should spend time reading our News Archive.Today?s archive addition is a story out of California (http://www.estateofdenial.com/-?p=376) regarding a lawyer who is charged with embezzling more than $110,000 from an estate managed by the lawyer for a man under treatment for a psychotic disorder.IRA cases are about opportunity and practitioners recognize impaired individuals as potentially lucrative revenue generators. It?s that cold, it?s that calculated. Yesterday?s posting about Ryan Cuthbert and his family illustrated the point. We see this California case as a noteworthy follow-up.--------------------------A friend of mine recently told me, predators ( Time, Disease, Abusers)weaken and set the victim up, then the opportunists, vultures move in for the kill! It's so sad our justice system has com...

A Detective?s Case Files Of Exploitation
2008-05-29 02:41:00 by Joe RoubicekWhile the number of violent crimes in the U.S. is decreasing, financial crimes against the elderly are increasing as a result of the aging of the population and greater concentration of wealth among older people. According to a 2005 Senior Forum Report by the White House Conference On Aging, only one in 100 cases of financial abuse is reported, and there are millions of financial abuse victims each year. The money is certainly there for the taking: persons over 50 control at least 70% of the nation?s household net worth. 75% of victims of financial abuse are between the ages of 70 and 89. The majority are female, frail and mentally impaired. With each new case I realized that the key is not deception of the elderly, but exploitation of common disabilities this population suffers. Exploiters were being recognized as crafty scammers when they were simply exploiting the victim?s disabilities.I had no idea at the time that my law enforcement career was about to focus on a b...

Warning Signs that You may Need a Pair of Eyeglasses
2008-05-13 20:15:00 People have been plagued with poor vision for decades. In the past, people were usually unaware that some of the symptoms they were feeling were true indicators that they actually required a pair of glasses. In the past, these symptoms were often overlooked and ignored as a mere headache. Nowadays if you are feeling some of these symptoms you can and SHOULD book an eye check with your doctor. However, you need to be aware of some of the symptoms of early eye problems so you know when you need to book that eye appointment before your problems develop further. The most telling sign that you need a pair of eyeglasses is if you are experiencing blurry vision and headaches. Most people attribute this to feeling under the weather or other external factors, but the truth is if you experience blurry vision and/or headaches for more than a couple days you should immediately book an eye appointment with your doctor. These symptoms are very serious and suggest that there is a good chance you w...

2008-05-11 00:00:00 By Suzanne Sege and Robert MainerWAYLAND -MASS. USA Mary Lauby, executive director of Jane Doe Inc., recently shocked the members of the Sudbury-Wayland-Lincoln Domestic Violence Roundtable by pointing out that over the past 14 months there have been 64 domestic violence related homicides in Massachusetts."If the commonwealth had 64 cases of West Nile Virus over the same length of time, state officials undoubtedly would declare an emergency and mobilize the state?s public health and public safety resources to stop the spread of the disease," Lauby said."And in the unlikely event that our officials didn?t recognize their responsibility to protect public health, there would be a deafening chorus of voices demanding action. So, where?s the outcry about the social justice problem called domestic violence that has killed 64 people in our state?"Jane Doe Inc. is a statewide coalition of agencies that provide services to victims of domestic violence. A Crisis We Can, and Must, Avoid
2008-05-08 00:42:00 By Ken Connor Christian Post Guest ColumnistThere is a crisis brewing in America. It has financial and moral implications that will impact our nation for generations to come. The problem? Too many baby boomers, too few babies.America's frail elderly are already at risk for abuse and exploitation. Apart from the unborn, there is no group that suffers more from the "disposable man" ethic that is the legacy of Roe v. Wade. All over America, our elders in long-term care institutions suffer from abuse and neglect. But the perpetrators are not only to be found in nursing homes and assisted living facilities. Sadly, the largest group of perpetrators is to be found among the families of the victims.A recent study by the National Research Council estimated that there are between one and two million cases of elder abuse in the U.S. The Senate Special Committee on Aging estimates that there may be as many as four times as many cases of elder abuse that go unreported. How much worse is the pr...

Con Artists Stealing Guardianship of Senior Parents
2008-04-08 13:05:00 By Matthew Paulson,Senior adults have been targeted as easy victims in a number of different scams for the last two decades now, and it's only getting worse. Instead of just stealing money from them or ripping them off, con artists are now actually stealing guardianship of many senior adults. Some criminals have figured out that they can assume guardianship of elderly individuals just by telling a judge they are no longer mentally stable. When approaching a judge, these crooks don't have to do anything to prove that they are related to the individual they are trying to assume guardianship of. Courts are so busy and over-packed with cases that they just don't have the time or resources to make sure that the person making the claim is on the up and up. There's no easy way to find out when this occurs, so family members often have no idea that someone is stealing guardianship of their parents and simply have no recourse in the event that it happens. Usually the ruling happens quick...

Ovarian Cancer - 7 Early Warning Signs
2008-04-06 19:28:00 Ovarian cancer is often called "The Silent Killer" because the symptoms are so nonspecific and are often blamed on something else. Thus it is possible to have been experiencing early warning signs of this disease for years and not realize anything is seriously wrong. This is very understandable, as the symptoms, if they are seen at all, most often seem benign at first. However, if you have had one or more of these symptoms for several weeks or months, please consider calling your physician and scheduling a check-up. Cancer is a scary word and most people would prefer to just assume everything is fine and hope whatever is bothering them simply "goes away." However, consider that ovarian cancer statistics show that 70% to 80% of diagnoses are made in late stages when the prognosis is not so good. To give yourself the best chance at long-term survival and even a complete cure, these are 7 of the symptoms to watch out for:1. Persistent indigestion.2. Bloating, feeling of fullness, tight...

G'ship Stories Keep Coming In !
2008-04-05 13:00:00 This is my mother, Doris Denney. During her active life, she was hard working and honest to a fault. She is currently in a wheelchair due in large part to Care Planning Associates' (a "professional" guardian) neglect. For a paltry six week guardianship, that company and its parasitical attorney ripped off eighteen thousand dollars from her. That was money she worked hard for, sacrificed for, and counted on to buffer the anticipated ravages of old age. It was money that was in no way earned by the guardianship and its free-loading attorney. Since there was considerably more money to be had, the guardianship made every effort to distort her life to keep themselves in her accounts. They were not able to continue their plunder, but Commissioner Carlos Velategui had no trouble gifting them with the obviously stolen eighteen thousand dollars. The court, in every way, gave evidence of a corruption as profound as that of the guardians. In truth, the guardianship commissioners and judges sh...

Duane Lee Ortiz put on a good show, talking his way into Cline's condo in Yakima by offering to wash her windows inside and out. While he was at it, he'd shine up the mirrors, too. He was down on his luck, he told her, and just needed to make a little money. "You have this kind of maternal feeling toward him. I just let him have the run of the house," she said. Sure enough, a day later when Cline went to put onthe diamond ring her husband had given her two years before he died, it wasgone. Yakima police immediately suspected Ortiz, who two years earlier hadswindled more than $100,000 from a retired machinist living in aYakima mobile home court. For that crime, prosecutors had to plea bargain and ended up with only a seven-day sentence."The punishment did not fit the crime," recalled Therese Murphy, deputy prosecuting attorney for Y...
