Virginia partial birth abortion law overturned again by federal court

The 2003 Virginia law to ban so-called "partial birth" abortions have been overturned again by a panel of the federal 4th Circuit Court of Appeals. The U.S. Supreme Court allowed for a similar federal measure to take effect and sent the Virginia law back down for reconsideration but thus far, the reconsideration has yielded the same result.The federal judicial panel's rationale for striking down the Virginia late-term abortion law was because of a slight difference between it and the federal law. Unlike the feds, the Virginia measure allowed for prosecution of doctors who intend to perform standard second-trimester abortions that become the illegal type of abortion. The panel thus classified the Virginia law again as placing an undue burden on women seeking abortion and struck it down.----Apparently, clear instructions from the U.S. Supreme Court just will not dissuade the 4th Circuit. The Maryland Terrapins have been slotted to face the George Washington Colonials while the Virginia Tech Hokies will meet the Navy Midshipmen in the 2008 BB&T Classic , reports the Washington Post. The men's college basketball event will be held December 6 and be televised by MASN.The announced lineup doesn't seem very inspiring at first glance. While it would have been great several years ago, Maryland vs. George Washington isn't all that compelling now. Maryland has all but become an NIT perennial while the George Washington program fell last season into outright disarray. Navy did improve in Patriot League play last season but to credibly believe that it can take Virginia Tech is a stretch.While granting that the BB&T Classic does raise money for charity, the seemingly irreversible falloff in its marquee value points to an event that has outlived its usefulness. The Washington Bayhawks pro lacrosse team will become the second area team to begin its regular season this weekend, its second season as a D.C. area franchise. Play opens for the Bayhawks this Sunday against the two time defending champion Philadelphia Barrage at Virginia Beach, Virginia. The neutral site contest is technically a home outing for the Barrage, an official travel team this season. The Bayhawks start actual home play next Saturday at the team's new George Mason Stadium home.Sunday's outing, former player Jerred Testa's first as the Bayhawks head coach, will air live on Comcast SportsNet Mid-Atlantic at 2 p.m. Eleven of twelve Bayhawks games this season will be televised by Comcast SportsNet, three live. Big Brown overcame a field of eleven other contenders with the greatest of ease to win the 2008 Preakness Stakes at Pimlico galloping away. The impressive enough 5 and a 1/4 length win could have been much more had jockey Kent Desormeaux not eased off to save him for the Belmont Stakes. The 133rd Preakness Stakes win marks the second Triple Crown jewel win in a row for Big Brown after a similarly impressive Kentucky Derby triumph. Only the Belmont and a confrontation with track fave Casino Drive, a major threat according to the radio analysts, stands between Big Brown and Triple Brown glory.In a bizarre twist, Big Brown paid $2.40 to win but $2.60 to place (1st or 2nd), a statistical incongruity that showcased just how many casual fans bet Big Brown to win. The Washington Mystics open their 2008 regular season tonight at the Indiana Fever, hoping to retain last season's momentum which, after a disastrous start, drew them only a game out of a playoff berth. Tree Collins returns with his interim task replaced with a full head coach label.This year's versions of the Mystics may have to develop some momentum all their own though, tending towards the young side with Nikki Teasley and DeLisha Milton-Jones departed. Crystal Langhorne joins the squad as a forward/center fresh off her wildly successful run with the geographically proximate Maryland Terrapins. In a followup to an earlier note, the Washington Mystics women's pro basketball franchise confirmed that its audio / radio game broadcasts have moved for the new 2008 season from WWRC/1260 to a Web only feed via WashingtonMystics.com. The Mystics join their fellow Lincoln Holdings-owned team, the Washington Capitals, in broadcasts being moved away from Clear Channel Washington radio. In symbolic terms, the loss of a broadcast radio flagship is highly unfortunate. In practical terms, the Mystics just saved some money for a radio time buy with little true loss of reach. WWRC had proven virtually unlistenable with a severely degraded signal during nighttime hours. By one vote, California overturns gay marriage ban

The California Supreme Court took the path not taken in Maryland, overturning a state law that had banned same-sex marriage as being against its state constitution. One vote again made a difference as California's ruling that overturned the ban was on a 4-3 vote. Maryland's Court of Appeals decided by a 4-3 count last year to instead uphold its state law against gay marriage.Whether or not California gay marriage legalization can survive an expected November constitutional ballot referendum, it remains my belief that the tide of progress will eventually allow for such couplings in most of the United States. To be sure, there will likely always be holdouts such as Virginia among the band of states with constitutional bans. Ultimately though, it will be the individual stories of people simply wishing basic societal recognition of their dedication to their partners that will win the day for most Americans.
